החלטה
1.
לפני עתירה לגילוי ראייה מכח סעיף 44 ל פקודת הראיות (נוסח חדש), התשל"א-1971 (להלן: פקודת הראיות ).
אפרט להלן את העובדות הרלבנטיות להכרעה במכלול, ככל שהדבר מתאפשר בהחלטה שדינה להתפרסם.

כנגד העותר, תושב רצועת עזה, הוגש כתב אישום לבית המשפט
המחוזי בבאר-שבע ובו מיוחסות לו עבירות ביטחון שונות.
על פי האישום הראשון בכתב האישום, העותר קשר קשר עם תושבי עזה אחרים במטרה להעביר כלי נשק שונים מסיני לרצועת עזה דרך מנהרות השייכות לאותם אחרים, המובילות ממצרים לרצועת עזה. על פי עובדות כתב האישום, תפקידו של העותר בקשר זה היה לקבל כסף ששילמו רוכשי נשק כתשלום עבור הנשק וזאת לפני שכלי הנשק הגיעו לרצועת עזה, ולהעביר את התשלום לקושרים לאחר שכלי הנשק עברו לרצועת עזה.
בכתב האישום נטען כי העותר ביצע כשש עסקאות כאלה, כשבכל עסקה הועברו לרצועת עזה כ-30 רובי קלצ'ניקוב וכ-20 אקדחים ובעד כל עסקה קיבל העותר מהקושרים כ-1,000 דולרים.
על פי עובדות האישומים השני והשלישי , העותר נכנס לישראל שלא כדין ביחד עם אחרים בשתי הזדמנויות, ושהה במדינה למשך מספר חודשים בכל פעם.
על פי האישום הרביעי , בעת שהעותר שהה בסיני שבמצרים, הוא סייע לשלושה אנשים לחצות את גבול ישראל-מצרים ולהיכנס לישראל שלא כדין, במטרה לבצע בישראל גניבות של כלי רכב, תמורת סכום של 1,000 דולרים עבור כל מסתנן.
באישום החמישי נטען כי תושב עזה ששהה בסיני ביחד עם העותר (להלן: סלימאן ) פנה אליו וביקש את עזרתו להסתנן למדינת ישראל. העותר סירב להסתנן ללא אדם אחר בשם עיד אלסופי (להלן: עיד ) וסלימאן שב לעזה. לאחר כשבועיים נפגשו העותר, סלימאן ועוד מספר מעורבים בביתו של עיד ושם קשרו קשר לעבור למצרים ולחצות את גבול ישראל-מצרים במטרה להיכנס לישראל שלא כדין. העותר אף נאשם כי אמר ליתר הקושרים כי אם יעצרו – עליהם להציגו ב שם יוסף אלסוארכה וזאת בכדי להכשיל את השוטרים במילוי תפקידם ולמנוע את זיהויו של העותר. כעבור זמן קצר, קשר סלימאן קשר עם פעיל חמאס בשם איברהים לחטוף חייל מישראל לעזה עבור ארגון החמאס, כך שיכניסו את החייל החטוף לעזה דרך סיני. עוד קשרו השניים קשר להסתנן לישראל עם שני מטעני חבלה ולפוצץ את מטעני החבלה וזאת בכדי לגרום למותם של תושבי מדינת ישראל. סלימאן ואותו איברהים סיכמו כי איברהים יסתנן למדינת ישראל דרך מצרים עם מטעני החבלה וסלימאן יסתנן אחריו כשהוא נושא משתיק קול. סלימאן נאשם כי ביצע פעולות שונות לאחר מכן, כגון לקיחת 9 כדורים לאקדח וכרטיס זיכרון לטלפון נייד ובו הסבר על ייצור מטעני חבלה. העותר והקושרים עברו לסיני דרך מנהרה מעזה ושהו שם במשך כשבוע. בתאריך 12.12.2009 הם חצו את גבול ישראל-מצרים ונכנסו לישראל שלא כדין. על גופו של סלימאן היה אקדח ומשתיק קול כאשר האקדח היה דרוך.

העותר והקושרים האחרים נעצרו על ידי כוחות צה"ל בישראל, בסמוך לגבול. לפני מעצרו הסתיר סלימאן את האקדח, משתיק הקול והטלפון הנייד וכן שבר את כרטיס הזיכרון. בעת מעצרו הציג עצמו העותר כיוסף אלסוארכה. מאוחר יותר, בתאריך 31.12.2009 נעצר איברהים בישראל, בציר פילדלפי, כשהוא נושא על גופו שני מטעני חבלה.

כאן המקום להעיר כי בעת שנעצרו העותר והקושרים האחרים – הם נורו, במסגרת של נוהל מעצר חשוד, והועברו לטיפול רפואי בבית חולים סורוקה בבאר-שבע. אחר כך הועמד העותר לדין כאמור.

