החלטה

לפני שתי בקשות רשות ערעור על החלטת בית המשפט המחוזי בירושלים מיום 25.11.2014 (עת"מ 41924-11-14, השופטת ש' רנר) . בהחלטה זו נדחתה בקשה למתן צו ביניים שיעכב את ביצוע צו הסגירה שהוציא משרד החינוך (להלן: המשרד ) לבית הספר "סטודיו אנקורי" הפועל ברחוב עזה בתל- אבי ב-יפו (להלן: בית הספר ). הבקשה הוגשה על-ידי חברת מפעלי אנקורי (1971) בע"מ (להלן: אנקורי או המבקשת ), המפעילה את בית הספר, היא המבקשת בבר"ם 8172/14, וכן על-ידי אמהות לשלוש תלמידות הלומדות בבית הספר (להלן: האמהות ), הן המבקשות בבר"ם 8173/14.

ביום 27.2.2014 הגישה אנקורי בקשה לרישיון עבור בית הספר, במסגרתו ציינה כי בכוונתה לפתוח חטיבת ביניים "צומחת" שעתידה להפוך לתיכון שש שנתי, מכיתה ז' ועד כיתה י"ב. ביום 18.3.2014 נדחתה בקשתה על הסף, בנימוק שאחד הטפסים שיש לצרף אליה, טופס התאמת תשתית, אינו תקין, וכן שלא הוגש היתר בניה למבנה בו אמור לפעול בית הספר (להלן :
המבנה ). החלטה זו הומצאה לאנקורי ביום 10.4.2014. ביני לביני, כבר ביום 24.3.2014, הגישה אנקורי למשרד אישור מטעם העירייה כי היתר הבנייה של המבנה לא צורף, מאחר שזהו בניין המיועד לשימור ונבנה בטרם נחקק חוק התכנון והבניה, התשכ"ה-1965.

ביום 5.5.2014 הגישה המבקשת ערר על דחיית בקשתה לוועדת הערר הפועלת לפי חוק פיקוח על בתי ספר, התשכ"ט-1969 (להלן, בהתאמה: ועדת הערר ו- חוק הפיקוח ). ביום 29.7.2014 דחתה ועדת הערר את הערר שהגישה המבקשת, תוך שציינה את החשיבות הנודעת להקפדה על מילוי הוראות נוהל רישוי ונוהל הכרה – בית ספר חדש בחינוך המוכר שאינו רשמי (2013) (להלן: הנוהל ). ועדת הערר ציינה כי דחיה על הסף של בקשות רישיון שאינן עומדות בדרישות הנוהל מאפשרת למשרד להתמקד בבחינת הבקשות הראויות להשקעת המש אבי ם הכרוכים בהליך הבדיקה. ועדת הערר הדגישה כי אנקורי תכננה לפתוח את בית הספר במבנה אחר, ורק שבועיים לפני המועד האחרון להגשת הבקשה לרישיון לפי הנוהל החליטה להעביר את מיקום בית הספר, ומטעם זה אנקורי לא הייתה ערוכה כראוי להגשת הבקשה אשר בצדק נדחתה על הסף.

