בפני בקשה לרשות ערר על החלטתו של בית המשפט המחוזי בירושלים מתאריך 17.5.2012 (כב' השופטת ת' בזק-רפופורט ), בגדרה נתקבל ערר שהגישה המשיבה על החלטה של בית המשפט השלום (סגנית הנשיאה, כבוד השופטת ע' כהן ), בדבר שחרור בתנאים של העורר, עד לתום ההליכים בענינו.

משטרה. במהלך ההתפרעות
נפצע

בראשו. על-פי הנטען, העורר היה בין המתפרעים ויידה אבנים לעבר כוחות המשטרה ממרחק של כ- 15 מטרים מהם. בית משפט השלום אומנם קבע כי המסכת הראייתית איננה חד-משמעית, אך הגיע למסקנה כי קיימות ראיות לכאורה נגד העורר. אשר על כן, בית משפט השלום החליט כי העורר ישוחרר ל-"מעצר בית", בבית משפחתו בכפר ג'ת שבצפון הארץ ויוכן תסקיר מעצר בענינו. מהתסקיר שהוגש עלתה חוות דעת חיובית, וצוין שאין לעורר עבר פלילי. בעקבות זאת בוטל "מעצר הבית" של העורר ונקבע כי הוא יוכל לחזור למגוריו בירושלים לצורך לימודים, כנגד: חתימת ערבות על-ידי בן-דודו המתגורר בשכונת בית-צפאפא בירושלים על סך עשרת אלפים ש"ח, הפקדה כספית של חמשת אלפים ש"ח (שכבר הופקדה במעמד ההחלטה על מעצר הבית) וצו פיקוח מעצרים למשך שישה חודשים.

המשיבה עררה, כאמור, על ההחלטה בטענה כי טעה בית משפט השלום, כאשר שחרר את המשיב מ"מעצר הבית", תוך התעלמות ממסוכנותו, כעולה מהמיוחס לו בכתב האישום.

בית המשפט המחוזי הנכבד קבע כי תנאי השחרור שנקבעו אכן מקלים יתר על המידה, לנוכח המיוחס לעורר על פי כתב-האישום, ובשים לב להסתיגויות מסוימות הכלולות בתסקיר המעצר. מאידך גיסא, הוא לא קיבל את טענת המשיבה, שביקשה להחזיר את העורר למעצר בית במקום משכן הוריו בצפון, מה שצפוי היה למנוע את המשך לימודיו. בית המשפט המחוזי הנכבד קבע עוד כי בענינו של העורר יש יתרון בהחזרתו של העורר ללימודיו בהישען על הגישה השיקומית. אשר על כן, נקבע כי העורר ישהה ב"מעצר בית" במעונות הסטודנטים בהר הצופים, מהם יורשה לצאת לקמפוס האקדמי ולשהות שם לצורך לימודיו, כאשר בסופי שבוע (מיום חמישי בערב ועד יום ראשון בבוקר) ישהה בכפר ג'ת עם הוריו – והכל תוך הותרת הערבויות, אשר ניתנו בענינו בעינן, בצירוף ערבויות נוספות של שני חברים שנדרשו לחתום על ערבות בסך עשרת אלפים ש"ח כל אחד.

העורר מבקש בבקשה שבכאן לבטל את "מעצר הבית" שפסק לו בית המשפט המחוזי ולאמץ את המלצת תסקיר המעצר ואת החלטת בית משפט השלום הנכבד בדבר שחרורו כמעט ללא מגבלה. העורר סבור כי התערבות בית המשפט המחוזי בהחלטתו של בית המשפט השלום, בניגוד להמלצת התסקיר היא עניין עקרוני הנוגע לשאלה המהותית בדבר היקף התערבות ערכאת הערעור בהחלטת הערכאה הדיונית באשר להליכי מעצר עד תום ההליכים. לדידו, לא היו נימוקים מספקים להתערבות זו.

דין הבקשה לרשות ערר – להידחות על הסף , בהתאם לסעיף 53(א1)(2) ל חוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), תשנ"ו-1996.
כידוע, ככלל, רשות ערר ב"גלגול שלישי" בהליכי מעצר איננה ניתנת, אלא מקום בו מתעוררת שאלה בעלת חשיבות עקרונית, החורגת מעניינם של הצדדים, או בהתקיים טעמים חריגים המצדיקים התערבות (ראו: בש"פ 2786/11 ג'ריס נ' ג'ריס (לא פורסם, 17.4.2011 ); בש"פ 9583/11

נ' מדינת ישראל (לא פורסם, 27.12.2011)). מקרה זה איננו נופל לגדרי החריגים לכלל האמור. טענות המבקש לפני קשורות בצורה הדוקה לעניינו הפרטי, ואין בהן מימד עקרוני המצדיק מתן רשות ערר. למעלה מן הנדרש אציין בקצרה כי לא מצאתי מקום להתערב בהחלטתו של בית המשפט המחוזי גם לגופו של עניין. נראה לי שבית המשפט עשה איזון ראוי בין השיקולים השונים, בשים לב למכלול ונימק כראוי את קביעותיו.

סוף דבר – הבקשה שבפני נדחית על הסף.
