החלטה
המבקש עתר לעיכוב ביצוע כל ההליכים המשפטיים כנגדו, לרבות הליכי הוצאה לפועל והליכי גבייה עד למתן החלטה בערעור שהוגש על ידו על החלטת בית המשפט המחוזי בבאר שבע מיום 12.10.09 (כב' השופט י' צלקובניק) בתיק פש"ר 9091/03, בגדרה דחה בית המשפט את בקשתו של המבקש לביטול החלטתו מיום 18.10.06 לפיה בוטלו הליכי הכינוס.
הלכה פסוקה היא כי מי שאינו עומד בתשלומים החודשיים שהושתו עליו נחשב כמי שמנצל לרעה את הליכי פשיטת הרגל. בהתחשב בכך שהמבקש לא עמד משך תקופה ארוכה בתשלומים לנושים - ואף מבלי להידרש לטענות המבקש לגבי קביעתו של בית משפט קמא כי החובות לא נוצרו בתום לב – נראה אפוא כי סיכויי הערעור נמוכים.
לכך יש להוסיף כי מאזן הנוחות מטה את הכף נגד המבקש, לא סגי באמירה כללית כי אי מתן הסעד יגרום למבקש נזק כבד בשל המשך נקיטת הליכי הוצאה לפועל נגדו, מה עוד שמתשובת המשיב עולה כי גם אם יתקבל הערעור והמבקש יוחזר להליכי פשיטת רגל, לא יהא בכך כדי למנוע מכירת הבית בכפוף למתן דיור חלוף (אציין כי המבקש לא טרח לציין בבקשתו את הליכי מימוש הבית במסגרת תיק פשיטת הרגל של רעייתו). מכל מקום, קיומם של הליכי הוצאה לפועל כנגד חייב אינם בגדר נזק בלתי הפיך, וככל שיינקטו הליכי הוצאה לפועל כנגד המבקש עד לדיון בערעור, פתוחה בפניו הדרך להתגונן במסגרת חוק ההוצאה לפועל לרבות בקשה לחקירת יכולת בפני ראש ההוצאה לפועל (ראו, לדוגמה,
ע"א 9847/08 חאלד שאעיב נ' כונס הנכסים הרשמי (לא פורסם, 19.3.09) פסקה 5 והאסמכתאות שם; ע"א 2763/09 לוי נ' כונס הנכסים הרשמי (לא פורסם, 29.7.09) פסקה 12 והאסמכתאות שם).
