המערער הוזמן כדין לדיון של היום, כפי העולה מבקשה מיום 6.2.2013 הנושאת את הכותרת "הבהרה" שהגיש הוא עצמו. בעקבות אותה הבהרה שהגיש, הודע לו על ידי מזכירות בית המשפט כי עליו להתייצב לדיון. בכל זאת בחר המערער שלא להתייצב לדיון.
בהינתן התנהלותו זו ובהינתן כי נימוקי הערעור אינם מגלים על פני הדברים סיכוי של ממש להצלחתו, אנו מורים על מחיקת הערעור בהתאם לתקנה 450 לתקנות סדר הדין האזרחי, התשמ"ד-1984 בשילוב עם תקנה 2 לתקנות פשיטת הרגל, התשמ"ה-1985.
המשיבים נטרחו והתייצבו לדיון, ומעורכי הדין כהנא ודורה שמענו כי הגיעו מרחוק. בנסיבות אלה יש הצדקה לפסיקת הוצאות לזכותם. המערער הפקיד ערבון בסך 2,000 ש"ח. בגין ישיבת היום ישולם סך של 1,000 ש"ח לכל אחד מהמשיבים 2-1.
