על פי המתואר בכתב האישום המתוקן נהג העורר לבצע מעשי סדום בקטין יליד 1998 (להלן: הקטין ) בעת שהיה מושיב אותו על ברכיו ונותן לו לנהוג ברכבו, ולאחר מכן הזהירו שלא יספר על כך להוריו או לאחרים. במועדים שונים הורה העורר לקטין למצוץ את איבר מינו, אך הקטין סרב. כן הואשם העורר כי בשלהי חודש נובמבר 2011, בעת שסייע לו הקטין בעבודתו כמתקין צלחות לווין, ביקש העורר מן הקטין שיתלווה אליו לחדר ששכר במקום העבודה (להלן: החדר ). משסרב הקטין, הפילו העורר וגררו עמו לחדר, ומשניסה הקטין להימלט, תפס אותו העורר בשנית והחזירו לחדר. העורר הציע לקטין כסף בתמורה לכך שירשה לו להגיע לפורקן מיני בישבנו, אך משסרב הקטין, הפשיטו העורר, ליקק איברים מגופו וסיבן את איבר מינו. בהמשך השכיבו על בטנו, חיכך את איבר מינו בישבנו של הקטין וכן ביצע בו מעשי סדום מספר פעמים. גם במקרה זה הורה העורר לקטין שלא יאמר לאיש דבר על שהתרחש. העורר חזר על המעשים המתוארים לעיל מספר פעמים במקומות שונים.

עם הגשת כתב האישום, הוגשה בקשה למעצר העורר עד תום ההליכים. בהחלטתו מיום 12.1.2012 עמד בית משפט
קמא על הראיות לכאורה נגד העורר, וקבע כי יש בהן די והותר כדי לבסס תשתית לכאורית משמעותית ומוצקה להוכחת אשמתו. כן נקבע כי קיימת חזקת מסוכנות סטטוטורית המתעצמת נוכח העובדה שמדובר בקרבן צעיר ומכך שהעורר עשה את המיוחס לו באכזריות ותוך הפעלת כוח, ובמקרה כגון דא הכלל הוא המעצר והחלופה – החריג. מסוכנותו של העורר נלמדת גם מכך שיש חשד שפגע גם בקרבנות נוספים, כפי שאמר לקטין עצמו, וזאת בנוסף לחשש המובנה לשיבוש הליכי משפט. בסופו של יום החליט בית המשפט כי חלופת מעצר לא תסכון, והורה על מעצרו של העורר עד תום ההליכים.

מכאן הערר שלפני, בו מופנית עיקר טרונייתו של העורר כלפי קביעתו של בית משפט קמא כי אין טעם לקבל תסקיר מעצר בעניינו או לבחון חלופת מעצר. העורר טען כי לא נשקף ממנו כל חשש כלפי קטינים אחרים ועל כן מסוכנותו פחותה משנקבע על ידי בית המשפט ; כי עברו הפלילי הנקי; כי העובדה שעבד כשומר בית ספר במשך 20 שנה מעידה על כך שאיננו מסוכן; כי מחובתו של בית משפט
לבחון חלופת מעצר ספציפית שהוצעה ולנמק מדוע נעתר להצעה או דחה אותה; וכי יש להתחשב בנסיבותיו האישיות של העורר שהוא בן 60, חולני, סובל ממחלת גב וסכרת, ובעל משפחה מרובת ילדים.
בשולי הדברים טען העורר כי על אף שאינו חולק על עצם קיומן של ראיות לכאורה, הוא חולק לגבי העוצמה הרבה אשר ייחס להן בית משפט קמא.

אומר בקצרה כי בנושא הראיות לכאורה לא מצאתי ממש. לא למותר לציין כי העורר הודה לפני אביו של המתלונן על מעשיו, ואף הציע פיצוי שנדחה על ידי האב.
המעשים המיוחסים לעורר הם חמורים, ומחומר הראיות עולה כי ייתכן שהעורר פגע גם בקטינים נוספים. בנוסף, וכפי שעולה מ"המגעים" שהתקיימו בינו לבין אביו של הקטין, קיים חשש לשיבוש הליכי משפט, מה עוד שהמתלונן ומשפחת הקטין גרים בקרבת מקום.
במצב דברים זה, ההלכה היא כי לא בנקל ישחרר בית המשפט נאשם לו מיוחסות עבירות כגון דא לחלופת מעצר, אלא במקרים חריגים (בש"פ 4073/11 גולדמברג נ' מדינת ישראל (לא פורסם, 21.7.2011) והאסמכתאות שם). זאת, באשר המעשים מצביעים על מסוכנות מובהקת של העורר, ובכגון דא נפסק לא אחת כי "לא ניתן להמר על גורלם ובטחונם של קטינים" (בש"פ 1375/04 אפריים נ' מדינת ישראל (לא פורסם, 26.2.2004); בש"פ 2540/11 מדינת ישראל נ' פלוני (לא פורסם, 7.6.2011)).

עם זאת, איני סבור כי יש לסגור את הדלת לחלוטין בפני העורר, בהתחשב בגילו ובמצב בריאותו ובעברו הנקי, ויש לבחון אפשרות לחלופת מעצר "מהודקת" בעיר אחרת, תחת מפקחים מהימנים, בערבויות מתאימות ובאיזוק אלקטרוני. כל זאת, בכפוף לתסקיר חיובי של שירות המבחן,
ולאחר שהקטין ואביו יסיימו להעיד בבית המשפט (התיק קבוע לשמיעת הקטין ליום 13.2.2012).
אשר על כן, אני מורה לשירות המבחן להכין תוך 30 יום תסקיר בעניינו של העורר, ולאחר מכן, יבחן בית משפט
קמא, אם ניתן להקהות עוקצה של מסוכנות בחלופת מעצר.
