פסק-דין

לבית המשפט המחוזי הוגשה תביעה של המערערת, שהיתה פגה, שטענה כי המערערים התרשלו בביצוע טיפול רפואי בה, ובשל כך לקתה בעיוורון. בית המשפט המחוזי קבע על יסוד הראיות שהוצגו לו כי מדובר בפגה אשר נולדה בשבוע ה-25 להריון של אמה במשקל של 520 גרם ובשל משקלה הזעיר וגיל ההריון היא היתה בסיכון גבוה, סיכון שלמרבה הצער התממש, ללקות במחלת רופ. המערערת היתה במעקב הדוק והסיכון שהתממש התגלה מיד עם התממשותו. רופאים המטפלים, כך קבע בית המשפט עשו כל שביכולתם, בידיעתם, ובידיעת העולם הרפואי להביא לריפויה של המערערת, אך המאמצים כשלו ומצב עיניה של המערערת התדרדר ובסופו של דבר היא התעוורה. לא נמצאה התרשלות מצד המטפלים. בית המשפט ניתח את עדויות המומחים שנשמעו בפניו והגיע למסקנות אשר הגיע תוך שקיבל את עדויות מומחי הנתבעים.

הערעור שלפנינו לא היה אלא בגדר ניסיון להניענו להתערב בממצאי עובדה שקבעה הערכאה הראשונה, כשלכל טענה וטענה ישנה תשובה משכנעת בפסק הדין נשוא הערעור. הדיון בערכאה הדיונית אינו בגדר "חזרה כללית" להליך הערעור, ובדרך כלל, באין סיבה לסטות מכך העובדות נקבעות בערכאה הדיונית. כך גם בענייננו.
3.
עיוורונה של המערערת אינו תוצאה של רשלנות של הנתבעים או מי מהם ואנו דוחים את הערעור. המערערת תשלם למשיבים שכר טרחת עורך דין בסך 10,000 ש"ח.
