החלטה

לפני ערר על החלטתו של בית המשפט המחוזי בתל אביב-יפו מיום 7.10.2013 (מ"ת 43058-09-13, השופט צ' קאפח ) במסגרתה הוא הורה על מעצרו של העורר עד תום ההליכים נגדו.
כתב האישום

כנגד העורר, מרדכי אזרזר, ושלושה אחרים (להלן: האחרים ), הוגש כתב אישום (ת"פ 43158-09-13) לבית המשפט המחוזי בתל אביב, המייחס להם עבירות של קשירת קשר לביצוע פשע (עבירה לפי סעיף 499(א)(1) לחוק העונשין, תשל"ז-1977 (להלן: חוק העונשין )) , התפרצות לדירה (עבירה לפי סעיף 406(ב) לחוק העונשין), החזקת כלי פריצה (עבירה לפי סעיף 409 לחוק העונשין) ונשיאת נשק (עבירה לפי סעיף 144(ב) לחוק העונשין). לעורר מיוחסת גם עבירה של התנגדות למעצר (עבירה לפי סעיף 47(א) לפקודת סדר הדין הפלילי (מעצר וחיפוש) [נוסח חדש], התשכ"ט-1969 (להלן: פקודת המעצר והחיפוש ).

על פי המתואר בכתב האישום, ביום 22.9.2013 קשרו קשר העורר, שהוגדר כנאשם 4, והאחרים (שהוגדרו כנאשמים 3-1) לשם התפרצות לבית מגורים ברחוב אופקים 11 תל אביב (להלן: הבית ), הנמצא בבעלותו של המתלונן, כדי לבצע בו גניבה. לצורך ביצוע תוכניתם הם הצטיידו בכלי פריצה ובמכשירי טלפון סלולאריים. סמוך לשעה 12:50 באותו יום, הגיע העורר ברכב יונדאי כסוף שכור (להלן: רכב היונדאי ) לאזור שבו ממוקם הבית. אחד האחרים הגיע למקום כשהוא נוהג ברכב מסוג ג'יפ ליברטי שחור (להלן: הג'יפ ). לאחר מכן פרצו שנים מהאחרים (נאשמים 1 ו-2) לבית. הם הצליחו לפרוץ את הכספת שבה החזיק המתלונן רכוש רב וכן אקדח. לאחר שנטלו את הרכוש מתוך הכספת ברחו שני האחרים לעבר כלי הרכב שהמתינו להם בחוץ: נאשם 1 שנשא תיק גב (שבהמשך התברר כמכיל את כלי הפריצה) ברח לעבר הג'יפ שבו נהג נאשם 3, ואילו נאשם 2, שנשא שק אטום (שבהמשך התברר כי הכיל את הרכוש הגנוב, שכלל כאמור גם אקדח) ברח לרכב היונדאי שהיה נהוג בידי העורר. כחצי שעה לאחר מכן, הצליחה המשטרה לעצור את שני כלי הרכב כשהעורר והאחרים ישובים בהם. העורר התנגד למעצרו בכך שדחף את אחד השוטרים בידיו וסירב לשבת. בשעת מעצרם נמצאו בג'יפ כלי פריצה רבים (פטישים במשקל 2 ו- 3 ק"ג , לום ברזל, 3 מברגים, איזמל, מגזרי פח, מברג פיליפס, וארבעה מכפתי פטנט) ואילו ברכב היונדאי נמצא הרכוש שנגנב מהבית שכלל בין היתר כסף מזומן ושיקים, 4 דרכונים, אקדח, מחסניות המכילות כדורי 9 מ"מ , מסמכים, דיסקטים שונים וכן תכשיטי זהב.
הבקשה למעצר עד תום ההליכים

