החלטה
ערר על החלטת בית המשפט המחוזי בירושלים עמ"ת 9310-30-10 מיום 31.10.10 (השופט מ' י' הכהן), אשר הורה על שחרורם של המשיבים לחלופת מעצר.
כתב האישום

בכתב האישום נטען כי ביום 27.9.10, סמוך לשעה 1:00, ברחוב עקבת שדאת בעיר העתיקה בירושלים, יידו המשיבים אבנים רבות מגג בייתו של המשיב 1, לעבר כוח משטרה, ששהה ברחוב אותה עת. מיד לאחר מכן נכנסו המשיבים לביתו של המשיב 1, דרך דלת הגג המובילה לפנים הבית. כוח משטרה שהגיע לבית עצר את המשיבים כשהם שוכבים במיטה. המשיב 2, כך נטען, דחף את השוטר עאמר חאמד (להלן: " עאמר" ), הכה בידו בעורפו של עאמר, ואיים על השוטרים באומרו: "אני אזיין אתכם, אני ארצח אתכם. אני אהיה עליכם שאהיד. מי אתם בכלל אני פה הבוס". לאחר שנעצר על יד כוח משטרה נוסף, המשיך המשיב 2 לאיים על השוטרים כי יפגע בהם, וכן השתולל והתנגד למעצרו.

נטען, כי במעשיהם המתוארים לעיל, ניסו המשיבים, לתקוף בצוותא שוטרים כשהם מזוינים באבנים. המשיב 2 תקף שוטר כשהוא מתכוון להכשילו במילוי תפקידו או למנוע או להפריע לו מלמלאו, ואיים על אדם בפגיעה שלא כדין בגופו, בכוונה להפחיד את האדם ולהקניטו.

הוראת החיקוק בהן הואשמו שני המשיבים: ניסיון תקיפת שוטרים בנסיבות מחמירות – עבירה לפי סעיף 274(2) + 274(3) + 25 לחוק העונשין, התשל"ז-1977 (להלן: " החוק" ); ובנוסף, לנאשם 2 בלבד: תקיפת שוטרים בנסיבות מחמירות – עבירה לפי סעיף 274(1) לחוק; איומים – עבירה לפי סעיף 192 לחוק.
השתלשלות ההליכים

בד בבד עם הגשת כתב האישום, הוגשו בקשות למעצרם של המשיבים עד תום ההליכים נגדם. בבקשה נטען, כי בעברו של המשיב 1, 5 הרשעות קודמות בעבירות אלימות ורכוש, ותלוי ועומד נגדו מאסר על תנאי של 3 חודשים, שהינו בר הפעלה בתיק זה. ביחס למשיב 2 נטען, כי בעברו 3 הרשעות קודמות בעבירות אלימות, הנחת חומר חבלה ונשק.

בדיון בבית משפט השלום, ביום 5.10.10, הצהיר בא כוח המשיבים כי אין מחלוקת לגבי קיומן של ראיות לכאורה. בהחלטה מאותו יום, הורה בית משפט שלום (השופט ח' לי-רן) על שחרורם של המשיבים. משיב 1 שוחרר בהפקדה של 2,500 ש"ח וערבות צד ג' בסך 3,000 ש"ח, ללא כל תנאים מגבילים. משיב 2 שוחרר לבית אביו, בשכונת אסעדיה בעיר העתיקה, עם ערבות צד ג' בסך 2,500 ש"ח, ללא כל הפקדה כספית. כמו כן, דחה בית המשפט את בקשת העוררת לעכב את שחרור המשיבים ב-48 שעות.

בו ביום, 5.10.10, הגישה העוררת ערר דחוף לבית המשפט המחוזי על החלטות בית משפט השלום, הן על ההחלטה שלא לעצור את המשיבים עד תום ההליכים והן על ההחלטה שלא לעכב את ביצוע השחרור.

