בקשה להגדלת היקף סיכומים

לפניי בקשת המשיבות בע"א 1203/10 להרחבת היקף סיכומיהן, מ-18 עמודים ל-23 עמודים. על פי הטענה, הרחבת ההיקף דרושה להן כדי להשיב לטענות שנטענו בסיכומי המערערת על דרך של הפניה להודעת הערעור. המערערת בע"א 1203/10 מתנגדת לבקשה וטוענת, כי המשיבות, במסגרת סיכומיהן כמערערות בע"א 1324/10, הפנו פעמים רבות לאמור בהודעת הערעור מטעמן. מבוקש, כי במידה ובקשת המשיבות בע"א 1203/10 תיענה בחיוב, יורחבו סיכומי המערערת בהיותה משיבה בע"א 1324/10.

בקשת המשיבות להרחבת היקף הסיכומים מגלה, כי סיכומי המערערת בע"א 1203/10 כוללים טענות שנטענו על דרך של הפניה להודעת הערעור. תגובת המערערת לבקשה מעלה, כי אף סיכומי המערערות בע"א 1324/10 לוקים בכך. כידוע, הדיון בהליך הערעור מתנהל על יסוד הסיכומים שמוגשים לפי צו סיכומי הטענות, בהיקף ובמתכונת שנקבעו בו, ולא ניתן לטעון בסיכומים בדרך של הפניה להודעת הערעור או לסיכומים בהליך דלמטה. הפניות כאלו פוגעות בשוויון הדיוני בין בעלי הדין, מכבידות על הקריאה הרציפה בסיכומים ופוגעות ביעילות ההליך (השוו: ע"א 2008/07 לוטן נ' ירמייב (לא פורסם, 24.7.2008)).
לפיכך, סיכומי המערערת בע"א 1203/10 וסיכומי המערערות בע"א 1324/10 יושבו לידיהן, והן יגישו סיכומים חדשים, ללא הפניות להודעת הערעור, עד ליום 23.3.2011. סיכומי המשיבות בשני הערעורים יוגשו עד ליום 9.5.2011. סיכומי התשובה מטעם המערערות בכל אחד מן התיקים יוגשו, ככל שתחפוצנה המערערות בהגשתם, עד ליום 30.5.2011.

תיקון סיכומי הצדדים, כך שלא יכללו הפניות להודעת הערעור, מייתר, למעשה, את הבקשה להרחבת היקף, שכן הטעם המונח ביסודה לא יתקיים עוד. הסיכומים יוגשו בהיקף שנקבע בצו הסיכומים ויערכו בהתאם להוראותיו. כל צד יישא בהוצאותיו בהליך שלפניי.