בד בבד עם הגשת כתב האישום, הגישה המשיבה בקשה לעצור את העורר והאחרים עד לתום ההליכים נגדם. בבקשה נטען כי נגד
העורר והאחרים קיימות ראיות לכאורה להוכחת אשמתם, ובכלל זה: דו"חות עיקוב אשר הבחינו בכלי הרכב, כמו גם בעורר ובאחרים בזירת הפריצה; דו"חות פעולה של בלשי ימ"ר ת"א אודות מעצר העורר והאחרים בבת ים ועמם כלי הפריצה והרכוש הגנוב; הודעה של המתלונן שזיהה את הרכוש שנתפס כשלו; חוות דעת אודות כלי הפריצה; העובדה שמרבית הנאשמים, ובכללם העורר, שמרו על זכות השתיקה; וכן העובדה שנאשם 1 מסר גרסה שהופרכה על ידי הראיות האובייקטיביות בתיק החקירה.

בבקשה הצביעה המדינה על קיומן של כמה עילות מעצר. נטען כי בעניינם של העורר והאחרים קמה עילת מעצר הקבועה בסעיף 21(א)(1)(ב) לחוק סדר הדין הפלילי (סמכויות אכיפה-מעצרים), התשנ"ו-1996 (להלן: חוק המעצרים ), שכן מדובר במי שהתפרצו לבית מגורים, לאחר תכנון מוקפד, התארגנות והצטיידות, בצהרי היום, בעת שיכלו להימצא בבית דיירים.
בנוסף נטען, כי נגד העורר והאחרים קמה עילת מעצר גם מכוח סעיף 21(א)(1)(א) לחוק המעצרים שכן קיים יסוד סביר לחשש משיבוש הליכי משפט והמלטות מדין, הנלמדת בין היתר מהעבירה בה מואשם העורר של התנגדות למעצר. בכל הנוגע לעורר ולנאשם 1 נטען כי מסוכנותם נלמדת גם מעברם הפלילי. באשר לעורר נטען כי עברו הפלילי כולל 12 הרשעות קודמות ב-16 תיקים בעבירות רכוש (כולל התפרצות, הפרת הוראה חוקית, הפרעה לשוטר ותקיפת שוטר) וכי תלוי ועומד כנגדו מאסר מותנה בן 4 חודשים (במסגרת ת"פ 27438-4-11).
הליכי המעצר בבית המשפט קמא

בתאריך 7.10.2013 התקיים דיון בבקשה למעצר עד תום ההליכים בפני בית המשפט קמא.

העורר הסכים לקיומן של ראיות לכאורה באשר לעבירות ההתפרצות והחזקת כלי הפריצה, אך התנגד לקיומן של ראיות לכאורה באשר לעבירה של נשיאת נשק, בטענה כי אין ראייה לכך שקשירת הקשר הייתה מלווה בידיעה כי קיים אקדח בבית ובהתחשב בכך שמבחינת העורר הוא לא היה מודע לתכולת השק שהובא לרכבו. כמו כן ביקש העורר כי יערך בעניינו תסקיר מעצר על ידי שירות מבחן.

בית המשפט קמא קיבל את בקשת המדינה והורה על מעצרו של העורר, מבלי להורות על הזמנת תסקיר בעניינו.

לשם השלמת התמונה ייאמר כי בית המשפט קמא החליט על מעצר עד תום הליכים גם בעניינו של נאשם 1, שאף לו עבר פלילי הכולל ריצוי של מספר מאסרים, אשר האחרון שבהם היה בן 28 חודשים, בגין עבירות רכוש. לעומת זאת, שני הנאשמים האחרים, שלהם לא היה עבר פלילי, שוחררו למעצר בית בהחלטות בית המשפט קמא מיום 7.10.2013 ומיום 23.10.2013. לגבי נאשם 2 בית המשפט הורה על הזמנת תסקיר מעצר, ובהמשך, בהתאם להמלצת שירות המבחן, הוא שוחרר למעצר בית. נאשם 3 שוחרר למעצר בית הכולל פיקוח אלקטרוני אף ללא תסקיר.