בתאריך 11.8.2010 הוצאה תעודת חיסיון על ידי שר הביטחון, וכלפיה מכוונת העתירה שלפניי. העותר מציין בעתירתו כי הראיה המרכזית נגדו היא הודאתו במשטרה ואולם הוא מעלה טענות רבות נגד חקירתו בשירות הביטחון הכללי וכלפי תרגילי חקירה שונים שהופעלו כלפיו, לטענתו. העותר מציין כי מדובבים אמרו לו כי אם לא יספר על כל מעשיו הוא ייפגע. העותר מבקש איפוא כי תימסר לו רשימת כל החומר החסוי, מבלי לפגוע בעצם החיסיון. עוד טוען העותר כי נוכח תעודת החיסיון, כל מהלך החקירה המשמעותי שבוצע כלפי העותר – הקשור למדובבים – נותר בחשיכה, ואין לו כל אסמכתא בכתב הנוגעת לחומרים שהתקבלו בחקירה זו.

בדיון שנערך בפניי – ולאחר טיעונים קצרים שהועלו במעמד הצדדים – שמעתי הסברים במעמד צד אחד בלבד מאת נציגי המדינה לגבי טיב החומר החסוי. באת-כוח המדינה טענה כי בחנה בעצמה את כל החומר החסוי האדיר שבתיק זה (4 ארגזים מלאים בעוקדנים) ולא מצאה בו חומר שיש בו, לדעתה, כדי לסייע להגנתו של העותר-הנאשם, מעבר למה שנמסר לו, למעט נושא אחד שהיא בחרה, בהגינותה, להציגו בפניי ואשר סברתי לאחר בחינתו שניתן וראוי להעביר לגביו פראפרזה מסוימת. לגבי עניין זה ארחיב בהמשך (ראו פסקאות 12 ו-13 להלן).

כאן המקום לציין כי בתאריך 27.3.2011 תוקן, בהסכמה, כתב האישום בעניינו של העותר והוסף עד תביעה נוסף. עקב כך הורחבה תעודת החיסיון שהוצאה בעניינו של העותר. בעקבות זאת ביקש בתחילה בא-כוח העותר לקיים דיון נוסף לשם השלמת טיעון לגבי החומר החסוי החדש ואולם לבסוף עדכן, בתאריך 28.6.2011, כי המחלוקת בין הצדדים צומצמה ולפיכך אין הוא מבקש לטעון עוד לגבי תעודת החיסיון העדכנית.
בעקבות הודעה זו של בא-כוח העותר, ובחינה של החומר רב-ההיקף שהועמד לעיוני (אשר נאסף ב-4 הארגזים הנ"ל) – הגיעה איפוא העת להכריע בעתירה, ואולם טרם שאני פונה לכך, אוסיף עוד שני פרטים:
(א)
במהלך הדיון שהתקיים בפני הצהירו נציגי המשיבה בהקשר ל אישום 5 הנ"ל כי מוסכם על המאשימה שהעותר לא ידע על האקדח ומשתיק הקול של סלימאן וכי אין האישום האמור כולל פריטים אלה כנגדו. נוכח עמדה זו ממילא חומר הנוגע לענין זה – איננו טעון גילוי.
(ב)
בתאריך 15.9.2011 הועדתי דיון נוסף במעמד צד אחד בלבד, בגדרו ביקשתי הבהרות מסוימות לגבי שאלות שעלו אצלי בעקבות בדיקת החומר.
דיון והכרעה

לאחר שמיעת טיעוני הצדדים ועיון במכלול החומר – הגעתי למסקנה כי דין העתירה להידחות , וזאת בכפוף לאמור בפיסקאות 12 ו-13 שלהלן. אנמק מסקנותיי מיד בסמוך.

