החלטה
לפניי בקשה לסילוק הערעור שכנגד שהוגש בתיק שבכותרת – על-הסף.
שתי תביעות הוגשו לבית המשפט המחוזי: האחת על-ידי המשיב (המערער שכנגד) – מר דורון לוטן – נגד מר אריה נתנאל (ת"א 1080/06); והשנייה על-ידי המערערת בערעור העיקרי, מ.א. נתנאל חברה לבנין ועבודות ציבוריות בע"מ, נגד המשיב (ת"א 1135/08). תביעתו של המשיב (ת"א 1080/06) נדחתה. גם תביעתה של מ.א. נתנאל (ת"א 1135/08) נדחתה. פסק-הדין ניתן ביום 26.12.2011.
ביום 12.2.2012 הגישה מ.א. נתנאל ערעור על פסק-הדין. צוין מפורשות כי הערעור נסב על דחיית התביעה שהגישה, קרי: ת"א 1135/08, וכי המערערת אינה משיגה על פסיקתו של בית המשפט קמא באשר להליכים נוספים שהיו לפניו (הכוונה לת"א 1080/06 ולהליך נוסף שפסק-הדין בו ניתן בנפרד). ביום 19.3.2012 הגיש המשיב (לוטן) ערעור שכנגד המופנה נגד מר נתנאל וכנגד מ.א. נתנאל. ביום 23.4.2012 ניתן צו לסיכומים, וביום 26.7.2012 הוגשה הבקשה שלפניי לסילוק הערעור שכנגד על-הסף (ולתיקון צו הסיכומים בהתאם). מונחת לפניי גם תגובתו של המשיב לבקשה לסילוק על הסף.
דין הבקשה להתקבל. כלל הוא כי ערעור שכנגד צריך לתחום את עצמו לעניינים שעלו בגדרי הערעור העיקרי (ע"א 3034/94 זילברמן נ' שנפלד , פ"ד מט(2) 1 (1995)). על כן, לא ניתן להעלות בערעור שכנגד את כל ההשגות על פסק-הדין של הערכאה הקודמת; ניתן להעלות רק השגות שיש להן זיקה למסגרת העניינית שהותוותה בערעור העיקרי. עמד על כך בית המשפט העליון באחת הפרשות:
בעצם האפשרות להגיש ערעור שכנגד מוענקת פריבילגיה למי שיכול היה לערער בערעור ראשי ולא עשה כן, לחרוג מפרקי הזמן הקצובים לו להגיש ערעור רגיל, ופריבילגיה זו מהווה גם כעין שוט כלפי הצד שכנגד החפץ בהגשת ערעור ראשי מצידו. דין הוא שזכות זו לא תהא כלפי כל ענין שליבו של המערער שכנגד חפץ בו, אלא, בהיות הערעור שכנגד סמוך על שולחנו של הערעור העיקרי, ולשם הגשמת מטרותיו - שומה עליו שיהא באותו ענין בו עוסק הערעור העיקרי (בש"א 3868/90 יעד אלקטריק שירות ובצוע עבודות חשמל בע"מ נ' לה טלמכניק אלקטריק ס.א. , פ"ד מה(1) 256, 263 (1990)).
הנה כי כן, הערעור שכנגד הוא שטר ששוברו בצדו. בגדרי הערעור שכנגד ניתן להציג טיעונים רק לגבי העילות המונחות ביסודו של הערעור העיקרי. אכן, "הערעור שכנגד הוא מקבילו של הערעור שכבר הוגש והוא יכול, על-כן, להיות מופנה רק נגד העילות המונחות ביסודו של הדיון במסגרת הערעור הראשי" (בש"א 4691/91
מדינת ישראל נ' אוזן , פ"ד מה(5) 695, 700 (1991)). אמת, דרישת ההקבלה או הזיקה העניינית אינה דרישה דווקנית ומצמצמת (ראו ע"א 8644/06 רבינוביץ נ' מולכו (לא פורסם, 24.6.2007)). עם זאת, גם אין לפרוץ את גדריה יתר על המידה. אחד הביטויים הבולטים לדרישת הזיקה הוא בזהותם של בעלי-הדין. ערעור שכנגד יכול להיות מוגש רק כלפי המערער עצמו (ראו יואל זוסמן סדרי הדין האזרחי 846 (מהדורה שביעית בעריכת שלמה לוין, 1995)). אכן, "הערעור שכנגד לא יופנה כלפי בעל-דין שלא ערער בערעור העיקרי" (אורי גורן סוגיות בסדר דין אזרחי 656 (מהדורה עשירית, 2009)). ההלכה שלפיה ערעור שכנגד אינו "תופס" אלא את אותו בעל-דין שהגיש את הערעור העיקרי היא הלכה ותיקה (ראו ע"א 6245/69 פילוסוף נ' דוידזון , פ"ד כד(2) 378, 382 (1970)), ובית המשפט חזר עליה פעמים רבות (ראו ע"א 4835/07 קן טק טנ'צרס בע"מ נ' אברבנאל (לא פורסם, 1.1.2008), והאסמכתאות הרבות שם).
