החלטה
בפניי בקשה לתיקון הודעת הערעור בהליך שבכותרת.

הערעור נסוב על פסק-דינו של בית-המשפט המחוזי מרכז (כב' סגן הנשיא ש' שילה) מיום 25.1.2011 שעניינו קיומם ותוקפם של ייפוי כוח על פיהם נחתם הסכם מכר בין המערער ובין חלק מן המשיבים. בפסק הדין קיבל בית המשפט את התביעה נגד המשיב 4, עיזבון המנוחה איטה ברנהולף לויס ז"ל (להלן: המנוחה ) וכן קיבל את התביעה נגד משיבים 5-10 אך דחה את התביעה נגד המשיבים 1-3.

ביום 13.11.2011 נערך דיון מקדמי בפני כב' השופטת א' חיות בהליך שבכותרת, ביחד עם ע"א 1612/11 שהוגש על ידי המשיב 4 כנגד פסק הדין. בהמלצת בית המשפט הסכימו הצדדים כי הערעורים יישארו תלויים ועומדים אך בע"א 1612/11 יוחזר הדיון לבית המשפט קמא לצורך חקירת רופאה שערכה תעודת רופא בעניינה של המנוחה ובהחלטה מאותו היום נקבע כי:
"הצדדים יגישו הודעה מעדכנת בתום התהליך שתואר, ועם קבלתה יקבעו סדרי דין לשמיעת הערעורים הנותרים תלויים ועומדים וככל שיידרש יתאפשר תיקון הודעת הערעור."
ביום 23.9.2012 ניתן על ידי בית המשפט המחוזי פסק דין משלים בו הפך את הכרעתו ביחס למשיב 4 בקובעו כי כשרותה המשפטית של המנוחה נגרעה עוד לפני כריתת ההסכם.

נוכח האמור הגיש המערער בקשה לתיקון הודעת הערעור - היא הבקשה שבפניי - בה הוא עותר לתיקונה כך שיוכל לעתור בגדרה על ממצאי בית המשפט קמא בפסק הדין המשלים, בהדגישו כי פסק הדין המשלים מהווה חלק בלתי נפרד מפסק-הדין המקורי כלפיו הופנה הערעור.
בתגובה שהגישו ציינו ה משיבים 1-4 כי המערער הגיש תביעה כספית מתוקנת
בבית משפט השלום בתל-אביב-יפו ומן הסעד שהתבקש בגדרה ניתן ללמוד כי זנח את ערעורו בכל הנוגע לאכיפת ההסכם וכי הוא בחר בנתיב של תביעה כספית בגין נזקיו הנטענים. לטענתם המערער אינו יכול להחזיק במקל בשני קצותיו, ועוד הם מוסיפים כי להודעת הערעור המתוקנת שהגשתה מתבקשת צורפו משיבים לא רלבנטיים. מטעמים אלו מתנגדים המשיבים 1-4 לבקשת התיקון וטוענים כי יש לדחות את הערעור על הסף.
בתשובה מטעמו טוען המערער כי המשיבים 1-4 מנועים מלחזור בהם מהסכמתם הדיונית בדיון שהתקיים בפני כב' השופטת א' חיות ועוד הוא טוען כי בכתב התביעה המתוקן שהוגש לבית משפט השלום אין משום ויתור על ערעורו בהליך דנן, וכי הסעדים המתבקשים באותו הליך אינם עומדים בסתירה לאלו המבוקשים בגדר הערעור.

דין הבקשה להתקבל.
משניתן על ידי בית המשפט המחוזי פסק דין משלים בו הפך קביעה מרכזית בפסק דינו המקורי ושינה את הכרעתו ביחס למשיב 4 אכן הודעת הערעור במתכונתה המקורית אינה משקפת את מלוא טענות המערער כלפי פסק הדין הסופי ודומה כי גם המשיבים 1-4 אינם חולקים על כך. טענתם המרכזית של אלו היא כי נוכח תביעה כספית מתוקנת שהגיש המערער בבית משפט השלום יש לקבוע כי המערער זנח את טענותיו באפיק הערעור שבכאן, ועל כן יש להורות על דחייתו על הסף.
ואולם, למערער נתונה הזכות להשיג על פסק דינו הסופי של בית המשפט המחוזי (ראו והשוו: תקנות 455-456 לתקנות סדר הדין האזרחי, תשמ"ד-1984 (להלן: תקנות סדר הדין האזרחי ); ע"א 3124/00 בצלאל נ' נתיבי איילון בע"מ (לא פורסם, 20.2.2005)), והדברים אף עולים בקנה אחד עם החלטת כב' השופטת א' חיות מיום 13.11.2011 אשר ניתנה בהמשך להסכמת הצדדים בדיון. טענות המשיבים 1-4 בדבר היחס בין כתב התביעה המתוקן שהוגש בבית משפט השלום ובין כתב הערעור המתוקן שהגשתו מתבקשת כעת - שהן בעיקרו של דבר טענות מסוג מניעות והשתק - אין מקומן בגדר הבקשה שבפניי, וזאת מבלי להביע כל עמדה לגופם של דברים או ביחס לפורום השיפוטי (בבית משפט זה או בבית משפט השלום) ולמסגרת הדיונית הראויה להעלאתן. מכל מקום, וודאי שטענות אלו אינן מצדיקות לנקוט בסעד הקיצוני והחריג של דחיית הערעור על הסף, כבקשת המשיבים 1-4. בשולי הדברים יצויין כי בדין צירף המערער כמשיבים לערעור את כל הצדדים להליך שהתנהל בבית המשפט קמא (ראו תקנה 424 לתקנות סדר הדין האזרחי).
אשר על כן, ומשהמשיבים 1-4 לא העלו כל טענה לגבי נוסח הודעת הערעור המתוקנת שצורפה לבקשה, אני נעתרת לבקשה לתיקון הודעת הערעור ומורה כי הודעת הערעור המתוקנת תתקבל לתיק בית המשפט. המערער ימציא שלושה עותקים של הודעת הערעור המתוקנת למזכירות בית המשפט, וזו תתייקה, כמו גם את החלטתי זו, בתיקי השופטים.
בנסיבות העניין אין צו להוצאות.
