לפניי בקשה לעיון בתיק בית המשפט. כב' הנשיאה ד' ביניש, בהחלטתה מיום 2.7.2008, הסמיכה אותי לדון בבקשה. המבקש הינו עורך-דין. לדבריו, הוא מטפל בתביעת רשלנות רפואית מטעמו של קטין הסובל משיתוק מוחין, אותה הגיש נגד מדינת ישראל. התביעה המתבררת בימים אלו בבית המשפט המחוזי בחיפה. לדברי המבקש, במסגרת אותה תביעה הגישה הנתבעת, היא המשיבה בהליך שבכותרת, חוות דעת לעניין הרשלנות הרפואית והקשר הסיבתי, על ידי מומחים רפואיים אשר חיוו דעתם גם בתיק דנן. הבקשה היא לעיין בחוות דעת המומחים הרפואיים, בפרוטוקול חקירת המומחים, בספרות הרפואית אליה התייחסו, בפרוטוקול חקירת אימו של המערער ובכמה מסמכים רפואיים של האם. מן הבקשה עולה כי מטרת העיון הינה לעמת את המומחים הרפואיים עם מסמכים אלה, במסגרת חקירתם הנגדית בתביעה בה מייצג המבקש בבית המשפט המחוזי בחיפה.

בא-כוח המערער הודיע (ביום 7.4.2008) על התנגדותו לעיון המבוקש. נטען כי המבקש אינו קשור בדרך כלשהי להליכים המתנהלים בתיק זה. בנוסף הודגש כי התיק מכיל מידע רב ורגיש אודות בריאותם של המערער ואמו. נטען כי מטעמים של צנעת הפרט יש למנוע מצב בו מידע זה ייחשף בפני זרים ללא טעם ראוי. כן צוין כי המערער חסוי והדעת נותנת שיש למנוע מסירת מידע על ענייניו לזולת. המשיבה הודיעה כי היא מותירה את ההחלטה בבקשת העיון לשיקול דעת בית המשפט. יחד עם זאת היא סברה כי מטעמי יעילות ומניעת חשש כי מסמכים המצויים בתיק בית המשפט יאבדו בשוגג, יש להורות כי העיון בתיק יתבצע רק בתום הליכי הערעור.

בקשה ל עיון בתיקי בית המשפט נבחנת לאורן של תקנות בתי המשפט ובתי הדין לעבודה (עיון בתיקי בית משפט), התשס"ג–2003 (להלן:
התקנות ). סעיף 4(א) לתקנות קובע כי "כל אדם רשאי לבקש מבית המשפט לעיין בתיק בית המשפט ובלבד שהעיון בו אינו אסור על-פי דין". תקנה 4(ד) לתקנות מוסיפה ומונה את השיקולים שעל בית המשפט לשקול, בקובעה כי "בבואו לשקול בקשת עיון, ייתן בית המשפט את דעתו, בין השאר, לעניינו בתיק של המבקש, לעניינם של בעלי הדין ושל מי שעלול להיפגע כתוצאה מהעיון, וכן לסבירות הקצאת המשאבים הנדרשת לשם היענות לבקשה". היקפו של העיון מוסדר בתקנה 4(ו) לתקנות, לפיה "החליט בית המשפט להתיר את העיון, רשאי הוא לקבוע בהחלטתו כל תנאי או הסדר הדרושים כדי לאזן בין הצורך בעיון לבין הפגיעה אשר עלולה להיגרם לבעלי הדין או לצד שלישי בשל העיון, לרבות השמטת פרטים, הגבלת מספר המעיינים ונקיטת אמצעים למניעת זיהוים של בעלי דין או אנשים אחרים; בית המשפט רשאי להגביל את היקף העיון ולהתנותו בתנאים, אם ראה כי הקצאת המשאבים הנדרשת מחייבת זאת".

