החלטה
ביום 10.2.2015 הוריתי על העברת מקום הדיון בת"א 23026-12-14 מבית משפט השלום בתל אבי ב לבית משפט השלום בירושלים בעקבות בקשת המבקשות. הבקשה הייתה מפורטת, כללה את כל הנספחים הדרושים וציינה גם את התנגדות המשיב לקבלתה.
עתה פונה המשיב בבקשה דחופה לעיין מחדש בהחלטתי, תוך צירוף נימוקים שלא פירט בהתנגדותו הקודמת. דין בקשתו זו להידחות.
ראשית, שלא כנטען, למשיב הייתה הזדמנות להגיב לבקשת העברת מקום הדיון. באי-כוח המבקשות פנו לבאת-כוחו, וכאמור לעיל, היא מסרה את התנגדותה לבקשה. היא לא פירטה אודות טעמים המצדיקים את דחיית הבקשה. היא אף לא ביקשה להגיש לבית משפט זה תשובה מפורטת בטרם תתקבל החלטה בבקשה.
שנית, לא השתנתה מסקנתי כי מירב הזיקות של התביעה שבנדון הן בירושלים. כאמור בהחלטתי הקודמת, בעיר זו אירעה התאונה מושא התביעה, שם מושבה של העירייה הנתבעת ומושבו של התובע, וסביר להניח שהעדים שראו את התאונה יגיעו מעיר זו או מסביבותיה. יודגש בהקשר זה, כי מקום משרדם של באי-כוח המבקש אינו מהווה עילה מספקת להעברת התיק (ראו בש"פ 3064/07 מזרחי נ' מדינת ישראל (23.4.2007)).
אשר על כן, בקשת המשיב נדחית, וההחלטה הקודמת בתיק זה תישאר על כנה. הדיון בת"א 23026-12-14 יתקיים בבית משפט השלום בירושלים.
