החלטה
לפניי בקשה להעברת מקום דיון מבית משפט השלום באילת לבית משפט השלום בתל אביב. מ דובר בהליך בו הוגש כתב אישום בעבירת תעבורה.
על פי סעיף 11ב להנחיות נשיאת בית המשפט העליון, על בקשה להעברת מקום דיון לפי סעיף 78 לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984 לכלול העתק קריא של דו"ח התנועה או כתב האישום, ויש לציין בה את כתובת המגורים בצירוף תצהיר או עותק מצולם של תעודת הזהות. מסמכים אלה לא צורפו לבקשה שלפניי.
בנוסף, המבקש אינו מתייחס בבקשתו לסוגייה של הודאה או כפירה בעובדות המפורטות בכתב האישום. לפי הנהוג בבקשות מסוג זה, בדרך כלל אין מעבירים דיון מבית משפט אחד לבית משפט אחר אם המשטרה תידרש להביא ראיות להוכחת העבירה בבית המשפט הנעבר. זאת משום שהדבר כרוך בנסיעת אנשי משטרה מהמקום הרגיל בו הם משרתים לבית משפט במקום אחר. לפיכך, העברת דיון ללא הודאה בעובדות כתב האישום נעשית רק במקרים חריגים ויוצאי דופן.
המבקש יגיש הודעה אליה יצורף דו"ח התנועה או העתק של כתב האישום, ותצהיר או עותק מצולם של תעודת הזהות, עד ליום 8.5.2014. בהודעה זו יציין המבקש במפורש האם הוא מודה בעובדות שבכתב האישום או שהוא כופר בהן. מיותר לומר כי המבקש זכאי לכפור במיוחס לו. לאחר מכן יימשך הטיפול בבקשה.
