ערר על החלטת בית המשפט המחוזי בירושלים מיום 12.7.2011 (כב' השופט א' רומנוב ), בגדרה נעצר העורר עד תום ההליכים המשפטיים המתנהלים כנגדו.

כנגד העורר, יליד 1987, הוגש כתב אישום המייחס לו עבירה של סחר בסם מסוכן לפי סעיף 13 בצירוף סעיף 19א לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973.
על פי המתואר בכתב האישום, בערבו של יום 1.6.2011, ביקש העורר מאדם בשם הושע ביטון (להלן: הושע ) כי יסיע אותו לאזור בית גוברין. אל השניים הצטרפו שניים נוספים בשם אלון וגימה ואדיר בוחבוט. בהיותם על כביש 35, פגשה החבורה רכב מסוג מזדה שהמתין להם. העורר ביקש מהושע כי יעצור בסמוך למזדה, או-אז ירד העורר מהרכב ושוחח עם אדם שהמתין לו במקום. האדם הנוסף הצביע לעבר צדו השני של הכביש, ואילו העורר חזר לרכב והורה להושע לבצע פניית פרסה ולעמוד בנתיב הנגדי במקביל למיקומה של המזדה. העורר ירד שוב מן הרכב ואסף משולי הכביש קוקאין במשקל 99.3 גרם במצב מוצק, עטוף בנייר נצמד. בשובו לביתו בבית שמש, הסתיר העורר את הקוקאין בשביל הסמוך לבית.

בד בבד עם הגשת כתב האישום הוגשה בקשה למעצר העורר עד תום ההליכים. בהחלטתו מיום 19.6.2011 קבע בית משפט קמא כי קיימות ראיות לכאורה להוכחת המעשים המיוחסים למשיב וכי העבירה המיוחסת לעורר, בצירוף עברו הפלילי וכתבי האישום התלויים ועומדים כנגדו מקימים עילת מעצר. עם זאת, בית המשפט הורה על עריכת תסקיר מעצר בעניינו של העורר.

ביום 10.7.2011 הוגש תסקיר שירות המבחן ממנו עולה כי העורר הוא בחור צעיר אשר גדל בנסיבות חיים קשות וכי היעדרן של דמויות מכוונות בחייו הוביל אותו לנהל אורח חיים עברייני מגיל צעיר. מבין שתי חלופות מעצר מוצעות, שירות המבחן המליץ על שחרורו של העורר לבית אחותו באופקים, תוך הגבלתו מלהשתמש בטלפון ובמחשב.

ביום 12.7.2011 התקיים דיון נוסף ב בית משפט קמא. בית המשפט עמד על חומרת העבירה המיוחסת לעורר ועל כך שתלויים ועומדים כנגדו מספר כתבי אישום. בית המשפט הוסיף כי מהעבירות בהן הורשע העורר והעבירות המיוחסות לו בכתבי האישום עולה שהעורר אינו מקבל את מרות החוק. העורר אף לא השלים את ביצוע עונש השל"צ אשר הוטל עליו במסגרת אחד התיקים הקודמים, ואף לא התייצב לדיון בבקשת שירות המבחן להפקעת השל"צ. לאור זאת, נקבע כי לא ניתן לקבל את החלופה המוצעת ו בית המשפט הורה על מעצרו של העורר עד תום ההליכים.
מכאן הערר שבפניי.

העורר טען כי אין ראיות לכאורה כנגדו ולמיצער, כי יש כרסום בראיות הקושרות אותו לעבירת הסמים המיוחסת לו. עוד נטען כי שגה בית משפט קמא בכך שלא נתן משקל להמלצת שירות המבחן, ממנה עולה כי החלופה המוצעת ראויה ויש בה להציב גבולות להתנהגותו ולהפחית את מסוכנותו, מה עוד שניתן להורות על איזוק אלקטרוני. כן טען העורר כי שגה בית משפט
קמא עת ייחס משקל רב לעברו הפלילי, ובפרט לכך שלא התייצב לדיון בבקשת שירות המבחן להפקיע את השל"צ, בציינו כי ביצע של"צ בהיקף של 125 שעות מתוך 150 שעות. סיכומו של דבר, שהעורר עתר לשחרורו לחלופת מעצר בתנאים אשר בית המשפט ימצא לנכון.

