בקשה לפטור מעירבון
החלטה

במסגרת הדיון בבקשה לפטור מערבון התעוררה השאלה בדבר דרך התקיפה של החלטת בית המשפט המחוזי, האם בדרך של בקשה לרשות ערעור או שמא בערעור בזכות. המשיב טען כי היה על המבקשת להגיש ערעור בזכות, שכן החלטת בית המשפט המחוזי היא בבחינת "צו בפשיטת רגל". המבקשת בתגובה הודיעה כי נפלה טעות סופר בהגשת ההליך ואכן יש להגישו בדרך של ערעור בזכות. מעיון בתיק בית המשפט עולה כי ההחלטה נשוא הערעור הינה החלטה של בית משפט של פשיטת רגל, אשר דחה את בקשת המבקשת, המוכרזת כפושטת רגל, לצו הפטר. החלטה זו היא אכן "צו בפשיטת רגל" כמשמעותו בסעיף 182 לפקודת פשיטת הרגל, שכן הנפגע על ידו רשאי לערער עליו (בזכות). ההליך הדיוני הנכון הוא איפוא ערעור בזכות. בנסיבות העניין, לא ראיתי מניעה להיעתר לבקשת המבקשת לשנות את סיווג ההליך לערעור בזכות.

מכאן לבקשה לפטור מהפקדת ערבון. המבקשת – המיוצגת מטעם הלשכה לסיוע משפטי – טוענת כי עקב מצבה הכלכלי הקשה אין באפשרותה לגייס תשלום כלשהו לצורך הפקדת הערבון. לדברי המבקשת, היא מתגוררת בדיור ציבורי, פוטרה לאחרונה מעבודתה ואין לה כל הכנסה. המבקשת מוסיפה וטוענת כי פנתה לבני משפחתה ולקרובים בניסיון לגייס כספים לצורך הפקדת הערבון, אולם מחייתם מצומצמת ואין באפשרותם לעזור למבקשת. המשיב מתנגד לבקשה בטענה כי סיכויי הערעור קלושים.

עיון בבקשה שלפניי ובמסמכים שצורפו לה מעלה כי מצבה הכלכלי של המבקשת אינו מן המשופרים. לכך מתווספת העובדה שהמבקשת נמצאה זכאית לייצוג של הלשכה לסיוע משפטי ולבעלה משולמת גמלת הבטחת הכנסה עבור שני בני הזוג. אולם לצורך פטור מערבון, אין די במצבו הכלכלי של המבקש ויש לאמוד אף את סיכויי ההליך. מעיון בהחלטתו של בית המשפט המחוזי, בהודעת הערעור ובתגובת המשיב, נראה כי, על פני הדברים, סיכויי ההליך אינם גבוהים. בית המשפט המחוזי לא ראה הצדקה ליתן למבקשת הפטר נוכח פרק הזמן הקצר שחלף מאז כניסתה להליכי כינוס ומאז הכרזתה כפושטת רגל ונוכח הדיבידנד הזעום שיקבלו הנושים בשלב זה. כפי שציין המשיב בתגובתו, דחיית הבקשה למתן צו ההפטר אינה מונעת מן המבקשת לקבל הפטר מחובותיה בעתיד, לאחר שייקבע כי הבשילו התנאים לכך. במצב דברים זה, למרות הנטייה להפעיל בדרך גמישה את סמכות הפטור (ראו, ע"א 4385/01 אלון נ' כונס הנכסים הרשמי , פ"ד נה(5) 361), אין בידי לקבוע כי סיכויי ההליך מצדיקים פטור מלא מהפקדת ערבון. בשים לב למהות ההליך, למצבה הכלכלי של המבקשת, למעמדם היחסי של הצדדים ולפסיקת ההוצאות הצפויה במקרה של כשלון ההליך, יועמד הערבון על סך של 2,500 ₪.
