החלטה
א.
ערר על החלטת בית המשפט המחוזי בבאר שבע (השופטת מרוז) מיום 23.12.08 בב"ש 22473/08, בה נדחתה בקשה לשחרור העורר ממעצר.
ב.
נגד העורר וארבעה אחרים הוגש ביום 21.11.08 כתב אישום, המייחס להם עבירות של כליאת שווא, אינוס בנסיבות מחמירות, מעשה מגונה בנסיבות מחמירות, תקיפה והדחה בחקירה. נטען, כי המתלוננת נחטפה ונכלאה בביתם של העורר ואשתו, וכן במערה שמתחת לבית, וכי במהלך תקופת הכליאה אנס העורר את המתלוננת פעמיים וביצע בה מעשה מגונה.
ג.
עם הגשת כתב האישום התבקש מעצרם של חמשת הנאשמים עד תום ההליכים. בדיון שהתקיים בו ביום, הסכים בא כוח העורר למעצר עד להחלטה אחרת. דיונים מפורטים בבקשה למעצר עד תום ההליכים התקיימו בימים 1.12.08 ו- 7.12.08, וכן ב 15.12.08. ביום 22.12.08 הגיש העורר בקשה לשחררו ממעצר, מן הנימוק שמאז הגשת כתב האישום חלפו יותר משלושים ימים, וטרם ניתנה החלטה בדבר קיומן של ראיות לכאורה.
ד.
הבקשה נדחתה, כאמור. צויין, כי מ דובר
בתיק סבוך, שבו עדויות רבות, וכי הסניגורים בתיק לא טענו להעדרן של ראיות לכאורה (אלא לכרסום). עוד צויין, כי יש באמרות המתלוננת ביחס למעשה האינוס "ניצוץ ראייתי", שדי בו לצורך מתן צו למעצר עד להחלטה אחרת, וכי גם אמרותיו של העורר קושרות אותו לחלק מן העבירות. סיכומו של דבר, כך נאמר, הדיונים וטיעוני הסניגורים לא הותירו ספק באשר לקיומה של תשתית ראייתית כלשהי, אף אם הדבר לא נקבע בהחלטה מפורשת, ועל כן המעצר מעוגן בדין.
ה.
בערר נטען, בעיקרו של דבר , כי לא די שיונח בפני בית המשפט "ניצוץ ראייתי", וכי הארכת המעצר מעבר לשלושים ימים טעונה החלטה מפורשת באשר לקיומן של ראיות לכאורה. זאת, בהתאם לסעיף 21(ד) לחוק סדר הדין הפלילי (סמכויות אכיפה-מעצרים), התשנ"ו-1996. עוד נטען, כי בית המשפט קמא לא צדק באמרו שהבקשה הוגשה בחוסר תום לב ועו"ד הגון לא היה מגיש בקשה כזאת. כן נטען כנגד אמירת בית המשפט, כי "דרושה מידה רבה של עזות מצח לצורך הגשת הבקשה דנן, לנוכח הנסיבות המתוארות...".
ו.
בדיון טען עו"ד נסאר, כי טרם ניתנה החלטה בתיק, בניגוד לקביעה בבש"פ 5863/98 כהן ואח' נ' מדינת ישראל ( פ"ד נב (4) 503' השופט אנגלרד). משעברו שלושים יום ולא ניתנה ההחלטה בענין הראיות, היה צורך לשחרר את העורר כיוון שהוא עצור שלא כחוק. לא היה סיבה להחליט שיש ראיות לכאורה, והשופטת מרוז נדרשה ל"ניצוץ הראייתי" בלא התייחסות לטענות ההגנה. על כן נתבקש שחרור העורר למעצר בית מלא עד שתינתן החלטה בעניין הראיות. עוד הוסיף עו"ד נסאר, כאמור מעלה, וטען כנגד ייחוס אי הגינות לפעולתו.
ז.
באת כוח המדינה ציינה, כי עם הגשת כתב האישום ב-21.11.08 והגשת הבקשה למעצר עד תום ההליכים, הסכימו הסניגורים כזכור למעצר עד להחלטה אחרת. בית המשפט המחוזי שמע את טיעוני הפרקליטות ובדיון ממושך נוסף את הסניגוריה, ונפרסו לפניו טענות הצדדים באשר לראיות. באשר לחוק המעצרים, ישנם שני מסלולים לענין "מעצרי ביניים", כעולה מבש"פ 6190/98 מדינת ישראל נ' שושני פ"ד נב(4) 515 (השופט קדמי); וכן מבש"פ 8896/06 בוסקילה נ' מדינת ישראל (לא פורסם). עוד נאמר, כי ישנם תיקים שבהם כמות הראיות עצומה, ולא יתכן שהכל ייכנס לגדר שלושים הימים.