בהחלטת בית המשפט המחוזי מאותו יום, הורה בית המשפט על הכנת תסקירי מעצר מטעם שירות המבחן, עד ליום 27.10.10, וכן על מעצרם של המשיבים עד לדיון שיתקיים לאחר קבלת התסקירים. וכך קבע בית המשפט:
"בנסיבות האמורות, מתחייבת לדעתי הזמנת תסקיר מעצר שיבחן לעומק הן את רמת מסוכנותם של המשיבים והן את האפשרות לשחרר את המשיבים לחלופת מעצר אפקטיבית, שתפיג במידה מספקת את מסוכנותם, כולל החלופות שנמנו על ידי הסנגור. עד למתן התסקיר וקבלת החלטה מסכמת בערר, אין אפשרות, לאור מסוכנותם המוכחת של המשיבים, להותיר אותם בחלופות שקבע בית המשפט קמא וגם לא בחלופות האחרות שהוצגו על ידי בא כוח המשיבים במהלך הדיון ולא נבדקו באופן מקצועי."

המשיבים הגישו ערר לבית משפט זה על החלטת בית המשפט לעוצרם עד להכנת התסקירים, זאת מתוך הנחה שהתסקירים לא יוכנו במועד. בדיון בבית משפט זה ביום 14.10.10, הסתבר לבא כוח המשיבים כי שירות המבחן כבר נפגש עם המשיבים, ועל כן ביקשו המשיבים לחזור בהם מהערר והוא נדחה.

בתסקיר שירות המבחן בעניינו של המשיב 1 העריך שירות המבחן, כי נשקף מהמשיב סיכון ברמה בינונית גבוהה. שירות המבחן פגש בהורי המשיב, שהוצעו כמפקחים והתרשם שהם מבינים את תפקידם. ההורים מסרו, כי מגג ביתם אירעו בעבר מספר תקריות יידוי אבנים על יד זרים. שירות המבחן התלבט בעניין המלצת שחרור, והמליץ, שאם בית המשפט שוקל לשחרר את המשיב 1 לחלופה, ישוחרר לבית הוריו בתנאי מעצר בית מלא.

בתסקיר שירות המבחן בעניינו של המשיב 2 העריך שירות המבחן, כי נשקפת מהמשיב סיכון ברמה גבוהה. שירות המבחן התרשם מגישה מגוננת של הורי המשיב כלפיו, ונמנע מלהמליץ על שחרורו.

בהחלטת בית המשפט המחוזי מיום 31.10.10, הורה בית המשפט המחוזי על שחרורם של המשיבים למעצר בית מלא בבתי הוריהם, בעיר העתיקה, בתנאים שתוארו לעיל. בית המשפט קבע בהחלטתו כי "אין להתעלם מחומרת העבירות המיוחסות למשיבים ומעברם הפלילי המצביעים יחד על מסוכנות משמעותית". עם זאת, נוכח טענת המשיבים, כי לא אירעו אירועים נוספים באותו אזור בשבועות האחרונים, ראה בית המשפט להורות על שחרור המשיבים. בית המשפט נימק את שחרור המשיבים חרף המלצתו השלילית של שירות המבחן, בכך שהערכת המסוכנות התבססה על כך שהמשיבים הכחישו את ביצוע העבירות המיוחסות להם.

שחרורם של המשיבים עוכב, לבקשת העוררת למשך 48 שעות עד היום.
נימוקי הערר

העוררת טוענת, כי טעה בית המשפט בכך שהורה על שחרורם של המשיבים לחלופת מעצר, חרף הסכנה הרבה הנשקפת מהם והנלמדת מחומרת מעשיהם, עברם הפלילי ותסקיר שירות המבחן. העוררת מוסיפה וטוענת כי אין מדובר במשובת נעורים, כי אם באירוע מתוכנן ומסוכן שנעשה בידי בוגרים בעלי עבר פלילי מכביד, כנגד שוטרים.

