לפניי בקשה להארכת מועד להגשת בקשה לדיון נוסף בקשר לפסק-דינו של בית משפט זה בע"פ 8274/11, מיום 21.1.2013. בפסק-הדין נדחה (בין היתר) ערעורו של המבקש על הרשעתו בעבירות שונות, וכן על חומרת העונש שהושת עליו בבית המשפט המחוזי.
המבקש מציין כי הזמן שחלף מאז פסק-הדין ועד תחילת ריצוי עונש המאסר ( 3.3.2013 ) הוקדש להתארגנות ולהליכי מיון בשב"ס, וכי עורך-דינו של המבקש "הסב פניו מפני פניותיו של העותר" והתרכז בהליכים אזרחיים המתנהלים נגד המבקש. עוד מציין המבקש את קשיי התקשורת מתוך בית האסורים.
לא אוכל להיעתר לבקשה.
לפי תקנה 4 לתקנות סדר הדין בדיון נוסף, התשמ"ד-1984, המועד להגשת בקשה לדיון נוסף על פסק-דין של בית המשפט העליון הוא תוך 15 ימים מיום מתן פסק-הדין. לבית המשפט מסורה סמכות להורות על הארכת המועד להגשת בקשה לדיון נוסף. עם זאת, לאור מאפייניו המיוחדים של הליך זה – אשר פותח פתח לליבון נוסף של סוגיה שהוכרעה בפסק-דין של בית המשפט העליון – נקבע כי הדרישה לקיומו של "טעם מיוחד" להארכת מועד תיושם באופן דווקני ונוקשה (ראו למשל בש"א 6180/09 פלונית נ' פלוני (13.9.2009); בש"א 7155/06 יונה נ' עו"ד אינסל (3.10.2006)).
בענייננו, פסק-הדין ניתן כאמור ביום 21.1.2013, ומכאן שהמועד האחרון להגשת בקשה לדיון נוסף חל ביום 5.2.2013. המבקש הגיש את הבקשה שלפניי ביום 21.4.2013, כלומר מדובר באיחור גדול ביותר. אין בטענות הכלליות שבבקשה כדי להצדיק איחור כה מ מוש ך. לא מיותר להדגיש כי המבקש היה מיוצג בהליך הערעור, ולמיטב הבנתי עורך-הדין ממשיך ללוותו בהליכים אחרים. קשה להניח אפוא כי המבקש לא ידע, או לא יכול היה לברר, את המועד להגשת בקשה לדיון נוסף.
מעבר לכך, עיון בפסק-הדין של בית המשפט העליון מלמד כי על פני הדברים לא מדובר במקרה שיש בו סיכוי ממשי לקיום דיון נוסף. הדבר בולט במיוחד למקרא נימוקי בקשתו של המבקש לדיון נוסף, שעניינם ניסיון של המבקש לטעון שוב לגבי חומרת העונש.
אשר על כן, הבקשה נדחית.