ח.
עסקינן בשאלה דיונית שכבר עלתה בעבר. בטרם אדרש
אליה אציין, כי חזקה על בית המשפט המחוזי, שבהערותיו שעליהן קובל הסניגור לא נדרש להגינות אישית של עו"ד נסאר, הממלא תפקיד מקצועי, ולא להטלת דופי אישי - אלא מתח ביקורת הקשורה להתנהלות בתיק זה.
ט.
לגופם של דברים, תיקים מורכבים עלולים מטבעם ליצור קשיים דיוניים, וניתן להביא דוגמאות שונות לכך, אך לא אאריך.
י.
בנידון דידן, אכן היתה הסכמת הסניגורים בדיון בפני השופט זלוצ'ובר ב-21.11.08, יום הגשת כתב האישום ובקשת המעצר, כי הנאשמים, לרבות העורר דנא, ייעצרו עד להחלטה אחרת ולצילום חומר החקירה. הנשיא פלפל קיים שני דיונים מפורטים בראיות, וברי אף מעיון בפרוטוקול, הדן בחמישה נאשמים, כי בתיק מורכב עסקינן, לרבות טענות מפורטות של עו"ד נסאר (ביום 7.12.08) המשתרעות על פני מספר עמודים צפופים. כאמור, וכעולה מהחלטת השופטת מרוז וכן מדברי הפרקליטות בדיון בפניה
ב-23.12.08, היו פעולות דיוניות נוספות בפני הנשיא פלפל לאורך הימים שלאחר מכן. הבקשה שהוגשה לשופטת מרוז ב-22.12.08 באה כנטען בשל העובדה שטרם ניתנה החלטה בענין הראיות חרף חלוף שלושים יום.
י"א.
לאחר העיון, איני רואה מקום להיעתרות לערר. כפי שציינה השופטת מרוז בהחלטתה, לא נטען – גם לא בפני – להיעדר ראיות לכאורה, נוכח החומר הקשור במתלוננת, אלא לכרסום (ואכן טען עו"ד נסאר בפני הנשיא פלפל ב-7.12.08 בין השאר לעדות כבושה של המתלוננת, ובהרחבה באשר לפרטים שונים בגירסאות המתלוננת). על כן קשה להלום את הטענה הבסיסית של היעדר "ניצוץ ראייתי", שמטבעו (מעבר לציטוט מהודעת המתלוננת שהביאה השופטת) הוא כשמו – "ניצוץ" – "ראייה לכאורה המתבססת על חומר החקירה טרם עמידתה בביקורת הסניגוריה" (בש"פ 5863/98 כהן הנזכר, בעמ' 513). על כן אין עסקינן, כפי שטען הסניגור, במקרה שבו היה צורך, לשם אותו "ניצוץ", להעמיד דברים מחומר הראיות אל מול טענות הסניגוריה. ככלל, בחריגים קיצוניים, שקילת טענות הצדדים אלה מול אלה מקומה בהחלטה בדבר ראיות לכאורה. ועוד, אף מטענות הסניגור המלומד בפני הנשיא פלפל ניתן ללמוד כי ברמת "ניצוץ" עומד התיק כדבעי. בפרשת בוסקילה הנזכרת מעלה נסקרו שני המסלולים הנוגעים ל"מעצר ביניים", הן מכוח סעיף 21(ד) לחוק המעצרים שאליו נדרש עו"ד נסאר, והן מכוח "סמכות העזר" או "הסמכות הנגזרת", המאפשרת במקרים חריגים (פרשת כהן , 513) הארכה נוספת לימים בודדים (ראו גם ההחלטות מקדם בבש"פ 1289/91 הררי נ' מדינת ישראל , פ"ד מה(2) 759 (השופט בך), וכן בש"פ 595/89 כהן נ' מדינת ישראל (לא פורסם) (השופט מלץ)).
י"ב.
אכן, ברי כי על בתי המשפט לעשות את המאמץ הרב, חרף העומס, לסיים את עיונם בראיות לכאורה בשלב מוקדם ככל הניתן, אך אין לבוא עמם בטרוניה כאשר בתיקים מורכבים ישנה הימשכות מעטה שמעבר לשלושים הימים, וכאמור יש לכך סימוכין בפסיקה. כך גם בנידון דידן. לכן איני רואה – כאמור – מקום להיעתר לערר.
י"ב.
בסיום כתיבת הדברים נמסר כי מחר (1.1.09) תינתן החלטת הנשיא פלפל באשר לראיות לכאורה.
