לפניי בקשת רשות לערור על החלטת בית המשפט המחוזי בבאר שבע (כב' השופט מ' לוי ), אשר דחה את ערר המבקש על החלטת בית משפט השלום בבאר שבע (כב' סגן הנשיא ע' רוזין ) והורה על מעצרו של המבקש עד היום, 8.9.2014 שעה 13:30.

המבקש נעצר ביום 1.9.2014 בחשד לביצוע עבירות של ניהול עסק ללא רישיון; סחר בסמים; שימוש והחזקת סמים שלא לצריכה עצמית; והפצת חומר מסוכן. בחזקתו נמצאו כ- 12 ק"ג
של חומר החשוד כסם מסוג "נייס גאי". החומר הועבר לבדיקת מעבדה. בדיון שנערך בבית משפט השלום בבאר שבע ביום 2.9.2014 הגיעו הצדדים להסכמה שלפיה יוארך מעצרו עד ליום 5.9.2014 וזאת לצורך השלמת בדיקות המעבדה. בית המשפט (כב' סגן הנשיא
א' רוזין ) נתן להסכמה תוקף של פסק דין, תוך שציין כי אם תתבקש הארכת מעצר נוספת, תצרף המשיבה לבקשתה מזכר חתום מאת מנהל המעבדה שהחומרים הועברו אליה לבדיקה כאמור שיפרט מתי התקבל הסם במעבדה; מתי החלה בדיקתו; ומתי בדיקה זו צפויה להסתיים. משנסתיימה תקופת המעצר המוסכמת ביקשה המשיבה להאריך את מעצרו של המבקש בשבעה ימים נוספים. ביום 5.9.2014 נעתר בית המשפט לבקשה באופן חלקי, והורה על מעצרו של המבקש עד היום – 8.9.2014 שעה 13:30. בית המשפט ציין בהחלטתו כי המשיבה לא הקפידה על הוראותיו כאמור; וכי אם תוגש בקשה נוספת להארכת מעצר, עליה להיות מלווה באינדיקציה לגבי החומר שנתפס בחזקת המבקש. בצד האמור, בית המשפט מצא כי לעת הזאת ובנתון לצורכי החקירה אין להורות בשלב זה על שחרורו של המבקש לחלופת מעצר, שכן החלופה המוצעת היא בפיקוח אשת המבקש ובביתו, שבו נמצאו החומרים שהועברו לבדיקה.

המבקש ערר על החלטה זו, וביום 7.9.2014 דחה בית המשפט המחוזי בבאר שבע (כב' השופט מ' לוי ) את הערר. בית המשפט מצא כי לא נפלה שגגה בהחלטתו של בית משפט השלום, אך ציין כי על המשיבה "לפעול לזירוז קבלת חוות הדעת המעבדתית או לזירוז קבלת אינדיקציה מהמעבדה". עוד צוין כי לעתים יש ואיחור בקבלת חוות דעת כאמור מצדיק שחרור לחלופת מעצר, מקום שהוצגה חלופה ראויה; אך במקרה דנן, נוכח כמות החומר שנמצאה, אין הצדקה להורות על שחרור, ובפרט בהינתן החלופה שהוצגה.

מכאן הבקשה שלפניי. לטענת המבקש, שגה בית המשפט המחוזי בכך שלא העריך נכונה את חלופת המעצר שהוצגה לפניו; בכך שלא ייחס משקל הולם לעובדה שגם בתום הארכת מעצר זו לא תהא, לשיטתו, אינדיקציה למיהות החומרים שבידי המשיבה; ובכך שלא ייחס משקל הולם להסתמכות המבקש על ההסכמות שהושגו בינו לבין המשיבה. לטענתו, אין הצדקה לכך שהוא שוהה במעצר שבעה ימים כאשר אין בידי המשיבה כל אינדיקציה באשר לחומרים שנמצאו ברשותו.

לאחר שעיינתי בבקשה ובהחלטות של הערכאות שקדמו לי, באתי לכלל מסקנה כי דינה להידחות. כידוע, החלטת בית משפט מחוזי בערר הנוגע למעצר אינה נתונה לערר בזכות. כעולה מסעיף 53(א1)(1) לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996, על החלטת מעצר מעין זו, כבענייננו, יש להגיש בקשת רשות לערור לבית משפט זה. הלכה היא כי במצב כזה, כדי לזכות ברשות הערעור, יש לעמוד במבחן הדומה במהותו למבחן שנקבע בבר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)), דהיינו: להוכיח כי מתבקשת הכרעה בסוגיה בעלת חשיבות ציבורית או משפטית נכבדה, החורגת מעניינם הפרטני של הצדדים לבקשה. במקרה דנן נדון עניינו של המבקש לפני שתי ערכאות, כמתחייב, ובקשתו אינה מגלה טעמים המצדיקים מתן רשות לערור ב"גלגול שלישי" לפי אמת המידה האמורה (בש"פ 2756/11 ג'ריס נ' מדינת ישראל (17.4.2011)). אף לא מצאתי כי מקרה זה מעורר את אותן נסיבות מיוחדות המצדיקות הענקת רשות ערר בהיעדר שאלה משפטית עקרונית (בש"פ 1268/12 מדינת ישראל נ' פלונית (9.2.2012) ). בשולי הדברים יוער כי הנחתי היא כי המעבדה תפעל למיצוי הבדיקה בהקדם, שאם לא כן ייתכן שיהיה מקום לשוב ולשקול חלופת מעצר בעניינו של המבקש.
הבקשה נדחית אפוא.
