בקשה להפחתת סכום ערבון
החלטה
כפי שטוען בצדק המשיב, הבקשה להפחתת סכום העירבון אינה מציגה תמונה מלאה באשר למצבה הכלכלי של המערערת ואינה נתמכת בתיעוד מלא. ברי כי כאשר מדובר בחברה בע"מ, לא ניתן להסתפק בטענה כללית לגבי קיומם של קשיים כלכליים, ובמסמך אחד בדמות תדפיסי חשבון בנק המצביעים על יתרת חובה. זאת ועוד, המערערת עצמה מציינת כי בקרוב תידרש לגייס סכומים ניכרים לצורך פעילותה, וכי סכום זה "ייגבה מבעלי המניות". המערערת לא הסבירה מדוע לא ניתן לגייס גם את סכום העירבון באותה הדרך (או לחלופין, באמצעות נטילת הלוואה מן הבנק). מעבר לכך אציין כי בהחלטת כבוד השופט נ' הנדל מיום 12.12.2010 נדחתה בקשת המערערת לעיכוב ביצוע פסק-הדין של בית המשפט המחוזי, תוך שצוין בין היתר כי סיכויי הערעור אינם נוטים לטובת קבלת הבקשה.
לאור המקובץ, ובשים לב לסכום ההוצאות שנפסק בבית המשפט המחוזי, אין מקום להפחתת סכום הערבון. על כן, העירבון יופקד תוך 14 ימים מעת המצאת החלטה זו, שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
