עתירה לגילוי ראיה, לפי סעיף 44 ל פקודת הראיות [נוסח חדש] , התשל"א-1971.

כנגד העותרים הוגש ביום 30.9.09 כתב אישום המייחס להם עבירת הריגה וחבלה חמורה בנסיבות מחמירות – עבירות לפי סעיפים 298 ו-333 ל חוק העונשין, התשל"ז-1977 . על פי הנטען בכתב האישום, בתאריך 3.9.09 התפתחה קטטה בין העותרים ושניים נוספים בשם איהאב וואא'ל לבין המנוח ואחרים, שישבו בסמוך לקיוסק בשדרות ארלוזרוב בעפולה. במהלך הקטטה, שהתפתחה בגין עניין של מה בכך, ניגש העותר מס' 1 למכונית ממנה יצא קודם לכן, הצטייד בדוקרן ודקר באמצעותו את המנוח ואדם נוסף, בשם בילאל. לאחר שהמנוח התמוטט מתבוסס בדמו, נמלטו העותרים.
נציין, כי כנגד איהאב וואא'ל, הוגש כתב אישום בנפרד.
בתשובתם לכתב האישום, אישרו העותרים את נוכחותם בזירה בעת האירוע, אך הכחישו את מעורבותם בקטטה. כל העותרים שוחררו בשעתו לחלופת מעצר, למעט העותר מס' 1 לגביו הורה בית המשפט המחוזי בנצרת בהחלטתו מיום 19.11.09 על מעצרו עד לתום ההליכים. ערר על החלטה זו נתקבל והעותר מס' 1 שוחרר אף הוא לחלופת מעצר (החלטתו של כב' השופט פוגלמן בבש"פ 9379/09 מיום 27.11.09).

שמיעת הראיות בתיק העיקרי נמצאת בעיצומה, אך יום אחד לפני המועד האחרון שנקבע לשמיעת ראיות התביעה, נתקבלה אצל העותרים תעודת חיסיון מיום 19.1.10 החתומה על ידי שר הביטחון בצירוף פראפרזה כלהלן:
"מדיווח שמהימנותו אינה ברורה, עולה כי ארבעת הר"מ:
מחמד...בעל ת"ז....[הפרטים נמחקו מאחר שהמבקש 1 קטין – י.ע.]
אהאב פואד חאלד מחאמיד בעל ת"ז 203922794
אדהם זוהיר צאלח נבארין בעל ת"ז 305048845
תאמר חאמד מחמד מאמיד בעל ת"ז 305046195
התבטאו בפני אחרים כי רצחו תושב סולם ופצעו נוסף במסגרת קטטה בליל שישי ה-4.9.09 – בעפולה".

בעתירה דכאן, ביקשו העותרים להסיר את החיסיון על מנת לבחון את החומר המודיעיני הקושר אותם לאישום ולהצליבו עם הודעות עדי התביעה במסגרת החקירה הנגדית, לבחון את זהותם של המודיעים, לבחון את זיקתם לעניין ומידת נכונות המידע, לבחון אפשרות למידע מודיעיני נוסף הקושר אחרים לעבירה ולבחון אם היה בידי השב"כ מידע הקושר את העותרים טרם מעצרם.
לשיטתם של העותרים, על בית המשפט להורות על חשיפת ראיה, גם אם היא עלולה להיות לרועץ לנאשם, שהרי אין חקר לתבונתו של סנגור מוכשר (ראו: ע"פ 35/50 מלכה נ' היועץ המשפטי לממשלה , פ"ד ד, 429, 433 (1950).
בשולי הדברים, העותרים הלינו על כך שעד לקבלת תעודת החיסיון לא ידעו על כוונת התביעה להוציא תעודת חיסיון.

בנושא של גילוי ראיה נתברכנו בפסיקה עניפה, ולא כל אימת ש בית המשפט נדרש לעתירה לגילוי ראיה, עליו לחזור ולגולל מבראשית את הפסיקה והעקרונות בנושא זה. "עמוד האש" לאורו הולך בית המשפט
הוא שמקום בו הראיה החסויה עלולה להביא להרשעתו של חף מפשע או להטיל ספק סביר שיכול ויעמוד לזכותו, תיטה הכף להעדפת עניינו של הנאשם על פני חיסיון הראיה (ראו: ע"פ 459/95 אבו רמאדן נ' מדינת ישראל, פ"ד נ(3), 775 781 (1996) והאסמכתאות שם). שלא כטענת הסניגור המלומד, בית המשפט לא יורה על חשיפתה של ראיה שעלולה להיזקף לחובתו של הנאשם. המבחן לחשיפתה של ראיה הוא חיוניותה להגנתו של הנאשם, ועל בית המשפט
לבחון אם יש בראיה החסויה "פוטנציאל מזכה" באספקלריה שמא יש בראייה החסויה כדי לעורר ספק סביר באשמתו של הנאשם (ראו: ע"פ 889/96 מזאריב נ' מדינת ישראל , פ"ד נא(1) 433, 443 (1997); דנ"פ 1424/01 מדינת ישראל נ' דרוויש חמדאן (לא פורסם, 23.4.2001); ע"פ 5114/97 סלימאני נ' מדינת ישראל , פ"ד נה(2) 721 (1997)). מקום בו מצא בית המשפט להורות על חשיפת ראיה חסויה בשל היותה חיונית להגנתו של הנאשם, על התביעה לבחור בין חשיפת הראיה או ביטול ההליך הפלילי כדי להימנע מחשיפתה של
ראייה שגילויה עלול לפגוע באינטרס חיוני למדינה (ראו, לדוגמה: ע"פ 621/01 מדינת ישראל נ' דרויש , פ"ד נה(2) 823, 828 (2001); בש"פ 3671/05 קהמוז נ' מדינת ישראל (לא פורסם).

ומהתם להכא.
לאחר שקיבלתי הסברים מהמשיבה במעמד צד אחד ועיינתי בחומר החסוי, ועל רקע קו ההגנה וחומר הראיות הגלוי, שוכנעתי כי אין בראיה החסויה כדי לסייע בהגנתם של העותרים. הפראפרזה שנמסרה לעותרים מתמצתת את הראיה החסויה וכפי שעולה מגוף הידיעה, אין בה כדי לסייע להגנתם של העותרים (וראו החלטתי בבש"פ 120/10 פלוני נ' מדינת ישראל (לא פורסם, 24.2.10), שם עמדתי על כך שברובם המכריע של המקרים, ראיות חסויות המבוססות על מידע מודיעיני, הן בבחינת עושר השמור לרעת הנאשם).
אשר על כן, אני דוחה את העתירה.

בשולי הדברים אציין כי הצדדים נחלקו בשאלה אם הודע להגנה על כוונת התביעה להוציא תעודת חיסיון לפי סעיף 44 לפקודה. לא אקבע מסמרות בעניין, אך בכל מקרה יש להצר על כך שהתביעה נדרשה למספר חודשים עד להוצאת תעודת החיסיון. עם זאת, נוכח ההסבר שנמסר ל בית המשפט במעמד צד אחד, נחה דעתי כי הייתה סיבה לעיכוב ואין לראות בכך מחדל של התביעה.
