החלטה

בקשת רשות הערעור וכן הבקשה לסעד זמני מצריכות תגובה. בהתאם לתקנה 34 לתקנות בתי משפט לעניינים מינהליים (סדרי דין), התשס"א-2000, תינתן התגובה על-פי ההוראות הקבועות בתקנה 406(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות ). התגובה תוגש עד ליום 14.12.2014 . התגובה תוגש במקביל, הן לבית משפט זה והן במישרין, למבקשת. בתגובה, תינתן התייחסות לאפשרות שבית המשפט יפעל על פי סמכותו לפי תקנה 410 לתקנות וכן לשאלה, אם במקרה כזה ניתן לראות בתגובה סיכום טענות בכתב כאמור בתקנה 448 לתקנות. היעדר התייחסות כמוהו כהסכמה. אי הגשת תגובה במועד כמוה כאי התייצבות, על הכרוך בכך.

במסגרת תגובתם יתייחסו המשיבים, בין היתר, לשאלה אלו פתרונות חינוכיים יוצעו לתלמידים הלומדים בבית הספר מושא הבקשה (להלן: בית הספר ) אם אכן ימומש צו הסגירה שהוצא לו, ומהי ההיערכות לכך מהיבט לוחות הזמנים. כן יתייחסו המשיבים למאזן הנוחות בכל הנוגע לאפשרות שבית הספר לא ייסגר עד להכרעה בעתירה כנגד צו הסגירה, בכפוף לכך שייאסר על המבקשת לערוך כל צעד שעניינו קידום ההרשמה לשנת הלימודים הבאה, אלא אם כן משרד החינוך יחליט להעניק רישיון לבית הספר או יתקבל הערעור המינהלי שאותו הגישה המבקשת על החלטת ועדת הערר.

ניתן בזאת צו ארעי המעכב את ביצוע צו הסגירה שהוצא לבית הספר, וזאת עד להחלטה אחרת של בית משפט זה.
