החלטה
לפני בקשה לקיום דיון נוסף בפסק דינו של בית המשפט העליון בע"פ 4346/10 רייפמן נ' כונס הנכסים הרשמי (טרם פורסם ,
28.6.2010) , שניתן מפי כבוד השופטים א' א' לוי ,
א' גרוניס ו ח' מלצר , וכן בקשה לעכב את ביצועו של פסק הדין עד להכרעה בבקשה. עובדות הפרשה פורטו כבר בהרחבה בהליכים קודמים שבאו בפני בית משפט זה ואין צורך לגולל את פרטי הפרשה שוב כעת (ראו החלטת השופט מלצר בע"פ 7174/09 מיום 21.9.2009 וכן בפסק הדין נשוא בקשה זו). בתמצית , המבקש הוא איש עסקים , אשר החזיק במניותיה של חברה אשר נכנסה להליכי פירוק. בית המשפט המחוזי קבע כי על המבקש להעביר את מניותיו בחברה לידיו של המנהל המיוחד שמונה לנכסיו. אך משהפר המבקש את הצו שהוצא למסירת המניות ,
הורה בית המשפט המחוזי על מאסרו לפי פקודת בזיון בית המשפט. בשלב מסוים נענה בית המשפט המחוזי לבקשת המבקש למנות מומחה שיחווה דעתו באשר לגורלן של המניות. אך יחד עם זאת קבע בית המשפט כי מינוי המומחה אינו מייתר את המאסר.
בית המשפט העליון נדרש לבחינת החלטתו של בית המשפט המחוזי באשר למאסרו של המבקש במקביל למינוי המומחה לעניין מיקומן של המניות "האבודות". נקבע כי שני המסלולים בהם בחר ללכת בית המשפט – מינוי המומחה וקיום המאסר – אינם עומדים בסתירה זה לזה. "נקיטת מהלכים שאפשר כי יובילו לאיתורן של המניות" , כך נקבע , "אינה מנטרלת את ההפרה הנמשכת של הצו על ידי המערער". משכך , נדחה ערעורו של המבקש.
המבקש אינו משלים עם פסק הדין ,
והוא סבור כי יש מקום לקיים בו דיון נוסף. לטענתו ,
פסק הדין קובע הלכה חדשה באשר לתכליתו של צו שיפוטי ואופן השימוש בו , וכן בנוגע למטרותיו של הליך בזיון בית המשפט. הלכות אלה , כך סבור המבקש , עומדות בניגוד להלכות קודמות של בית משפט זה.
לאחר שבחנתי את טענות המבקש באתי לכלל מסקנה כי דין הבקשה להידחות. כידוע , הליך הדיון הנוסף שמור למקרים נדירים ויוצאי דופן , שבהם פסק בית המשפט העליון הלכה חשובה , קשה , חדשה או כזו העומדת בסתירה להלכה קודמת של בית-המשפט העליון (סעיף 30(ב) לחוק בתי המשפט [נוסח משולב] ,
התשמ"ד-1984). מקרה זה אינו בא בגדר המקרים החריגים והנדירים האלה. פסק הדין אינו קובע הלכה חדשה באשר למהותו של צו שיפוטי או תנאים הנדרשים לקיומו , ואף לא באשר לתכליתו של הליך הבזיון. המדובר אך בפסק דין אופרטיבי , שאינו מבקש לקבוע כל הלכה חדשה , לא כל שכן כזו העומדת בסתירה להלכות קודמות של בית משפט זה. נפסק כבר כי "בכדי להצדיק קיומו של דיון נוסף , קביעת ההלכה בפסק הדין צריכה להיות גלויה , מפורשת וברורה" (דנ"פ 6135/09 תורק נ' מדינת ישראל (טרם פורסם , 14.4.2010)). דברים אלה יפים אף לענייננו. אין ספק כי תוצאת פסק הדין היא קשה מבחינת המבקש. אך לא לכך נועד הליך הדיון הנוסף.
התוצאה היא שהבקשה נדחית. בנסיבות אלה ,
מתייתרת הבקשה לעיכוב ביצוע פסק הדין.
