החלטה
ההליך שבכותרת הוא ערעור על פסק-דין של בית המשפט המחוזי שעסק בשאלת חילוט רכושם של נאשמים – הם המשיבים 6-2 (להלן: הנאשמים ). הנאשמים הורשעו בעבירות שונות ובהן סחר בבני-אדם לצרכי זנות ואיסור הלבנת הון. המערערים בהליך שבכותרת משיגים על פסק-הדין, זאת לאחר שבבית המשפט קמא השמיעו את קולם בהיותם טוענים לזכות ברכוש. האם סיווגו הנכון של ההליך הוא ערעור פלילי, או שמא ערעור אזרחי – זו השאלה המונחת לפניי.
לאחר עיון בטענות הצדדים מקובלת עליי עמדתה של המדינה כי יש לסווג את ההליך כ ערעור אזרחי .
סעיף 23 לחוק איסור הלבנת הון, התש"ס-2000 מורה כי על חילוט רכוש לפי חוק זה יחולו, בשינויים המחויבים, הוראות סעיפים 36ג עד 36י לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973. סעיף 36ה לפקודת הסמים המסוכנים קובע כי ערעור של מי שטוען לזכות ברכוש שחולט בהליך פלילי יהיה "בדרך שמערערים על החלטה בענין אזרחי". לשון החוק ברורה אפוא: יש להגיש ולברר את השגותיהם של המערערים – שאינם הנאשמים – בדרך של ערעור אזרחי. אדגיש כי לא שוכנעתי מטענותיהם של המערערים בדבר "שיקול דעת רחב" לקבוע שההליך יסווג כערעור פלילי, וכי הוראת סעיף 36ה סיפא לפקודת הסמים המסוכנים, כמו-גם ההחלטות הנזכרות בתגובת המערערים מיום 28.12.2012, עוסקות בנסיבות שונות ואין ללמוד מהן גזירה שווה לענייננו (ראו גם ע"א 7025/12 קמור רכב נ' מדינת ישראל (טרם פורסם, 8.11.2012)).
אשר על כן מתבקשת המזכירות לשנות את סיווגו של ההליך לערעור אזרחי.
המערערים ישלמו תוך 14 ימים אגרה בשיעור הקבוע בדין, ויפקידו עירבון בסך של 20,000 ₪ תוך אותו מועד. בהיעדר תשלום והפקדה יימחק ההליך או יירשם לדחייה, לפי העניין, ללא הודעה נוספת.
לגבי הבקשה לאיחוד דיון – זו תועבר ליומן בית המשפט לאחר השלמת הליכי הרישום כאמור לעיל.