ומן הכלל את הפרט: בענייננו, שני נתונים מזדקרים אל העין ומכריעים את הכף לטובת קבלת הבקשה לסילוק על-הסף.
ראשית, מר נתנאל לא ערער על פסק-הדין של בית המשפט המחוזי (וגם לא היה תובע בבית המשפט קמא, אלא נתבע בתביעתו של לוטן). די בעובדה זו כדי לשמוט את הקרקע מתחת להליך הערעור שכנגד, שהרי כאמור, לא ניתן להגיש ערעור שכנגד אלא כלפי בעל-הדין שערער בערעור העיקרי. טענתו של המשיב כי מר נתנאל הוא בעל מניות בחברה-המערערת אינה הופכת אותו מניה וביה למערער בערעור העיקרי, וגם הטענה כי היה צורך לצרפו כמשיב לערעור העיקרי אינה הופכת אותו מוש א לגיטימי להגשת ערעור שכנגד.
שנית , הערעור העיקרי נסב על דחיית תביעתה של מ.א. נתנאל (ת"א 1135/08), וכמובן אין המערערת מלינה על שנדחה ערעורו של המשיב (ת"א 1080/06). המשיב מצדו משיג (בערעור שכנגד) על דחיית תביעתו-שלו (ת"א 1080/06), וכמובן אין לו תלונות על שנדחתה תביעתה של מ.א. נתנאל (ת"א 1135/08). ברור שיש תשתית עובדתית המקשרת בין התביעות שהוגשו לבית המשפט קמא, אך עדיין מדובר בשתי תביעות שונות ובית המשפט הקדיש לכל אחת מהן דיון נפרד בפסק-דינו. לאחר עיון בתיק ובטענות הצדדים באתי לכלל מסקנה כי המשיב אינו יכול להיתלות בערעור על דחיית תביעתה של המערערת בבית המשפט המחוזי (כנגד המשיב), כנקודת הזנק להגשת ערעור שכנגד על דחיית תביעתו-שלו בבית המשפט המחוזי (כנגד מר נתנאל).
בהמשך לאמור לעיל אציין כי בחירתו של המשיב לרשום בכותרת הערעור שכנגד כי מר נתנאל ומ.א. נתנאל הם "המערערים בערעור", בעוד שרק מ.א. נתנאל הגישה את הערעור העיקרי, היא בחירה מוקשה; וכן מוקשה הסעד המבוקש בסעיף 56 לערעור שכנגד – לחייב את "המשיבים שכנגד" בתשלום הסכום של 2,600,000 ₪ (הסכום שנתבע בגדרי ת"א 1080/06) – בעוד שמ.א. נתנאל כלל לא הייתה נתבעת בת"א 1080/06.
לאור המקובץ, המסקנה היא שהערעור שכנגד אינו עולה בקנה אחד עם הוראות הדין והפסיקה. משכך – דין הערעור שכנגד להימחק. המשיב יישא בשכר טרחת עורך-הדין של מבקשי הסילוק על-הסף בסכום של 4,000 ₪.
בתגובתו של המשיב צוין כי הוא פנה לצד שכנגד בעניין בקשה להארכת מועד להגשת ערעור, וכי בכוונתו להגיש בקשה כזו לבית המשפט. אם וכאשר תוגש בקשה להארכת מועד, היא תטופל כמקובל.
המזכירות מתבקשת לתייק את החלטתי-זו בתיקי השופטים. תשומת לב המזכירות לצורך בהוצאת צו סיכומים מתוקן.
