החלטה
1.
לפני בקשה למשפט חוזר שדינה להימחק.
2.
המבקש הורשע בעבירת רצח ודינו נגזר למאסר עולם. ערעורו לבית משפט זה נדחה (ע"פ 7450/02).

הבקשה למשפט חוזר הוגשה על ידי המבקש עצמו ללא ייצוג והיא כוללת עמוד אחד בכתב ידו של המבקש. בהמשך הגיש המבקש עמוד נוסף בכתב ידו ובין היתר ביקש כי ימונה לו סניגור. ביום 5.1.2006 קבע הנשיא ברק כי הבקשה למשפט חוזר תתברר לפני. מספר ימים לאחר מכן ביום 15.1.2006 ביקש הרשם יגאל מרזל כי הסנגוריה הציבורית תמסור עמדתה לעניין ייצוג המבקש בהליך.

עמדת הסנגוריה הציבורית לא נמסרה אלא כעבור כשנה ביום 27.12.2006 לאחר מספר הארכות מועד שניתנו לה. הסנגוריה הציבורית הודיעה כי "בשלב זה, מאחר ונדרשת עדיין עבודה מהותית רבה בבדיקת התיק, מודיעה הסניגוריה הציבורית כי אין באפשרותה לייצג את המבקש בבקשתו זו למשפט חוזר. בכך אין כדי לחוות דעה לעניין ייצוגו בבקשה עתידית של המבקש למשפט חוזר, אם תימצא הסניגוריה הציבורית כי יש מקום להגשת בקשה כזו". בשלב זה ביקשתי, בהחלטה מיום 1.1.2007, כי הסנגוריה הציבורית תבהיר "מדוע העובדה שנדרשת עבודה רבה מביאה את הסנגוריה הציבורית למסקנה כי לא תוכל לייצג את המבקש בבקשה זו אך אפשר ותייצג אותו בבקשה אחרת".

בהבהרה שהוגשה מטעם הסנגוריה הציבורית ביום 5.2.2007 נמסר כי המבקש פנה גם ישירות לסנגוריה הציבורית בבקשה לייצגו אך היא טרם סיימה לבדוק את תיקו וכי בדיקה זו עשויה להימשך עוד זמן רב. כמו כן נמסר בהבהרה כי "נכון למועד זה טרם מצאה הסניגוריה הציבורית עילה להגשת בקשה למשפט חוזר [...] אם בתום הבדיקה תמצא הסניגוריה הציבורית עילה למשפט חוזר, תגיש בשמו של המבקש בקשה חדשה למשפט חוזר [...] מכאן, שהסניגוריה הציבורית מבהירה, כי אין היא מייצגת את המבקש בבקשה למשפט חוזר שהגיש בעצמו".

בשלב זה החלטתי ביום 8.2.2007 כי "המבקש, אליו תועבר הבהרת הסניגוריה הציבורית באמצעות שב"ס, יגיב להבהרה תוך 15 ימים". כל תגובה לא התקבלה וביום 22.3.2007 קבע כבוד הרשם יגאל מרזל כי "המבקש טרם הגיב להחלטת כב' השופטת מ' נאור מיום 8.2.07 וניתנת לו הזדמנות נוספת לעשות כן, תוך 10 ימים מעת המצאת החלטה זו [...] בהעדר תגובה יכול וימחק ההליך מחמת חוסר מעש".

עד כה ולמרות שחלפו כבר יותר מ- 5 חודשים מאז החלטתי וכמעט 4 חודשים מהחלטת הרשם לא התקבלה כל תגובה מן המבקש. מזכירות בית המשפט ווידאה לבקשתי כי החלטות אלו אכן נמסרו למבקש.

הבקשה למשפט חוזר בה עיינתי כוללת כאמור מספר עמודים מצומצם ביותר בכתב ידו של המבקש ועל פניו קשה למצוא בה עילה המצדיקה משפט חוזר. בכל אופן העיקר הוא בכך שהמבקש פנה ישירות לסנגוריה הציבורית בבקשה לייצגו (ראו סעיף 18(א)(9) לחוק הסניגוריה הציבורית, התשנ"ו-1996). הסנגוריה הציבורית כפי שנמסר אכן בודקת את בקשתו ומאחר שהמבקש לא הגיב להחלטתי בעניין זה יש להניח כי זנח את הבקשה שלפני ודין הבקשה להימחק מחמת חוסר מעש.

הבקשה נמחקת אפוא. העתק מהחלטה זו יישלח גם לסנגוריה הציבורית.
