המערער היה נתון בהליכי פשיטת רגל מאז הגיש בקשה לכינוס נכסים להכרזתו כפושט רגל ב-31.8.04, וניתן בעניינו צו כינוס נכסים ביום 19.10.04, אשר במסגרתו הושתו עליו תשלומים חודשיים בסך 500 ₪, והוטל עליו להגיש לכונס הרשמי דוחו"ת חודשיים בדבר הכנסותיו והוצאותיו.

ביום 11.1.07 ביטל בית המשפט המחוזי בתל-אביב (כב' השופט ש. ברוך) את הליכי פשיטת הרגל, לבקשת הכונס הרשמי. הטעמים להחלטה זו הם כי המערער שילם, לכל היותר, רק רבע מהתשלומים החודשיים שהושתו עליו, וכן לא הגיש דוחו"ת חודשיים. בית המשפט קבע כי אין מ דובר
בסטייה קלה מצו הכינוס, אלא בהמריית צו הכינוס במשך שנים. כן ציין, כי לא הועלתה כל הצעה פרקטית לסילוק החובות; נוכח משקלם המצטבר של הטעמים האמורים, קיבל בית המשפט, כאמור, את בקשת הכנ"ר, וביטול את הליכי פשיטת הרגל בעניינו של המערער.

המערער קובל בערעורו על ביטול הליכי פשיטת הרגל בעניינו. הוא טוען, כי הגיש בקשה לבית המשפט להפחית את התשלומים החודשיים שהוטלו עליו בשל מצבו הכלכלי והרפואי הקשה, אך בקשתו נדחתה. הוא הסביר, כי במסגרת הליכי הגירושין נדרש לשלם 1,500 ₪ מזונות מתוך הכנסתו העומדת על כ-3,500 ₪, ולא נותרו בידיו כספים למחייתו. כן הסביר, כי הוא עובד בחלוקת לחם, ובשל בעיות גב קשות לא עבד במהלך מרבית חודשי שנת 2003. בטיעון בעל פה, עלה עוד כי כנגד המערער מתנהל הליך פלילי בעבירות מין, בהן הורשע בערכאה הדיונית, ונגזרו עליו מספר חודשי מאסר. ענין זה נמצא עתה בערעור, ובינתיים ביצוע גזר הדין מעוכב.

במהלך הדיון בערעור, הצהיר המערער כי הוא מבין ששגה באופן התנהלותו במסגרת הליכי פשיטת הרגל, וכי הוא נחוש בדעתו לקיים עתה במלואם את התנאים שיוטלו עליו במסגרת הליכים אלה באם יוחזרו על כנם. הוא עתר למתן הזדמנות נוספת להמשיך בהחזר חובותיו במסגרת הליכי פשיטת רגל והתחייב להגיש דיווחים במועד, תוך הבנה כי אם יפר תנאי מן התנאים האמורים, עשויים הליכי פשיטת הרגל בעניינו להתבטל.

אף שפסק דינה של הערכאה קמא ניצב על טעמים מבוססים ומבוררים, נוכח
הנסיבות האישיות המורכבות הקשורות במערער, כפי שאלה עלו בפנינו, באנו לידי מסקנה כי ראוי ליתן לו הזדמנות נוספת להמשיך ולנהל את ענייניו במסגרת הליכי פשיטת רגל, תוך הבהרה והדגשה כי מ דובר בנסיון נוסף, שהוא בבחינת לפנים משורת הדין, אשר אם חלילה יכשל, עשוי הוא להביא לביטול הליכי פשיטת הרגל.
המערער הציע במסגרת הדיון בפנינו לשלם בתוך 60 יום סך של 3,000 ש"ח על חשבון החוב; כן הציע תשלום חודשי של 350 ₪ לפרעון שוטף של החוב, והתחייב להגיש את הדיווחים לכנ"ר במועדים הנדרשים.

בנסיבות הענין, אנו מקבלים את הערעור, מבטלים את פסק דינו של בית המשפט המחוזי, ומורים על החזרת עניינו של המערער למסגרת הליכי פשיטת הרגל על פי פקודת פשיטת הרגל (נוסח חדש), תש"ם-1980. המשך תחולתם של הליכי פשיטת הרגל מותנה בכך שהמערער יקיים את התנאים הבאים: ישלם בתוך 60 יום ממועד פסק דין זה סך של 3,500 ₪ על חשבון החוב; ישלם תשלום חודשי שוטף בסך 400 ₪; ויגיש את הדוחו"ת לכונס הרשמי בדבר הכנסותיו והוצאותיו במועדים הנדרשים. באם יופר תנאי זה או אחר בידי המערער, יהיה הכנ"ר רשאי להגיש בקשה חדשה לביטול הליכי פשיטת הרגל.
הערעור מתקבל, איפוא, כאמור לעיל.
