החלטה
ערר על החלטת בית המשפט המחוזי בירושלים מיום 23.5.2011 (כב' השופט נועם סולברג), בגדרה נעצר העורר עד תום ההליכים המשפטיים המתנהלים נגדו.

כנגד העורר הוגש כתב אישום המייחס לו עבירה של סיכון חיי אדם במזיד בנתיב תחבורה לפי סעיף 332(3) לחוק העונשין, התשל"ז-1977. על פי המתואר בכתב האישום, העורר יידה אבנים, יחד עם אחרים, לעבר ג'יפ של שוטרי מג"ב אשר ליווה ג'יפ אבטחה של מאבטחי עיר דוד בשכונת סילוואן בירושלים. זאת, מתוך מטרה לפגוע בג'יפ ובנוסעיו ולסכן את בטיחותם. על פי הנטען, שתיים מן האבנים פגעו בג'יפ עצמו ושתיים נוספות פגעו בסמוך לו. מיד לאחר ביצוע המעשה, עלה העורר על סוס ועזב את המקום.

בד בבד עם הגשת כתב האישום הוגשה בקשה למעצר העורר עד תום ההליכים. נקבע כי אין חולק על קיומן של ראיות לכאורה לפי שבעת האירוע זיהה תצפיתן את העורר, ושמר על קשר עין רצוף בעת הדיווח למשטרה ועד מעצרו. גם שוטר שנסע ברכב מסר תיאור של העורר והעיד על יידוי האבנים, שהתבצע, על פי עדות הנהג, במרחק 10 מטרים מהג'יפ. עוד נקבע, כי קיימת מסוכנות מן העורר, בהתחשב גם כי "הזירה שבה מדובר – סילוואן – מסוכנת למדי בעת הזאת", וכי חלופת המעצר שהוצעה בבית האב בראס אל עמוד סמוכה למדי למקום.
על החלטה זו הוגש ערר ל בית משפט זה (בש"פ 4454/11). בהחלטתו מיום 19.6.2011 ציין כבוד השופט גרוניס כי מהחלטת בית משפט קמא עולה שבפני העורר פתוחה הדרך להציע חלופה אחרת, רחוקה יותר מסילוואן ולפיכך:
"הנני סמוך ובטוח ש בית המשפט המחוזי יבחן מחדש את נושא המעצר אם וכאשר תוצע חלופה חדשה שתיבחן, כאמור, על ידי שירות המבחן. לפיכך, מתבקש שירות המבחן להכין תסקיר שיבחן את החלופה החדשה שמציע הסניגור בשמו של העורר. השירות יגיש התסקיר ל בית המשפט המחוזי, במידת האפשר, תוך 20 ימים".

בבקשה לעיון חוזר בפני בית משפט קמא, הוגשה המלצת שירות המבחן לשחרר את העורר לחלופת מעצר חדשה שהוצעה על ידו בבית דודו ודודתו בשכונת ענתא, המרוחקת יותר מסילוואן. על אף זאת, קבע בית משפט קמא כי על אף שהאמור בתסקיר המבחן מקובל עליו והחלופה החדשה טובה מקודמתה, אין בה די על מנת לשנות את המאזן הכולל והמסוכנות הנובעת מהעורר עדיין מצדיקה השארתו במעצר עד תום ההליכים.
מכאן הערר שבפניי בו הלין העורר על כך ש בית משפט קמא לא קיבל את המלצת שירות המבחן, במיוחד בהתחשב בכך שלעורר אין עבר פלילי.

דין הערר להתקבל. העורר הוא בחור צעיר, נשוי ואב לילדה וללא עבר פלילי. מתסקיר שירות המבחן עולה כי הדודים מהווים דמויות סמכותיות עבור העורר; כי המעצר יצר גבולות עבורו; זהו מעצרו הראשון של העורר והוא לא מעורב בחיי חברה שוליים ופליליים.
על רקע האמור לעיל, אני סבור כי יש בחלופה המוצעת כדי להקהות את
הסיכון שהעורר יסתבך ביידוי אבנים או בעבירה יוצרת סיכון אחרת במהלך מעצרו.
אשר על כן, אני מורה על שחרורו של העורר לחלופת מעצר בית מלא, בשלב זה, בענתה, בפיקוח הדוד נביל זיתון ת.ז. 080725658 ואשתו הדודה מזיונה זיתון ת.ז. 086024932. בנוסף, חתימה על ערבות עצמית בסך 20,000 ₪ וערבות צד ג' של הדוד בסך 20,000 ₪.
