בקשה לפטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת.

ההליך נסוב על פסק דינו של בית המשפט המחוזי בנצרת, בו נתקבלה חלקית תובענה לפסק דין הצהרתי שהגיש המערער ונקבע כי יש להורות על ביטול הסכם בדבר חלוקה פנימית של מים בין חקלאי כפר גוש חלב. בבקשה לפניי טוען המערער כי הגם שהינו מוותיקי החקלאים בכפר גוש חלב, הוא נקלע לאחרונה למצב כספי קשה למדי והוא מתקיים כיום מקצבת הבטחת הכנסה. לטענתו, אין לו כל הכנסה מלבד קצבה זאת והוא נדרש להוצאות גבוהות בשל מצבו הרפואי של בנו. משיבות 4 -7 טוענות בתגובה כי המערער הצהיר בפני בית המשפט המחוזי כי בבעלותו כ – 112.5 דונם חקלאיים מאדמות הכפר גוש חלב וחזקה על מי שבהחזקתו שטח כה גדול כי אינו אדם חסר יכולת כלכלית. לתגובתן צירפו משיבות 4 – 7 נסחי טאבו המצביעים על היות המערער שום כבעלים של מספר חלקות בגוש חלב. יתר מהמשיבים מתנגדים גם הם לבקשה לפטור מאגרה וערבון, מטעמים דומים. המערער טוען בתגובה כי אין בבעלותו כל רכוש למעט החלקות נשוא הערעור, אשר רק חלק מהן מצויות בבעלותו והן מעוקלות במסגרת תיקי הוצאה לפועל.

לאחר עיון בטענות בעלי הדין ובחומר המצוי בתיק באתי לכלל מסקנה כי אין להיעתר לבקשה. הבקשה אינה מניחה תשתית עובדתית מספקת כדי להעיד על חוסר יכולת כלכלית של המערער לשלם את האגרה ולהפקיד את הערבון. נטל ההוכחה בעניין זה מוטל על המערער. על מנת לעמוד בו, עליו לפרוש תמונה מלאה ועדכנית על מצבו הכלכלי. אמנם, המערער הציג תיעוד לפיו קיבל קצבת הבטחת הכנסה מן המוסד ל ביטוח לאומי בשנת 2007. "קבלת גמלה לפי חוק הבטחת הכנסה, התשמ"א-1980 בעת הגשת הבקשה לפטור מאגרה, תשמש ראיה לכאורה לחוסר יכולתו של המבקש לשלם את האגרה" (תקנה 14(ה) לתקנות בתי המשפט (אגרות), התשס"ז-2007). אולם בנסיבות העניין, כאשר המשיבים הצביעו על נכסים של המערער ואף המערער עצמו הצהיר בפני בית המשפט קמא על נכסים בהיקף של עשרות דונם חקלאיים, לרבות קרקעות שנתקבלו בירושה, לא ניתן להסתפק בקבלת הגמלה כבסיס למתן פטור מאגרה. לא כל שכן אין בכך לבסס פטור מהפקדת ערבון. בקשת המערער היא כללית ובלתי מפורטת. המערער לא מסר נתונים על רכושו והכנסותיו. הוא אף נמנע מלצרף תיעוד כלשהו בדבר הכנסותיו מחקלאות, כמו גם חשבונות שוטפים שהיו עשויים לשפוך אור על מצבו הכלכלי. בבקשה לא הובהר מניין משגת ידו של המערער לממן את ייצוגו המשפטי בהליך שבכותרת ובהליכים בפני בית המשפט קמא. כן לא הובהר מדוע אין באפשרות המערער להסתייע בקרוביו לשם הפקדת ערבון. נוכח החסר בתשתית הראייתית, לא ניתן לפטור את המערער מתשלום אגרה והפקדת ערבון. יחד עם זאת, בהתחשב בזכאותו של המערער לגמלת הבטחת הכנסה, תופחת האגרה לסך של 1,000 ₪. אשר לערבון, בשים לב לכלל נסיבות העניין, ובכלל זה מספר המשיבים, מעמדם היחסי של הצדדים; פסיקת ההוצאות בבית המשפט קמא והנתונים החלקיים שהובאו בדבר מצבו הכלכלי של המערער, יועמד הערבון על סך של 10,000 ₪. האגרה תשולם והערבון יופקד תוך 21 ימים מעת המצאת החלטה זו (וימי הפגרה יבואו במניין), ולא – יימחק ההליך או יידחה, לפי העניין, ללא צורך במתן הודעה נוספת.
