בפניי בקשה לפטור מהפקדת עירבון ולחלופין להפחתתו לסך של 500 ש"ח, בהליך שבכותרת המופנה כלפי החלטת כב' השופטת ע' וינברג-נוטוביץ מבית המשפט המחוזי מרכז-לוד, אשר דחתה בקשה לפסול עצמה מלשבת בדין בהליך פשיטת רגל המתנהל בעניינה של המבקשת.
נוכח הליך פשיטת הרגל המתנהל בעניינה של המבקשת, העובדה שהיא הוכרזה כ"מוגבלת חמורה", ותיקי הוצאה לפועל המתנהלים בעניינה, הנחתי היא כי מצבה הכלכלי אינו מן המשופרים.
ואולם, הצדק עם המשיבים - המתנגדים לבקשה - כי המערערת לא פרשה בבקשתה תשתית עובדתית מספקת להוכחת מצבה הכספי. כך לא פירטה המערערת את נכסיה (ולטענת המשיב 1 יש לה זכויות בנכס מקרקעין, אם כי על יסוד נספח שצורף לתשובה שהגישה המבקשת נראה כי על הנכס מוטלת משכנתה) וכן את הוצאותיה השוטפות ביחס להכנסותיה. בנוסף המערערת לא צירפה לבקשה תדפיס של חשבון הבנק שלה, כי אם רק אישור על יתרת החובה בחשבונה נכון ליום 9.9.2013 (כחודשיים לפני הגשת הבקשה). כמו כן המערערת ציינה כי "עשתה מאמץ גדול" לשלם את האגרה בגין ההליך, אך לא הבהירה כיצד גייסה את הסכום ומדוע אין באפשרותה לעשות מאמץ דומה לגייס סכום נוסף כעירבון. בנוסף טענת המערערת לפיה אין באפשרותה לגייס את סכום העירבון בעזרת סביבתה הקרובה נטענה בעלמא ולא פורטה ולא הוכחה כדבעי.
עוד יצוין כי המערערת הגישה תשובה לתגובות המשיבים, אך גם בתשובתה לא נתנה מענה מלא לחסר שבבקשתה ולא צירפה את מלוא האסמכתאות הנדרשות להוכחת מצבה הכספי.
לכך יש להוסיף כי סבורני כי גם סיכויי ההליך, כשלעצמם, אינם מצדיקים לפטור את המערערת באופן מלא מהפקדת עירבון.
יחד עם זאת ונוכח המצב הכלכלי הנטען, אשר כאמור נראה כי אינו מן המשופרים, יופחת העירבון ויועמד על סך של 3,000 ש"ח.
עירבון בשיעור האמור יופקד בתוך עשרה ימים ממועד המצאת ההחלטה לידי המערערת, ולא - יירשם ההליך לדחיה, ללא הודעה נוספת.
ההחלטה תומצא למערערת ללא דיחוי, באמצעות הפקסימיליה.
