השגה על החלטת מזכירות

בפניי השגה על החלטת מזכירות בית המשפט שלא לקבל הליך לרישום.
ההליך אותו ביקשה המבקשת להגיש הינו "בקשות לפסילת שופט מנומקות היטב ומתן מענה ענייני להחלטה והתנהלות השופט". הגשת הליך כאמור אינה מעוגנת בהוראות הדין, שהרי לא ניתן לעתור בבית משפט זה לפסלותו של שופט טרם שניתנה על ידו החלטה בבקשה כזו. ככל שכוונת המבקשת היא הגשתו של ערעור פסלות, הרי שמן ההחלטה אשר צורפה להליך שהגשתו מתבקשת עולה כי המבקשת עתרה לפסלותו של כב' השופט צ' עוזיאל מבית משפט השלום בתל-אביב-יפו, במסגרת הליך פלילי המתנהל בעניינה, ובהחלטה מיום 4.12.2013 קבע השופט עוזיאל כי "המשך דיון, לרבות בבקשה לפסילת שופט, יתקיים ביום 5.1.2014, כפי שתוכנן".
דהיינו, בשלב זה טרם הכריע השופט עוזיאל בבקשת פסלות שהגישה המבקשת וקבע כי ידון בה במהלך הדיון שיתקיים בפניו, וממילא בשלב זה אין בנמצא החלטה עליה ניתן להגיש ערעור פסלות. עוד יוזכר, כי ככלל לא ניתן להשיג על החלטות ביניים בהליך פלילי, ומשכך ומשאין מדובר בהחלטה בבקשה הפסלות, אין בידי המבקשת להשיג עליה בשלב זה.
אשר על כן צדקה מזכירות בית המשפט בקובעה כי אין מקום לקבל את ההליך לרישום, וההשגה נדחית אפוא.