כידוע, בחינת עתירה לגילוי ראיה נעשית באופן דו-שלבי:
בשלב הבדיקה הראשון , יש לבחון האם החומר החסוי נכלל בגדר העניינים שהוגדרו כחסויים על פי תעודת החיסיון. אם התשובה לשאלה זו היא חיובית, יש לעבור לשלב הבדיקה השני.
בשלב הבדיקה השני , יש לבחון את משקלן של הראיות החסויות ומידת חשיבותן להגנתו של הנאשם. ראיה שהינה חיונית להגנתו של הנאשם – יש להורות על חשיפתה, שכן במקרה כזה הצורך לגלותה לשם עשיית צדק עדיף מן העניין שיש לא לגלות ראיות אחרות – יש לערוך לגביהן איזון בין מידת התועלת הצפויה לנאשם מחשיפתה של הראיה, לבין הפגיעה הצפויה לביטחון המדינה מחשיפתה (ראו: בש"פ 2489/09 בראודה נ' מדינת ישראל (לא פורסם, 7.6.2009); בש"פ 3791/09 נבאהין נ' מדינת ישראל (לא פורסם, 29.6.2009); בש"פ 7193/09 פלוני נ' מדינת ישראל (לא פורסם, 1.9.2010); בש"פ 7507/10 פלוני נ' מדינת ישראל (לא פורסם, 28.2.2011) ).
הנה כי כן בפסיקה פורש סעיף 44(א) לפקודה כנותן עדיפות מסוימת לזכותו של הנאשם להליך הוגן, על פני האינטרס הביטחוני והציבורי (ראו: בש"פ 4857/05 פחימה נ' מדינת ישראל (לא פורסם, 15.7.2005); בש"פ 2489/09 הנ"ל). בהתאם נפסק כי על בית המשפט הדן בעתירה לגילוי ראיה חסויה לבחון את החומר החסוי "בעיניו של סנגור", המבקש לגלות כל בדל ראיה שיש בה, ואפילו בדוחק – כשהיא לעצמה, או עם ראיות אחרות – לסייע לנאשם (ראו: בש"פ 9086/01 רביב נ' מדינת ישראל , פ"ד נו(3) 163, 172 (2002)).

בחינת החומר החסוי על פי הכללים הנ"ל מעלה כי בכפוף לאמור בפיסקאות 12 ו-13 להלן – אין בו נתונים שיכולים לסייע להגנה בין לעניין הטענות לגבי לחצים שהופעלו עליו בחקירה ובין לעניין לחצים שהופעלו עליו על ידי מי שאינם גורמי מרות. מתברר עוד כי כל פירוט, מעבר לזה שכבר נמסר לבא-כוחו של העותר לגבי חומר החקירה בשב"כ, כולל הזכ"דים שכבר הועברו לו והפראפרזה אליה אתייחס בהמשך– יביא לפגיעה באינטרסים ביטחוניים חשובים. יוער כי הדבר נכון גם לגבי בקשת העותר לקבל לידיו רשימה של כלל חומר החקירה האמור.

אשר לטענת העותר בדבר הצורך במידע לגבי עברם הפלילי של מי מבין המדובבים שנטען כי השתתפו בחקירתו, יש להניח כי ככל שיזומן להעיד, או העיד כבר עד תביעה כזה או אחר שיש לו גיליון הרשעות קודמות רלבנטי – תימסר לבא-כוחו של העותר הודעה מתאימה ביחס לעניין זה והוא יוכל לשקול צעדיו בהתאם, כפי שהוסכם במקרה קודם (המוכר, כמובן, גם לבא כוחו של העותר כאן, שייצג את העותר שם – עיינו: בש"פ 3854/10 פלוני נ' מדינת ישראל (לא פורסם, 2.6.2010)).

על אף כל האמור לעיל, נתון אחד שעלה, כאמור, במהלך הדיון שנערך לפניי במעמד צד אחד, ואשר חזרתי ובדקתי אותו בעת שעיינתי במכלול החומר – הציף קשיים, שמצדיקים, לתפיסתי, העברת מידע לגביו לעותר. מתברר, כי בעת שהעורר שהה במתקן החקירות של שירות הביטחון הכללי אירעה התרחשות שאיננה בלתי ידועה לעותר, ואולם מן הרצוי כי תהיה גלויה לכל הנוגעים בדבר ובפרט לסנגורו (אם מרשו לא ראה מסיבה כלשהי לפרוס הדבר בפניו) – ולבית המשפט. באת כוח המדינה עדכנה איפוא, בהתאם להערותיי ולהנחייתי, כי המדינה תיאות למסור לעותר פראפרזה בהקשר לאירוע זה – בזו הלשון:
"נודע בדיעבד כי בעת שהנדון ביקר במרפאה ביום 25.12.2009 שאל אותו החובש במה הוא מואשם ויעץ לו להודות בכל פעילותו".
באת כוח המדינה הוסיפה ומסרה כי לאחר שנודע לה על ההתרחשות הנ"ל – היא בחנה את השתלשלות העניינים והבהירה לכל הנוגעים בדבר כי מדובר באירוע שלא צריך היה לקרות.

בנסיבות המתוארות בפיסקה 12 שלעיל ונוכח החומר שעיינתי בו והמידע הנ"ל, נראה לי כי הפראפרזה המוצעת אכן משקפת את טיבו של האירוע שהתרחש במרפאה והנני מורה להעביר את הפראפרזה האמורה לעותר. מעבר לכך, כאמור, לא ניתן למסור לעורר כל מידע נוסף, בצד החומר (הרב) שכבר ניתן לו.
14.
נוכח כל המקובץ, ובכפוף לאמור בפסקאות 12 ו-13 שלעיל
– העתירה נדחית.
