החלטה
עתירה לגילוי ראיה לגביה הוצאה תעודת חיסיון לפי סעיף 44 לפקודת הראיות [נוסח חדש], התשל"א-1971 (להלן: פקודת הראיות ).

העותרת הגישה לבית משפט השלום תביעה כספית כנגד המשיבות בסך 75,000 ₪ בגין נזקים שנגרמו לה בשל בידוק בטחוני לפני טיסה (ת.א. (שלום-ת"א) 6783-11-09). בתמצית שבתמצית, כתב התביעה מגולל מסכת השפלות והתעמרות שעברה העותרת, לטענתה, במהלך הבידוק הבטחוני, ואשר בגינם ויתרה על הטיסה ועל השתתפותה בכנס אקדמי בטוניס. המשיבות הכחישו בכתב ההגנה את גרסת העותרת וטענו כי הבידוק נעשה תוך שמירה על כבודה ופרטיותה של העותרת, ולאחר שבמהלך הבידוק התקבלה התרעה ממכשיר הבידוק שחייבה בדיקה של המחשב הנייד של העותרת.
במסגרת ההליכים המקדמיים שלחה העותרת למשיבות שאלון ודרישה לגילוי מסמכים. השאלון כלל שאלות רבות לגבי נוהלי הבידוק לפיהם פעלו נציגי המשיבים. שאלות אלה לא נענו מן הטעם שנוהלי הבידוק הינם מסווגים וחסויים. בהמשך לכך הוציא שר הביטחון תעודת חיסיון לפי סעיף 44 לפקודת הראיות, לגבי פרטי מידע אשר מסירתם עלולה לפגוע בבטחון המדינה, לרבות שיטות ודרכי פעולה, נוהלי עבודה, תבחינים על פיהם מבוצע הבידוק הביטחוני של הנוסעים או המטען, ואמצעים טכניים המופעלים באבטחת התעופה הישראלית.

על כך נסבה העתירה שבפנינו, בה מבקשת העותרת להסיר את החיסיון ולהורות על גילוי נוהלי האבטחה. לטענת העותרת, גילוי הנהלים יאפשר לה להוכיח את טענתה שבבדיקתה נעשה שימוש בשיטת "התיוג האתני", וכי אך בשל כך זכתה ליחס המשפיל כלפיה, כנטען בכתב התביעה.
המשיבות התנגדו לעתירה. בהסכמת העותרת ומכוח סמכותי לפי סעיף 46 לפקודת הראיות, הציגו המשיבות בפני, במעמד צד אחד, את נוהלי האבטחה, תוך מתן הסברים מצד גורמי הביטחון.

דין העתירה להידחות.
אין בדעתי להאריך בדברים, מאחר שאין זו הפעם הראשונה שבתי המשפט נדרשים לסוגייה. בעת"מ (ת"א) 1555/06 התנועה לחופש המידע נ' רשות שדות התעופה (לא פורסם, 15.11.2006) נדחתה עתירה לחשיפת חלק מאמות המידה לביצוע בידוק בטחוני. בבש"א 6763/06 כיאט נ' רשות שדות התעופה (לא פורסם, 28.11.2006) (להלן: עניין כיאט ) נדונה עתירה כמעט זהה לעתירה דכאן. גם שם היה מדובר בתעודת חיסיון שהוצאה במסגרת תביעה אזרחית בגין נזקים שנגרמו עקב התנהגות משפילה במהלך בידוק בטחוני בשדה התעופה. העתירה נדחתה בהחלטתו המפורטת של חברי השופט רובינשטיין, ואם אוסיף על הדברים אהיה כמכניס תֶּבֶן לַעֲפָרַיִם. אשר על כן, אני מאמץ את הטעמים והנימוקים שפורטו באותה החלטה.
ולבסוף, אך לאחרונה נדון נושא התיוג (פרופיילינג) בבג"ץ 4797/07 האגודה לזכויות האזרח בישראל נ' רשות שדות התעופה (לא פורסם, 22.5.2012), שאף במסגרתו הוצאה תעודת חיסיון על פי סעיף 44 לפקודת הראיות לגבי הנהלים והכללים שלפיהם נערך הבידוק הבטחוני בשדות התעופה.

למעלה מן הצורך אציין כי איני סבור שיש בנהלים ובכללים כדי לקדם את עניינה של העותרת בתובענה האזרחית. גם על פי נוהלי וכללי האבטחה – וזאת אני נכון "לחשוף" ללא חשש כלשהו לפגיעה בבטחון המדינה – אין מקום ליחס לא הולם, ובוודאי שלא ליחס משפיל ומבזה כלפי הנבדק. ככל שהעותרת תוכיח בבית משפט השלום את גירסתה העובדתית כנטען בכתב התביעה
הרי שלא תידרש לאותם נהלים וכללים כדי לזכות בתביעתה.

סיכומו של דבר שאני מאמץ את החלטתו של השופט רובינשטיין בעניין כיאט , אך למעט ההסדר המוסכם שעליו הורה באותה החלטה, ולפיו החומר החסוי יוצג בפני בית משפט השלום. משהוצאה תעודת חיסיון לפי סעיף 44 לפקודת הראיות, ומשנדחתה העתירה להסרת החיסיון, משמעות הדבר שהחומר חסוי וככזה הוא אינו קביל כאמור בסעיף 44 לפקודת הראיות: " אין אדם חייב למסור, ובית המשפט לא יקבל , ראיה אם ראש הממשלה או שר הבטחון הביע דעתו, בתעודה חתומה בידו, כי מסירתה עלולה לפגוע בבטחון המדינה" .
בהקשר זה אפנה להוראת תקנה 119 לתקנות סדר הדין האזרחי, התשמ"ד-2004, הקובעת כלהלן (הדגשה הוספה – י"ע):
"הוגשה בקשה למתן צו למסירת שאלון, או לעיון במסמכים, ונטענה טענת חסיון לגבי שאלה פלונית או מסמך פלוני, רשאי בית המשפט או הרשם שלא להעתר לבקשה לענין אותה שאלה או אותו מסמך, ולשם כך רשאי הוא לעיין במסמך כדי להחליט אם יש ממש בטענה זו; אין האמור בזה בא לגרוע מזכותה של המדינה לסרב להראות מסמך ".
ברגיל, רשאית אפוא הערכאה המבררת לעיין בחומר על מנת להכריע בטענת חיסיון שמעלה בעל דין, אך לא כך מקום בו קבע המחוקק מסלול נפרד לעתירה לגילוי ראיה שעניינה בטחון המדינה או בטחון הציבור לפי סעיפים 45-44 לפקודת הראיות. במקרה כאמור, עומדת למדינה הזכות לסרב לגלות את המסמך בכפוף לתוצאת ההליך לגילוי ראיה (לשאלה אם סעיף 44 לפקודת הראיות מחייב חיסיון מלא או גילוי מלא או שמא ניתן לנקוט בפתרון ביניים כמו היתר לחשיפת החומר בפני אנשים מסוימים בלבד, ראו רע"א 7114/05 מדינת ישראל נ' חיזי
(לא פורסם, 11.12.2007) וכן תזכיר חוק אישור השתתפות בהליכים מסווגים הנוגעים לבטחון המדינה, התשס"ט–2008).

סופו של דבר, שאני דוחה את העתירה.
