בקשה שנייה להארכת מעצרו של המשיב בתשעים ימים לפי סעיף 62 ל חוק סדר דין פלילי (סמכויות אכיפה – מעצרים) , התשנ"ו-1996 (להלן: חוק המעצרים ).

העובדות הצריכות לעניין פורטו בהחלטתו של כב' המשנה לנשיאה א' ריבלין בבש"פ 7502/11 מיום 23.10.2011 ולכן איני רואה להאריך בסקירת העובדות והקורא מופנה להחלטה זו. בקליפת אגוז, כנגד המשיב, יליד 1965, הוגש כתב אישום מתוקן הכולל שני אישומים ומייחס למשיב עבירות של מעשה סדום, מין במשפחה ואיומים. על פי המתואר באישום הראשון, ביצע המשיב, במהלך השנים 1994-1987 מעשים מגונים ומעשי סדום באחותו בהיותה בטווח הגילאים שבין 4 ל- 12. על פי המתואר באישום השני, ביצע המשיב באחות אחרת מעשים מגונים ומעשי סדום בשנים 1990-1987, בהיות המתלוננת ב' בטווח הגילאים 9 ל- 12.
הנה כי כן, כתב האישום מייחס למשיב עבירות מין שביצע בשתיים מאחיותיו לפני 25 –18 שנים.

אין חולק כי קיימות ראיות לכאורה כנגד המשיב, אשר הודה בחלק מהמעשים המיוחסים לו – למעט מעשי הסדום – ובשיחה שהוקלטה בינו לבין אחת משתי האחיות, הוא מתנצל בפניה על מה שעולל לה ומבקש את סליחתה.

אשר להתקדמות ההליך בתיק העיקרי: ביום 8.2.2011 התקיימה הקראה, והתיק נדחה בשל טענות מקדמיות לגבי אישורו של היועץ המשפטי לממשלה להגשת כתב האישום נוכח חלוף הזמן, ולצורך הידברות בין הצדדים; ביום 3.4.2011 ניתנה תשובת המדינה לטענות המקדמיות שהעלה המשיב. בית המשפט
המחוזי הורה למדינה להמציא את כתב האישום המקורי למשיב, והתיק הועבר להליך של גישור בפני כבוד השופט מ' דרורי . בדיון מיום 3.10.2011, הודיעו הצדדים כי לא הגיעו להסכמה לגבי רף הענישה אך בכוונתם להגיע להסכמה עובדתית; בדיון מיום 7.12.2011, הודיעה המדינה כי הצדדים הגיעו להסדר טיעון. בא כוח המשיב ביקש דחייה בת שבועיים על מנת להיפגש עם המשיב, באומרו כי: "הכול היה סגור עם הנאשם, אך הוא מבקש שהות נוספת כדי להודיע סופית אם ההסדר מקובל עליו". לבקשת ההגנה, התיק נדחה לישיבת תזכורת אחרונה, וזאת בטרם ייקבע התיק להוכחות; בדיון מיום 2.1.2012, אישר בא כוח המשיב כי "היה הסדר טיעון סגור, שאושר על ידי הנאשם וכאשר הוא התבקש לחתום עליו, סירב לעשות כן", אולם לא ניתנה תשובה סופית בנוגע להסדר. כמו כן, ביקש בא כוח המשיב לערוך למשיב בדיקה פסיכיאטרית לצורך בדיקת כשירותו לעמוד לדין. בית המשפט נעתר לבקשה והורה על הגשת חוות דעת פסיכיאטרית ונקבעה ישיבת תזכורת לשם קבלת חוות הדעת הפסיכיאטרית ליום 6.2.2012. ביני לביני הוגשה חוות הדעת הפסיכיאטרית, ומאחר שנמסר לצדדים כי התיק יתחיל להישמע ביום 15.2.2012, עולה כי המשיב נמצא כשיר לעמוד לדין.

כעת, משחלפו תשעה חודשים ומשפטו של המשיב טרם הסתיים, הגישה המדינה את הבקשה דכאן להאריך את מעצרו של המשיב בתשעים ימים נוספים.
המדינה טענה כי מעשיו של המשיב כמפורט בכתב האישום, מעידים על מסוכנותו, ולנוכח המעשים החמורים המיוחסים לו, קיים חשש להשפעה על עדים ואף להימלטותו של המשיב.

אין חולק כי העבירות המיוחסות למשיב הן חמורות, והשפעתן על שתי אחיותיו ניכרו לאורך השנים, כפי שעולה מהשיחה שהוקלטה בין המשיב לאחת האחיות המתלוננות. עם זאת, יש לקחת בחשבון כי המדובר במעשים שנעשו לפני שנים הרבה; כי למשיב אין עבר פלילי; כי אחת מהאחיות כבר לא מתגוררת בארץ; וכי מהשיחה המוקלטת בין המשיב לבין אחותו
- במהלכה התנצל שוב ושוב על מעשיו הרעים - לא משתמעת נימה של איום. גם אם יש לזקוף את עיקר העיכוב בהתקדמות המשפט לחובתו של המשיב, הרי שברי כי המשפט לא יסתיים תוך הזמן הקרוב.
בנסיבות אלה, וכפי שציין
גם השופט ריבלין בהחלטתו הנ"ל, אני סבור כי יש לאפשר את שחרורו של המשיב, בכפוף לחלופת מעצר סבירה. המשיב הציע בשעתו חלופת מעצר בבית אביו המבוגר, אשר מבלה מרבית זמנו בכולל ולא בבית, אך זו נשללה על ידי שירות המבחן. אין בכך כדי לסגור את הדלת בפני המשיב. ייכבד המשיב ויציע ל בית משפט קמא חלופה ראויה אחרת, או "יעבה" את החלופה שהוצעה על ידו בשעתו, אם ימצא בית משפט קמא כי ניתן להסתפק בחלופה שתוצע על ידי המשיב, ניתן יהיה להורות על שחרורו לחלופה זו בתנאים ובמגבלות, לרבות איסור מוחלט על יצירת קשר במישרין או בעקיפין עם המתלוננות.

בשלב זה, וכל עוד לא תאושר חלופה לשביעות רצונו של בית המשפט המחוזי, אני נעתר לבקשת המדינה ומורה על המשך מעצרו של המשיב החל מיום 21.1.2012 או עד למתן פסק דין
