החלטה
לפניי בקשה לפטור מהפקדת עירבון בהליך שבכותרת.

ההליך נסוב על פסק דינו של בית המשפט המחוזי בחיפה, בו נדחתה תביעת המערער לפיצויים בגין רשלנות רפואית בקשר לטיפול הרפואי שניתן לאמו עובר ללידתו. בבקשה לפניי נטען כי המערער הינו קטין הלוקה בתסמונת דאון, חסר כל אמצעים ורכוש. נטען כי גם להוריו קשיים לגייס את סכום הערבון. הבקשה נתמכת בתצהיר של אמו של המערער, בה מצוין כי המערער נמצא במשפחה אומנת וכי הוריו נדרשים להשתתף בהוצאות הרשות המקומית בטיפולו בסכום של כ-2,000 ₪. משיבים 4-1 מתנגדים לבקשה.

על המבקש פטור מעירבון, תוך חשיפת בעל הדין שכנגד לסיכון כי הוא לא יוכל לגבות את מלוא הוצאותיו, אם יפסקו כאלה, לעמוד בשני תנאים מצטברים: חוסר יכולת כלכלית להפקיד העירבון וקיום סיכויים טובים להליך. כדי לעמוד בתנאי הראשון על מבקש הפטור לפרוש לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי. המערער לא עמד בדרישה זו. יובהר כי כאשר מ דובר בהליך המוגש מטעמו של קטין באמצעות הוריו, כפי המקרה דנן, לא ניתן להסתפק בטענה כי לקטין עצמו לא עומדים מקורות עצמאיים לגיוס כספי הערבון. ככל בעל דין, גם על קטין להסתייע בסביבתו הקרובה לשם גיוס כספי הערבון. דרישה זו מקבלת משנה תוקף כאשר מ דובר
בהליך המוגש הלכה למעשה על ידי הוריו של הקטין. מכאן שהבקשה לפטור מערבון צריכה הייתה לכלול פרטים לגבי יכולתם הכלכלית של הוריו של המערער. בבקשה לא ניתן כל פירוט בעניין זה, לא בדבר נכסים ולא בדבר הכנסות. במצב דברים זה, לא מתקיים התנאי הראשון בדבר הוכחת חוסר יכולת להפקיד ערבון. יש להוסיף כי לא שוכנעתי גם בהתקיימותו של התנאי השני, באשר לסיכויי ההליך. על פני הדברים נראה כי סיכויי הערעור – המופנה נגד ממצאים עובדתיים וקביעות מהימנות של הערכאה הדיונית – אינם טובים באופן המצדיק פטור מערבון. בשים לב לטיב ההליך ומהותו ולכלל נסיבות העניין, יעמוד סכום הערבון על סך של 15,000 ₪. הערבון יופקד תוך 21 ימים מעת המצאת החלטתי זו, ולא - יירשם ההליך לדחייה ללא צורך במתן הודעה נוספת.
