החלטה

לפניי בקשת רשות ערעור על החלטת בית המשפט לעניינים מינהליים בתל-אביב-יפו מיום 10.7.2013 (כבוד השופטת ד"ר ד '
אבניאלי ),
בה אושרה הגשת תובענה ייצוגית נגד המבקשת (להלן – ההחלטה ) .

עניינה של התובענה הייצוגית נשוא בקשת רשות הערעור הוא בסיווג "מכוני קוסמטיקה, מכונים לטיפוח הציפורניים ומכוני קעקועים" לשם גביית ארנונה בעיר תל-אביב-יפו. לטענת המשיבים (שהם התובעים המייצגים בהליך) היה על המבקשת לסווג מכונים אלו כ"בתי מלאכה", סיווג שלגביו הארנונה הנגבית היא בשיעור מופחת. טענתם של המשיבים נסמכת בעיקר על פסק-דינו של בית משפט זה בבר"ם 4021/09 מנהל הארנונה של עיריית תל-אביב-יפו נ ' חברת מישל מרסייה בע"מ (20.12.10) (להלן – עניין מרסייה ). בעניין מרסייה נקבע כי על אף הקושי הפרשני הטמון בדבר, בהינתן הקטגוריות הקיימות לסיווג נכסים לעניין גביית ארנונה בתל-אביב-יפו, יש לסווג מספרות כבתי מלאכה. לטענת המשיבים, יש להחיל קביעה זו שנעשתה בעניין מרסייה , גם לגבי המכונים שבהם עוסק ההליך דנא. המבקשת חולקת על עמדה זו. בבקשה לאישור התובענה הייצוגית נתבעת השבה של הסכומים שלפי הטענה נגבו ביתר על-ידי המבקשת בשנתיים שקדמו להגשת ההליך. כאמור, בית משפט קמא אישר את הגשת התובענה הייצוגית, ומכאן בקשת רשות הערעור שלפניי.

דין בקשת רשות הערעור להידחות בלא שראיתי צורך להידרש לטענות המבקשת לגופן. לאחר שניתן פסק-הדין בעניין מרסייה , שבה והועלתה בפני בבית משפט זה במספר הזדמנויות שאלת סיווגם של נכסים לעניין גביית ארנונה תחת הקטגוריה של "בתי מלאכה" (ראו, בר"ם 7383/11 ריבנאי נ '
מנהלת הארנונה עיריית רמת גן (22.12.2011); בר"ם 2968/11 אר. אם. אלקטרוניקס ישראל בע"מ נ ' מנהל הארנונה בעיריית ירושלים (2.12.2013); הליך נוסף העוסק בסוגיה זו תלוי ועומד בגדרו של עע"ם 2503/13). אולם, ככל שמ דובר בהליך דנא, סבורני שבקשת רשות הערעור אינה עומדת בקריטריונים שנקבעו בהלכה הפסוקה למתן רשות ערעור על החלטה המאשרת הגשה של תובענה ייצוגית (ראו, רע"א 8761/09 סלקום ישראל בע"מ נ ' פתאל (6.5.2010) (להלן – עניין סלקום )). לענייננו, אחד התבחינים שנקבעו בעניין סלקום למתן רשות ערעור הוא משמעות קבלת התובענה הייצוגית מבחינת הנתבע. בבקשת רשות הערעור דנא אין כל טענה מפי המבקשת לעניין זה. די בכך כדי להביא לדחיית בקשת רשות הערעור (השוו, רע"א 4695/13 צמנטכל ניהול נכסים בע"מ נ ' בלוך , פיסקה 3 (25.10.2013), והאסמכתאות שם).

יודגש, כי אין בדחיית בקשת רשות הערעור כדי להביע עמדה כלשהי לגבי טענות המבקשת. את טענותיה תוכל המבקשת להעלות בבית משפט קמא וכן בערעור על פסק-הדין הסופי בהליך, ככל שערעור כזה יוגש על ידי מי מבעלי הדין ויהיה בכך צורך.

בקשת רשות הערעור נדחית. המבקשת תשא בשכר-טרחת בא-כח המשיבים בסכום של 20,000 ש"ח.