על אף שלא ניתן לבית הספר רישיון, הוא פתח את שעריו בתחילת שנת הלימודים הנוכחית (ביום 1.9.2014), וכעת לומדים בו 26 תלמידים בכיתות ז'-ח'. ביום 9.9.2014 הגישה המבקשת לבית המשפט המחוזי בירושלים ערעור על החלטתה של ועדת הערר (עמ"נ 24808-09-14) (להלן: הערעור על החלטת הוועדה ). ביום 21.9.2014 הוציא המשרד צו סגירה לבית הספר על פי סעיף 32(א)(1) לחוק הפיקוח. צו זה נכנס לתוקפו 30 יום מיום מסירתו. לטענת המבקשת הצו נמסר לה רק ביום 26.10.2014 ומכאן שבית הספר אמור היה להיסגר ביום 25.11.2014. בהמשך לכך, ביום 6.11.2014 פנתה המבקשת למשרד בבקשה לעכב את סגירת בית הספר. משפניה זו לא נענתה, ביום 19.11.2014 הגישה אנקורי עתירה לבית המשפט המחוזי בירושלים כנגד צו הסגירה, ובמסגרתה ביקשה גם צו ביניים שיעכב את סגירת בית הספר עד להכרעה בעתירה כנגד צו הסגירה או לחלופין עד להכרעה בערעור על החלטתה של וועדת הערר. בית המשפט המחוזי דחה את הבקשה למתן צו ביניים, וקבע כי התנהלותה של אנקורי היא חמורה שכן היא מפעילה את בית הספר ללא רישיון ובכך עוברת עבירה פלילית לפי חוק הפיקוח. בית המשפט המחוזי הוסיף וקבע כי אנקורי פעלה בשיהוי כיוון שהגישה את הערעור על החלטת הוועדה רק ביום 9.9.2014, אף שההחלטה ניתנה כאמור עוד ביום 29.7.2014, וכן לא ביקשה שייקבע דיון דחוף בערעור. בית המשפט ציין בהקשר זה כי גם העתירה כנגד צו הסגירה הוגשה למעלה מ-20 יום לאחר שצו הסגירה הומצא למבקשת ובכך העמידה את בית המשפט בסד זמנים שהוא כמעט בלתי אפשרי. בית המשפט המחוזי קבע עוד כי סיכויי העתירה אינם גבוהים, וכי ככל שהעתירה תדחה יידרשו התלמידים בבית הספר לעבור ללמוד בבתי ספר אחרים בשלב מאוחר יותר של שנת הלימודים באופן שרק יגדיל את הנזק שייגרם להם, כך שיש לשקול גם נתון זה בגדרי מאזן הנוחות.

ביום 1.12.2014 הגישה אנקורי את הבקשה דנן, במסגרתה היא טוענת כי שגה בית המשפט המחוזי כאשר לא נתן משקל ראוי לנזק שייגרם לתלמידי בית הספר אם לא יינתן צו ביניים. המבקשת מוסיפה וטוענת כי היא כלל לא פעלה בשיהוי, אלא מיהרה לפנות למשרד עם קבלת צו הסגירה, והגישה את העתירה כנגד צו הסגירה רק לאחר שפנייתה בנושא לא נענתה. המבקשת מדגישה כי בקשתה לרישיון נדחתה בשל פגם טכני קל שאף תוקן בהמשך, וכי במבנה פעלו מוסדות חינוך שונים לאורך השנים, כולל בשנת 2013-2012, כך שכל המסמכים הנוגעים לו אמורים להיות ברשות המשרד וממילא אין כל קושי בהפעלת בית הספר במקום. באותו מועד הגישו האמהות בקשת רשות ערעור נוספת על החלטת בית המשפט המחוזי. האמהות מצטרפות לטענות אנקורי, ומצביעות על הנזק החמור שייגרם לטענתן לבנותיהן אם ייסגר בית הספר. הן אף צירפו חוות דעת מומחה לשם תמיכה בטענתן זו.

הבקשות הועברו לטיפולי ביום 2.12.2014, ובמועד זה הוריתי למשיבים להגיב להן. כמו כן, הוריתי על מתן צו ארעי המעכב את צו הסגירה עד למתן החלטה אחרת של בית משפט זה.

