בקשה פטור מעירבון
החלטה

בהליך שבכותרת (ע"א 4832/08) נקבע ערבון בסך 40,000 ₪ ולפני בקשה לפטור מהפקדתו. זאת, נוכח הפקדת 15,000 ₪ במסגרת רע"א 3813/08, הליך שהוגש למען הזהירות והמתייחס לאותה ההחלטה. משיבים שהגיבו לבקשה, התנגדו לה.

לאחר עיון בחומר שלפני ובטענות בעלי הדין שנדרשו לנדון, מסקנתי היא כי יש להפקיד ערבון בהליך זה, אם כי בסכום מופחת. אנמק את עמדתי: כעולה מן התיקים, הוגשו שני הליכים בגין אותה החלטה של בית המשפט קמא, בקשת רשות ערעור וכן ערעור אזרחי. השאלה איזה מן ההליכים מהווה הדרך הראויה להשיג על הנדון לא הוכרעה, יש בה פנים לכאן ולכאן ושני ההליכים ידונו לפני הרכב (ראו החלטת כב' השופט ח' מלצר מיום 28.7.08 ובמיוחד סעיף 24 לה). ממילא אין המ דובר
בשני הליכים נפרדים, בהן נדונה חזית מחלוקת שונה, והמצדיקים הפקדת ערבון נפרדת, אלא בעניין אחד ומאוחד. עם זאת, עדיין אין בידי לקבל את הטענה לפיה אין להפקיד במסגרת הערעור ערבון כל עיקר. זאת, שכן סך הערבון שהופקד במסגרת רע"א 3813/08 היה מלכתחילה על הצד הנמוך, ומשעה שמ דובר
בדיון גם במסגרת הדיונית של ערעור אזרחי, יש להתאים את שיעור הערבון למקובל בכגון דא. אשר על כן, נקבע בזאת כי הערבון המאוחד בשני התיקים יעמוד על 40,000 ₪. סך 15,000 ₪ שהופקדו ברע"א 3813/08 ישמשו לצורך זה, ובנוסף יפקידו המבקשים-המערערים סך של 25,000 ₪ והכל לא יאוחר מיום 1.10.08, שאם לא כן, ידחה הערעור בלא התראה נוספת. אין צו להוצאות בבקשה זו. החלטה זו תועבר לצדדים, ללא דיחוי, באמצעות הפקסימיליה.
