בקשה לחיוב המשיבה 6 בהגשת סיכומים
החלטה
המשיבה 6 ציינה בתגובתה כי בחרה להשלים עם התוצאות האופרטיביות של פסק הדין (בציינה כי בעיקרו של דבר עניינן במערכת היחסים שבין המערערים למשיב 1), ומשכך מבקשת היא שלא ליטול חלק בהליך הערעור.
דומני כי בנסיבות אלו אין באמור בטענות המערערים כדי להקים עילה לחייב את המשיבה 6 להגיש סיכומים מטעמה (ולהתייצב לדיון). יצוין בהקשר זה כי טענת המערערים לפיה לתוצאות ההליך תהא השפעה על המשיבה 6 הינה טענה שעל המשיבה 6 לקחת בחשבון, שהרי מובן כי פסק הדין שיינתן בערכאה זו יחייב אותה, אך אין בה כדי לחייבה להעלות טענות מטעמה. גם בעובדה שהמשיבה 6 נטלה חלק בהליכים שהתנהלו בבית המשפט קמא אין כדי להצדיק לחייבה לשוב ולהביע עמדתה, משהיא מוותרת מיוזמתה על זכותה זו, תוך נטילת הסיכון הכרוך בכך.
אשר על כן החלטתי מיום 26.8.2013 עומדת בעינה.