ביום 16.12.2014 הוגשה תגובת המשיבים לבקשות. המשיבים גורסים כי דין הבקשות להידחות. במסגרת זאת, מדגישים המשיבים כי חוק הפיקוח אוסר על פתיחת בית ספר ללא רישיון. למעשה, כך נטען, אנקורי מבצעת עבירה פלילית בכך שהיא ממשיכה להפעיל את בית הספר, ולכן אין להעניק סעד למי שעשה דין עצמי. המשיבים מוסיפים וטוענים כי קיים קושי בהמשך פעילותו של בית הספר אשר כלל היבטיו (בריאותיים, בטיחותיים ופדגוגיים) מעולם לא נבדקו בידי המשרד. כן טוענים המשיבים כי אין לקבל מצב בו שמוגשת בקשה חסרה לרישיון, ולאחר מכן מתווספים לה מסמכים נוספים "טיפין טיפין", כפי שקרה במקרה זה. המשיבים גורסים כי בהתנהלותה של אנקורי אף נפל שיהוי כבד וכי סיכויי העתירה שהגישה כנגד צו הסגירה הם נמוכים. לשיטת המשיבים, ההחלטה שלא להעניק רישיון לבית הספר היא סבירה וראויה ומכאן שאף סיכויי הערעור על החלטתה של וועדת הערר הם נמוכים. המשיבים מדגישים בהקשר זה כי אפילו יבוטל צו הסגירה ויתקבל הערעור על החלטת הוועדה, לא יהיה בכך כדי להעניק לבית הספר רישיון (אלא, לכל היותר, הדבר יוביל לפתיחת הליך לפי הנוהל לבחינת בקשת אנקורי למתן רישיון). בהתייחס למאזן הנוחות, טוענים המשיבים כי טובת התלמידים אינה מתיישבת עם לימודים במוסד בלתי חוקי, וכי אין לאנקורי להלין אלא על עצמה על כך שפתחה את בית הספר ללא רישיון. כן טוענים המשיבים בהקשר זה כי לא תהיה כל בעיה למצוא לתלמידים הלומדים בבית הספר מסגרות חינוכיות חלופיות.

לאחר בחינת הבקשות והתגובות להן, החלטתי, לא בלי התלבטות, לקבל את הבקשות, לדון בהן כאילו הוגש ערעור לפיהן ולקבל את הערעור.

השיקולים במקרה דנן הם מורכבים. סעיף 3 לחוק הפיקוח אוסר על פתיחת בית ספר ללא רישיון, וסעיף 32(א)(1) לו קובע כי מנכ"ל המשרד רשאי להורות על סגירתו של בית ספר הפועל ללא רישיון. הפעלת בית ספר ללא רישיון או בניגוד לצו סגירה היא עבירה פלילית (סעיף 33(א) לחוק הפיקוח). הוראות חוק אלה הן המסגרת הנורמטיבית לסוגיית הפיקוח על בתי ספר, מסגרת זו היא ראויה ואף מתחייבת – האחריות על חינוכם, שלומם ובריאותם של ילדים אינה עניין של מה בכך, ולא יכולה להינתן ללא פיקוח רגולטורי הולם. את הוראות החוק יש לאכוף, ויש לשבח את המשרד על מאמציו בתחום זה. כן יש לציין לטובה את מאמציו של המשרד לטפל בבקשות לרישיון במהירות וביעילות, כך שהתשובה לבקשה ואף החלטתה של ועדת הערר יינתנו עוד בטרם פתיחת שנת הלימודים, כפי שנעשה בהתייחס לבית הספר שבו עסקינן. לכן, צדק בית המשפט המחוזי כאשר שקל את התנהלותה של אנקורי, אשר עשתה דין לעצמה ופתחה את בית הספר ללא רישיון. לא זו אף זו: יש להבטיח בכל דרך שהפרקטיקה בתחום של פתיחת מוסדות לימוד חדשים לא תהיה בשיטה של הגשת בקשה, ואז: אם ניתן הרישיון – טוב, ואם לא ניתן – גם כן טוב.