בהחלטתו קבע בית המשפט קמא כי הראיות לכאורה נגד העורר הן מבוססות גם בכל הנוגע לעבירה של נשיאת נשק, מאחר שעל-פי ניסיון החיים אין זה סביר שנאשם 2, אדם צעיר ונטול עבר פלילי, לא סיפר לעורר על האקדח שהביא עמו עם שאר שלל הגניבה.
הטענות בערר

בהליך שהתקיים בפני התמקד העורר בשתי טענות. הוא חלק על קיומן של ראיות לכאורה נגדו בעבירה של נשיאת נשק, דבר שלשיטתו משפיע גם על הערכת המסוכנות שניתן לייחס לו, וכן טען כנגד הסירוב להורות על הכנת תסקיר מעצר בעניינו.

בכל הנוגע לעבירה של נשיאת נשק, נטען כי האקדח הובא מן הבית, ללא תכנון קודם (שהרי אף המתלונן עצמו, על פי הודעתו, לא זכר בוודאות אם האקדח היה מופקד בכספת), וכי הוא הוחזק בשק אטום שלא אפשר לעורר לדעת מה נמצא בו. זאת ועוד, השק נמצא לרגלי המושב הקדמי שליד הנהג (כך על פי דוח הימ"ר), דבר שלשיטת העורר מחזק את טענתו כי לא היה ער להימצאותו. בנוסף נטען כי לא נמצאו ראיות לכך שהמערער נגע בשקית או הביט לעברה. בשולי הדברים הצביע בא-כוחו של העורר גם על העדרה של חוות דעת באשר לכך שהאקדח שנתפס הוא אכן "כלי נשק".

העורר הוסיף וטען, כאמור, כי היה מקום להכין בעניינו תסקיר מעצר, בשים לב לאופיין של העבירות המיוחסות לו – עבירות רכוש "רגילות" – ולנסיבותיו האישיות כאב לילדה קטנה החולה במחלה כרונית. בא-כוחו אף הצביע על כך שלפחות
על פני הדברים קיים סיכוי גבוה להימצאותן של חלופות ראויות בעניינו של העורר, שדודו הוא מפקד לשעבר של בית כלא.

המשיבה התנגדה לקבלת הערר על כל חלקיו ובעיקרו של דבר סמכה ידיה על החלטתו של בית המשפט קמא.
החלטה

לאחר ששקלתי את הדברים הגעתי לכלל דעה שדין הערר להתקבל במובן זה שיש להורות על הכנת תסקיר מעצר בעניינו של העורר.

בכל הנוגע לראיות לכאורה יריעת המחלוקת שבפני היא מצומצמת יחסית, לנוכח הסכמתו של העורר לקיומן של ראיות לכאורה ביחס למכלול העבירות שיוחסו לו, למעט בכל הנוגע לעבירה של נשיאת נשק. אני סבורה שבעניין עבירת נשיאת הנשק, שהמשיבה התבססה עליה לשם הדגשה נוספת של טענת המסוכנות, הראיות הן אמנם חלשות יותר, לנוכח העובדה שהוכחת היסוד הנפשי הנדרש בגדרה של עבירה זו מבוססת לכאורה על "ניסיון החיים" בלבד, כמתואר לעיל.

עברו הפלילי המכביד של העורר כמו גם העבירות שבהן נטל חלק לכאורה מצדיקים כולם את המסקנה בדבר מסוכנותו. אולם, מכלול נסיבות העניין מלמד שזוהי מסוכנות אשר אין לשלול על הסף את האפשרות של איונה על-ידי חלופה מתאימה.

בנסיבות אלה, אני מורה על הכנת תסקיר מעצר בעניינו של העורר. התסקיר יוגש לבית המשפט קמא עד ליום 21.11.2013, על מנת שזה יקיים בו דיון לשם בחינת האפשרות של חלופת מעצר.

אשר על כן, הערר מתקבל כאמור בפסקה 18 לעיל.