אין ממש בטענת העורר במישור הראיות לכאורה. הראיות כוללות, בין היתר, דו"ח מעקב של המשטרה והודעות מפלילות שנמסרו על ידי הושע. הושע סיפר בחקירתו כי כאשר המשיב נכנס חזרה למכונית הוא "החזיק ביד שקית ניילון שקופה עם משהו בפנים שנראה כמו סבון בצבע לבן ואז הבנתי שמדובר בסמים מסוכנים" (הודעת הושע מיום 2.6.2011 בעמ' 2). משהוצגה השקית עם הסמים בפני הושע השיב כי הוא מזהה את החומר שהעורר הראה לו והוסיף ואמר כי במהלך הנסיעה אף נטל את השקית כדי לראות במה מדובר ו"ראיתי שזה סם בצבע לבן". עוד אמר הושע בהודעתו מיום 5.6.2011 כי שאל את העורר מה יש בשקית והעורר השיב לו "קריסטל זה עולה הרבה כסף" (שם, בעמ' 2). די בדברים אלה, כשלעצמם, כדי לקשור את העורר לשקית הסמים.
אכן, העורר לא נראה כשהוא מטמין את הסם בשביל הסמוך לביתו, ועל השקית עם הסם שנתפס לא נמצאה טביעת אצבע או ממצא D.N.A. הקושרים אותו לסם, אך מדו"חות
הפעולה עולה כי לא היה קשר עין רציף עם העורר (ראה הדו"ח של רס"ר חן ויצמן מיום 2.6.2011). מכל מקום, די בראיות האחרות כדי לקשור את העורר לסם, ואזכיר כי הסם נתפס ליד השביל במקום בו הושע הוריד את העורר מהמכונית ובסמוך למקום מגוריו של העורר.
ואם לא די בכל אלה, באה שתיקתו של העורר בחקירה ומחזקת הן את הרף הראייתי - בהיעדר הסבר סביר לראיות דלעיל - והן את חזקת המסוכנות (ראו החלטותי בבש"פ 1648/11 אביטן נ' מדינת ישראל , פסקה 8 להחלטתי והאסמכתאות שם (לא פורסם, 7.3.2011); בש"פ 1748/11 יחזקאל נ' מדינת ישראל, פסקאות 6-8 להחלטתי והאסמכתאות שם (לא פורסם, 10.3.2011)).

כנגד העורר קמה עילת מעצר וחזקת המסוכנות הסטטוטורית הקבועה בסעיף 21(א)(ג)(3) לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו- 1996.
אשר לחלופת מעצר, הרי שהכלל הוא כי אין לשחרר לחלופת מעצר נאשמים בעבירות של סחר בסמים אלא במקרים חריגים (ראו, לדוגמה: בש"פ 3899/95 מדינת ישראל נ' ג'מאל , פ"ד מט(3) 164, 168 (1995); בש"פ 2512/96 מדינת ישראל נ' נסאסרה , פ"ד נ (2) 101 (1996); בש"פ 8087/09

ליטבק נ' מדינת ישראל (לא פורסם, 10.2.2010); בש"פ 2305/10 מילר נ' מדינת ישראל (לא פורסם, 28.3.2010)). כלל זה נסמך על נסיון החיים המלמד כי יש קושי ליתן אמון בסוחרי ומפיצי הסמים כי לא ישובו לסורם גם אם יהיו במעצר בית (ראו, לדוגמה: בש"פ 9595/09 קורס נ' מדינת ישראל (טרם פורסם, 7.12.2099) בפסקה 6 והאסמכתאות שם).

העורר מנהל ומתנהל באורח חיים עברייני. על כך ניתן ללמוד מעברו הכולל הרשעה בעבירות של חבלה חמורה ותגרה במקום ציבורי, וכן ממספר כתבי אישום התלויים ועומדים כנגדו בעבירות של הכשלת שוטר במילוי תפקידו, העלבת עובד ציבור וניסיון לתקיפת שוטר בעת מילוי תפקידו, מה שמעיד על כך שאין מוראו של החוק על העורר.

שירות המבחן מצא כי קיימת רמת סיכון גבוהה להישנות התנהגותו העבריינית של העורר, אשר אינו מבין את בעייתיות התנהגותו. שירות המבחן אמנם התרשם כי אחותו של העורר יכולה לשמש כמפקחת עליו אם ישהה במעצר בית בביתה ותוגבל גישתו למחשב ולטלפון. לאור האמור לעיל, איני סבור כי חלופת מעצר תסכון להקהות מסוכנותו של העורר, מה עוד שקשה לפקח על הגבלה מעין זו. בהתחשב בכך שניתן לקשור עסקאות סמים באמצעות המחשב והטלפון, אין בחלופה המוצעת לאיין את
החשש כי העורר ימשיך בפעילותו העבריינית כחלק משרשרת הפצת הסם (בש"פ 3807/06 טורק נ' מדינת ישראל (לא פורסם, 21.5.2006); בש"פ 3232/09 בוטרשוילי נ' מדינת ישראל (לא פורסם,
22.4.2009)).