יחד עם זאת, כידוע, בבחינת בקשה לסעד זמני ניתן משקל רב גם למאזן הנוחות, אשר בענייננו מערב גם את טובתם של צדדים שלישיים – תלמידי בית הספר. כידוע, ההקפדה על טובת הילד היא עקרון יסוד בשיטתנו. תקנה 7(ב) לתקנות חינוך ממלכתי (העברה), התשי"ט-1959 שעוסקות בהעברת תלמידים בין בתי ספר – סוגיה רלוונטית לענייננו ככל שבית הספר ייסגר – קובעת בהקשר זה כי בשעת הדיון בבקשה להעברת תלמיד תישקל טובת הילד. דומה שקשה לחלוק על כך שתלמידי בית הספר עלולים להיפגע מסגירתו במהלך שנת הלימודים. מבחינות רבות הנזק לתלמידים כבר נגרם בכך שהחלו ללמוד בבית ספר שלא קיבל רישיון. אנו נדרשים אפוא להשוות בין שתי רעות: המשך הלימודים של התלמידים בבית הספר עד להכרעה בעתירה, שצפויה להישמע במועד קרוב מועד, והעברתם לבית ספר אחר עוד קודם להכרעה בה. בנסיבות העניין, שבהן הדיון בערעור על החלטתה של וועדת הערר קבוע למועד קרוב והוא צפוי להתקיים ביום 6.1.2015 (לאחר שהדיון שהיה אמור להתקיים ביום 30.12.2014 נדחה לבקשת המשרד) וכאשר אין טענה כי נשקפת לתלמידי בית הספר סכנה מידית כתוצאה מהמשך הלימודים בו דומה שמאזן הנוחות נוטה לעבר מתן צו הביניים (השוו: בר"ם 5989/14 מנכ"ל משרד החינוך נ' הבית העגול – חינוך בדרך הטבע (8.9.2014)). בנסיבות אלה, איני מוצאת מקום לקבוע מסמרות בנוגע לסיכויי הערעור על החלטת הוועדה או בנוגע לסיכויי העתירה המכוונת כנגד צו הסגירה.

יודגש כי אין לראות בהחלטתי זו חלילה משום עידוד לעשיית דין עצמי, או מתן לגיטימציה לדרך התנהלות במסגרתה "נקבעות עובדות בשטח" עת בתי ספר נפתחים ללא רישיון. התנהלות זו היא פגומה ופסולה, וכפי שציינתי לעיל, יש לברך ולעודד את משרד החינוך לטפל בה בכלים העומדים לרשותו. בבר"ם 5776/13

(להלן: עניין מקום להיות ) ציינתי כי סגירת בית ספר פוגעת באופן טבעי בתלמידיו, אך הדבר אינו מביא בהכרח להטיית הכף לכיוון הענקת סעד שיאפשר את המשך פעולתו של בית הספר. קביעות אלה עודן שרירות וקיימות, אך מובן כי כל מקרה צריך להיבחן לגופו. בעניין מקום להיות פעל בית הספר ללא רישיון במשך שלוש שנים, קרי אי החוקיות שדבקה בו היא משמעותית הרבה יותר מבית הספר שבענייננו. כמו כן, באותו מקרה בית הספר צו הסגירה הוצא לבית הספר בטרם נפתחה שנת הלימודים – ולכן קיים שוני מהותי מענייננו בו מתבקשת סגירת בית הספר בעיצומה של שנת הלימודים. הבדלים אלה הביאו לתוצאה שונה בשני המקרים בכל הנוגע למתן צו ביניים. העקרונות החלים הם אותם עקרונות, אך האיזון ביניהם עשוי להשתנות בהתאם לנסיבות המקרה.

אם כן, אני מורה על מתן צו ביניים שיעכב את סגירת בית הספר עד להכרעה בעתירה המכוונת כנגד צו הסגירה או בערעור על החלטת הוועדה, לפי המוקדם מבניהם. מאחר שהטעם למתן צו הביניים נוגע לטובת התלמידים, אני מורה כי בתקופה שבה יחול צו הביניים ייאסר על אנקורי לערוך כל צעד שעניינו קידום הרשמה לשנת הלימודים הבאה, לרבות כל פרסום בקשר לכך.

בטרם חתימתי על החלטה זו, הובאה לפני בקשת אנקורי להשיב לתגובת המשיבים לבקשות, אך נוכח התוצאה אליה הגעתי לא מצאתי מקום להיעתר לה.
14.
סוף דבר: הערעור מתקבל, בנסיבות העניין, ובהתחשב בפגמים שנפלו בהתנהלותה של אנקורי שעשתה דין לעצמה, היא תשא בהוצאות המשרד בסך של 15,000 שקל וכן יישארו על כנן גם ההוצאות שהשית עליה בית המשפט המחוזי.