טוענת העוררת, כי טעה בית המשפט קמא בכך שנימק את החלטתו לשחרר את המשיבים ממעצר, בהתבסס על טענת המשיבים, כי לא היו אירועים אחרים של יידוי אבנים מאז מעצרם של המשיבים, טענה עליה חולקת העוררת. לשיטת העוררת, מעצרם של המשיבים נדרש, נוכח המסוכנות הנשקפת מן המשיבים עצמם, וכי טענת ההגנה באשר להעדר אירועים אחרים איננה גורעת ממסוכנות זו.

כמו כן טוענת העוררת, כי בית המשפט לא ייחס משקל מספיק לעברם הפלילי של המשיבים, והסכנה העולה מהם; למשיב 2 עבירות דומות מאוד בעברו, ובנסיבות חמורות ביותר, לטענת העוררת. בגין חומרת מעשיו, נדון בהיותו כבן 17, לשלוש שנות מאסר על ידי בית המשפט המחוזי. בערעור שהוגש לבית המשפט העליון, ע"פ 8042/03, החמיר בית המשפט את עונשו של המשיב לארבע שנות מאסר בפועל. באירוע החמור בו השתתף, השליך המשיב, יחד עם אחרים, סלע במשקל 17.5 ק"ג ואבנים נוספות מגגו של מסגד בעיר העתיקה בירושלים, לעבר בני משפחה יהודים, ביניהם שני ילדים, האחד בן שלוש והשני בן שנה וחצי, וכתוצאה מכך נפגעו שניים מבני המשפחה קלות; למשיב 1 מאסר על תנאי של שלושה חודשים בר הפעלה בתיק זה. בעבר ריצה המשיב 1 מספר מאסרים בפועל, כולל מאסר לתקופה של 30 חודש. למשיב זה 5 הרשעות קודמות ב-16 תיקים, הכוללים, בין היתר, עבירות שוד מזוין, תקיפת שוטר, תקיפה בתנאים מחמירים, החזקת סכין, איומים ועבירות סמים. העוררת תטען, כי נוכח עברם המכביד של המשיבים לא ניתן לתת בהם את האמון הדרוש לצורך שחרורם לחלופת מעצר.

לחלופין טענה העוררת, כי אין בחלופות המעצר עליהן הורה בית המשפט להשיג את מטרתן. בית המשפט שחרר את המשיבים לזירת האירוע, לאותה שכונה בעיר העתיקה בירושלים, בה ביצעו את העבירות. המשיב 1, שוחרר לאותו בית ממש ממנו יידו את האבנים. אשר על כן, התבקש בית המשפט לבטל את החלטת בית המשפט קמא ולהורות על מעצרם של המשיבים עד תום ההליכים המשפטיים נגדם, ולחלופין לקבוע תנאי שחרור מחמירים יותר.

לא בלי היסוס החלטתי לדחות את בקשתה הראשית של המדינה ולהעתר לבקשה החלופית בלבד. בית המשפט של ערעור יטה להתערב בכגון דא רק כשישנה טעות בולטת בהחלטת הערכאה הראשונה. בענייננו – לא אכחד – אפשר ואילו דנתי בעניין כערכאה ראשונה הייתי מחליטה אחרת, ואולם זהו מקרה גבולי ולא ראיתי, על דרך העיקרון, להתערב בשיקול הדעת של בית המשפט המחוזי. עם זאת, צריך לשנות את תנאי השחרור באופן שמעצר הבית יהיה הרחק ממקום סכנה. על כן קובעת אני כי המשיב 1 ישהה בבית חנינא בכתובת שתומצא לעוררת עובר לשחרור ואילו המשיב 2 ישהה בבית אחותו בשכונת טיר, גם כן בכתובת עליה יודיע לעוררת. הערבים המקוריים שנקבעו יפקחו עליהם בכתובות החלופיות.

השחרור יבוצע רק אחרי הודעה על הכתובות ומילוי תנאי הערבות.

הערר מתקבל במובן עליו עמדתי.
