החלטה
המשיב 1 בע"א 7016/10 (להלן: נגר ) הניח בפנינו מספר בקשות, ולאחר שעיינו בתגובות הצדדים אנו מורים כלהלן:
1.הבקשה למתן פסיקתא לעניין עיכוב יציאה מהארץ :
הבקשה התייתרה, ושמא הייתה מיותרת מלכתחילה, מאחר שעו"ד גרינברג, המנהל המיוחד, פנה בעניין זה ל בית המשפט המחוזי ובוטל צו עיכוב היציאה כנגד נגר. ככל שהתעוררו או יתעוררו בעניין זה בעיות הקשורות במספר תעודת הזהות או במספר ההליך, ייכבד נגר ויפנה ל בית המשפט
המחוזי בתיק פשיטת הרגל.
2.הבקשה לתיקון פרוטוקול :

אין חולק כי בעמ' 4 שורות 8-1 הדובר הוא עו"ד גרינברג ולא עו"ד גרינפלד. אנו נעתרים לתיקון כמבוקש.

בבקשה נטען כי מהפרוטוקול הושמטו דברי כב' השופטת חיות, אשר לטענת נגר, אמרה "כי ההרכב שם לא התכוון למה שנכתב בפסה"ד וכי בפסה"ד ברע"א 3230/09 נשלח רמז לביהמ"ש המחוזי הנכבד, אשר לא הבינו".
הבקשה נדחית. לא נאמר כי ההרכב ברע"א 3230/09 לא התכוון למה שנכתב בפסק הדין שם.
למיטב זכרוננו, במהלך הדיון נאמר
- על ידי השופט עמית או על ידי השופטת חיות או שניהם - כי כוונת ההסכם ברע"א 3230/09 הייתה כי לנושים אלון יישאר סכום של 1.4 מליון ₪, כך שברי כי לא הייתה כוונה ששכר הטרחה יילקח מסכום זה, כפי שנפסק על ידי בית המשפט
המחוזי. לעניין זה, ראו בעמ' 3 לפרוטוקול, שם מצטט השופט עמית מתוך הפרוטוקול בדיון שהתנהל ברע"א 3230/09, תוך
הפנייה לדברי השופטת חיות שם כי על נגר להציע הצעה שתהא מקובלת על אלון.
3.הבקשה לביטול ההסכם בע"א 7016/10.
הבקשה נדחית.
נגר היה מיוצג בעת הדיון על ידי עו"ד גרינפלד (שמאז הודיע ל בית המשפט כי הפסיק לייצגו). חזקה על בא כוחו דאז של נגר כי הסביר לו את הסיכונים העומדים בפניו
לאחר שהפקיד את הסכום
מושא פסק הדין ברע"א 3230/09 תוך התניות שונות. הדבר עלול היה לגרום לכך, שסכום החוב שאושר בשעתו על ידי המנהל המיוחד יחזור ויעמוד על כנו, והדברים באים לידי ביטוי בפרוטוקול בעמ' 2 שורות 14 – 24.
מכל מקום, ככל שנגר סבור כי ההסכם "נכפה עליו", או שההסכם הופר על ידי אלון או על ידי המנהל המיוחד – ייכבד ויגיש תביעה נפרדת.
למעלה מן הצורך נציין כי הצדדים, לרבות נגר, כבר פעלו על פי ההסכם. הכספים הועברו מעו"ד גרינברג לאלון, ואילו נגר, אשר ביד אחת עותר לביטול ההסכם, כבר הזדרז ביד השניה לפעול על פי ההסכם ולבקש (ולקבל) ביטול של צו עיכוב היציאה מן הארץ.
4.הבקשה "למחיקת רישום החלטה אשר ניתנה בערעור אזרחי 7016/10 מבר"ע 2599/10".
הבקשה נדחית.
משהגיעו הצדדים להסכם, מצאנו לנכון בפסק דיננו מיום 23.10.2011 לדחות את בקשת הרשות לערער שהוגשה על ידי אלון (רע"א 2599/10), שכן לא ניתן להפריד בין הדבקים ויש לראות את ההליכים כמקשה אחת. בכך יש גם משום מענה לבקשת אלון מיום 10.11.2011. התייחס לכך הכונ"ר בתגובתו בציינו "ברי כי פסק הדין מתייחס לשני ההליכים, וביטולו משמעו ביטול פסק הדין שניתן אף ברע"א 2599/10 על כל המשתמע מכך".
לפני נעילת שער הובאה בפנינו תגובת נגר לתשובת המשיבים. התגובה כוללת ברובה התנצחות והתנגחות אישית עם עו"ד גרינברג ואין בה כדי לשנות מהחלטתנו זו.
לאור התוצאה אליה הגענו, נגר ישא בהוצאות המנהל המיוחד, אלון והכונ"ר בסך 3,500 ₪ כל אחד.
