החלטה

המדינה הצהירה כי היא נכונה להחיל על העורר את קווי הפעולה שהתווה כבוד השופט רובינשטיין בהחלטתו מיום 9.1.2012 בבש"פ 9577/11 ובש"פ 9691/11 בעניינם של אשרף זלום ושאדי זאהדה.
אלא שלטענת העורר, אין להשוות מעמדו לעוררים שם, באשר הראיות לכאורה כנגדו הן בעוצמה פחותה. בהקשר זה הפנה העורר להודעתו של אחד הנאשמים האחרים בשם איהאב ג'לאד (אשר על ההחלטה לשחרורו הגישה המדינה ערר בבש"פ 749/12) בה נאמר כי ג'לאד הפסיק לראות את העורר, מה שעולה בקנה אחד עם גרסתו העורר כי לא היה מעורב בפעילות של חמאס. לכך יש להוסיף כי בניגוד לחלק מהעוררים האחרים, העורר לא שמר על זכות השתיקה, ולא נכח במפגש בפארק קנדה ובמפגש בואדי ערה.

אומר בקצרה, כי העורר מוזכר בהודעותיו של פואד חמדיה, הודעה אשר מקבלת חיזוק, גם אם עקיף, בהודעתו של אבו עסב. לכן, איני סבור כי יש להבדיל בין עניינו של העורר לבין העוררים האחרים, אשר הוגדרו על ידי חמדיה כמי שנמצאים בדרג השלישי של ההתארגנות.

אשר על כן, וברוח החלטתו הנ"ל של השופט רובינשטיין, אני מורה כי תוך 15 יום יוגש תסקיר שירות המבחן למבוגרים לעניין אפשרות חלופת מעצר בישראל ולא באיו"ש - ומחוץ לירושלים. בית המשפט המחוזי יבחן אפשרויות השחרור לחלופה ויחליט על פי שיקול דעתו, לרבות הפקדה וערבויות, איזוק אלקטרוני, הפקדת דרכון ועיכוב יציאה.
