החלטה
בפניי בקשה לעיכוב ביצוע עונש מאסר בפועל בן 12 חודשים שהושת על המבקש בפסק דינו של בית משפט זה בע"פ 9723/08 עד למתן החלטה בבקשה לדיון נוסף שהגיש על פסק הדין.
בתמצית, בית המשפט המחוזי בתל-אביב-יפו (תיק פלילי 40013/08) הרשיע את המבקש על פי הודאתו בעבירות של החזקת סמים מסוכנים מסוג קוקאין וחשיש, והשית עליו עונש של 6 חודשי מאסר לריצוי בדרך של עבודות שירות, שתי תקופות של מאסר על תנאי וקנס. ערעור המשיבה על קולת העונש (ע"פ 9723/08) התקבל בבית משפט זה בדעת רוב (כבוד השופטים א' א' לוי ו מ' נאור לעומת דעתו החולקת של כבוד השופט א' גרוניס ) ועונשו הוחמר ל-12 חודשי מאסר. על פסק דין זה הוגשה הבקשה לדיון נוסף.
כידוע, נאשם אשר נגזר עליו עונש של מאסר חייב להתחיל בריצוי עונשו מייד לאחר מתן גזר הדין (ראו למשל ע"פ 6458/07 ברדע נ' מדינת ישראל (טרם פורסם, 31.7.2007)). עיכוב ביצוע עונש מאסר יינתן רק במקרים מיוחדים אשר יתקיימו בהם נסיבות אשר משקלן עולה על זה של משקל האינטרס הציבורי המתבטא באכיפה מיידית של הענישה
(ראו ע"פ 111/99 שוורץ נ' מדינת ישראל , פ"ד נד (3) 769 (2000) (להלן: הלכת
שוורץ ). על אחת כמה וכמה נכונה הלכה זו שעה שמ דובר בבקשה לדיון נוסף, בקשה שמטבעה סיכוייה נמוכים הם.
בנסיבות הענין, ולאחר שעיינתי בבקשת המבקש כמו גם בתגובת המשיבה, איני רואה מקום להיעתר לבקשה לעיכוב ביצוע עונש המאסר. אין מקום, מטבע הדברים, בהליך זה להידרש לסיכויי הבקשה לדיון נוסף גופה, ואסתפק בכך שאציין כי לא ראיתי על פני הדברים כי סיכוייה כה גבוהים הם עד שמוצדקת הסטייה מהלכת שוורץ
ומתן עיכוב ביצוע בנסיבות העניין.
אשר על כן, הבקשה נדחית.
החלטתי מיום 7.4.09 לעיכוב ביצוע העונש מבוטלת בזאת.
על המבקש להתייצב עד ליום 10.5.09 בשעה 9:00, במזכירות הפלילית של בית המשפט
המחוזי בתל-אביב-יפו, לשם תחילת ריצוי עונשו.
