לפני בקשה לפי ס' 78 לחוק בתי המשפט (נוסח משולב) התשמ"ד-1984 (להלן: החוק ) ,
להעברת מקום הדיון בת"א 23026-12-14 מבית משפט השלום בתל אבי ב לבית משפט השלום בירושלים.

התביעה הוגשה ביום 10.12.2014, ועניינה בנזק שנגרם לתובע – המשיב בבקשה זו – כשנפל מקורקינט חשמלי עליו רכב ברחובות העיר ירושלים. המשיב הגיש תביעת נזיקין נגד עיריית ירושלים ונגד חברת הביטוח שלה – המבקשות – בטענה שהן אחראיות לנזקיו.

המבקשות עותרות להעברת מקום הדיון מתל אבי ב לירושלים. לשיטתן, על אף שלבית המשפט בתל אבי ב יש סמכות מקומית לדון בתביעה, אין זיקה מהותית בין התובענה לבין בית משפט זה. אמנם, לחברת הביטוח משרדים גם בעיר זו, אך האירוע מושא כתב התביעה התרחש בירושלים, שם מקום מושבה של העירייה וכך גם מקום מגורי התובע. המבקשות מציינות כי אין בכוונת העירייה לפנות אל המבטחת בעניין זה, ולדידן יש למחוק אותה מההליכים.

יתר על כן, המשיבות סבורות כי בנסיבות המקרה יהיה צורך בבירור שיפוטי יסודי ומעמיק, והיות שמירב העדים שבכוונתה לזמן הם תושבי ירושלים, הטרחתם לבית המשפט בתל אבי ב תביא לבזבוז זמן ומש אבי ם.

דין הבקשה להתקבל. מירב הזיקות בעניין דנן הינן בעיר ירושלים: מקום האירוע, העירייה הנתבעת ומקום מגורי התובע. העובדה כי למבקשת 2 סניף בתל אבי ב, אין בה לשנות מהאמור, בייחוד נוכח הצהרת המבקשות כי לשיטתן יש למחוק את חברת הביטוח מן ההליכים.
לכך מצטרפת העובדה שהדיון בתביעה טרם החל, וישיבה ראשונה נקבעה לתאריך 12.7.2015. לפיכך, טרם נחצה הקו של "התחלת הדיון", אשר החל ממנו חובה לקבל את הסכמת הערכאה הדיונית לצורך העברת ההליך בהתאם לסעיף 78(א) לחוק ( בש"א 4023/07

אשר על כן, הבקשה מתקבלת. הנני מורה על העברת הדיון בת"א 23026-12-14 מבית משפט השלום בתל אבי ב לבית משפט שלום בירושלים.
