פסק-דין
בדיון שנערך בפנינו קיבלו בעלי הדין את הצעתנו, כי ההכרעה בערעור זה תהא בהתאם לסעיף 79א(א) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, כך שבית המשפט יקבע מאיזה מועד יחולו ריבית והפרשי הצמדה לפי חוק פסיקת ריבית, התשכ"א-1961 (להלן – חוק פסיקת ריבית). רואים אנו לנכון לשבח בהקשר זה את עמדתן ההוגנת של המשיבות.
לאחר בחינה של הטענות לכאן ולכאן הגענו לכלל דעה כי החל מיום 1.1.90 יחושבו הפרשי הצמדה וריבית לפי חוק פסיקת ריבית. מיותר לומר שעד למועד הנזכר ייערך החישוב על פי החוק לתיקון דיני הרכישה לצרכי ציבור, התשכ"ד-1964. על המשיבות לשלם את היתרה הנובעת מ פסק דין זה תוך 60 ימים מהיום.