התקנות מתוות, איפוא, מסלול תלת-שלבי לבחינה של בקשה לעיון ( ראו,
ע"א 8849/01 סבוב נ' פז-גל חברה לשווק בע"מ ואח' פ"ד, נט(5) 385). בשלב ראשון
נבחנת השאלה האם יש איסור בדין לעיון בחומר המבוקש. ככל שהתשובה לשאלה זו היא בשלילה, נבחנת בשלב שני השאלה האם העיון מוצדק הוא. בשלב הבחינה השני, נקודת המוצא היא שלכל אדם זכות עיון. זכות זו נגזרת מעיקרון פומביות הדיון (ראו, בג"ץ 1447/03 תובל ש"י נ' פנים להתחדשות יהודית לישראל (לא פורסם; 1.11.2004)). מאחר שנקודת המוצא היא לאפשר את העיון, על בעל הדין המתנגד לעיון הנטל לשכנע כי אין להתירו. "הכלל הוא, איפוא, שיש לאפשר עיון במסמכים המצויים בתיקי בית-המשפט, ואף את פרסומם, אלא אם קיימת הוראה תחיקתית או טעם כבד-משקל הנגזר ממנה, המצדיקים, באיזון כולל, את מניעת העיון או הפרסום" (ע"א 4825/97 גהל נ'
פקיד השומה למפעלים גדולים , פ"ד נה(2) 433, 437). "מעקרון פומביות הדיון וחופש המידע נובע שבהיעדר טעם מיוחד המונע זאת רשאי כל אדם לעיין בתיקי בית-המשפט" (בג"ץ 9474/00 גל נ' ראש עיריית חיפה,
פ"ד נט(3) 714). עם זאת, כמו כל זכות, גם זכות העיון אינה מוחלטת ולעתים יש מקום להגבילה בשל אינטרסים נוגדים. בין האינטרסים העשויים להצדיק מניעת עיון מצויה הזכות לפרטיות של בעלי הדין, הגנה על סודות מסחריים ועוד. ההכרעה בשאלת העיון מבוססת על איזון בין האינטרסים והזכויות של כל הנוגעים בדבר – מבקש העיון, בעלי הדין, והאינטרס הציבורי. בשלב השלישי , בהנחה ויש הצדקה עקרונית לאפשר את העיון, נבחנת השאלה כיצד ניתן להגשים את מטרת העיון תוך פגיעה מידתית ככל האפשר בזכויות ובאינטרסים של בעלי הדין שהתנגדו לעיון. במסגרת זו נבחנת האפשרות להגביל את היקף העיון או להתנותו בתנאים, בשים לב בין היתר לסבירות הקצאת המשאבים של בית המשפט (ראו, ע"א 3914/91 לחאם נ' פקיד השומה נצרת (לא פורסם; 1.5.2006)).

אפתח בשלב הראשון, בו נבחן קיום איסור בדין לעיון בחומר המבוקש. מעיקרי הטיעון שהגיש המבקש (ביום 9.9.2008) עלה לכאורה כי בית המשפט המחוזי הוציא צו איסור פרסום על פרטי התיק (סעיף 6 לעיקרי הטיעון), וזאת לאחר שניתן פסק הדין בבית המשפט המחוזי, פסק דין אשר פורסם במלואו בכמה מאגרים משפטיים, ללא השמטת פרטים מזהים כלשהם. יחד עם זאת, אף אחד מבעלי הדין עצמם לא ציין כי הוצא צו איסור פרסום בשלב כלשהו של הדיונים. יתרה מכך, בירור במזכירות בית המשפט המחוזי בחיפה העלה כי לא הוצא צו כאמור. משכך, ומשלא נטען בפני על ידי מי מבעלי הדין כי קיים חיסיון על מסמכים כלשהם בהם מבוקש העיון, אין לשלול את העיון בשל קיום איסור בדין לעיין בחומר המבוקש.

בשלב הבא יש לבחון האם קיימת הצדקה לאסור את העיון. נקודת המוצא היא כאמור התרת העיון. התנגדות לעיון נשקלת בשים לב לתכלית העיון ולמידת הפגיעה בבעלי הדין. בענייננו, מטרת העיון של המבקש היא ללמוד את חוות הדעת של המומחים הרפואיים, שכן הוא מטפל בתיק דומה בו ניתנו חוות דעת על ידי אותם מומחים. אמנם, כפי שציין בא-כוח המערער, המבקש אינו קשור בדרך כלשהי להליך המתנהל בתיק זה. אך לטעמי האינטרס אותו הציג הוא אינטרס לגיטימי, שעשוי להקים "טעם ראוי" לעיון בתיק בית משפט. אשר לאינטרס המערער, אין ספק שהמסמכים בהם מתבקש העיון מכילים התייחסות לעניינים שבצנעת הפרט. יש במתן זכות לעיין בהם כדי לפגוע בפרטיותם של המערער ואמו. יחד עם זאת, יש לזכור כי התביעה כולה נשמעה בדלתיים פתוחות ופרטיה נחשפו לציבור עם פרסום פסק הדין במאגרי המידע המשפטיים. פסק הדין שפורסם, המשתרע על 56 עמודים, הוא מפורט מאוד, וכולל את מרבית הנתונים הרפואיים המוזכרים במסמכים בהם התבקש עיון.

על רקע דברים אלה ניתן היה לצפות כי המערער יבהיר כיצד מתן זכות עיון למבקש תביא לפגיעה בצנעת הפרט, מעבר לפגיעה שנגרמה ממילא בשל הדיון בדלתיים פתוחות ופרסום פסק הדין. במצב הדברים שתואר, לא ניתן להסתפק בטענה כללית של צנעת הפרט. יש לזכור כי "בהיעדר הסבר קונקרטי באשר לפגיעה העלולה להיגרם כתוצאה מחשיפתם של מסמכים ספציפיים, יש לאפשר את העיון" (דברי הנשיא א' ברק בבג"צ 10076/02 ד"ר רוזנבאום נ' נציב שירות בתי הסוהר (לא פורסם, 22.8.2005). והנה, בא-כוח המערער כלל לא הגיש עמדה מפורטת בקשר לבקשה (חרף החלטתי מיום 4.9.2008). הוא לא הבהיר את טיבה הקונקרטי של הפגיעה ואת היקפה. לפיכך, אין מנוס מן הקביעה כי לא הורם הנטל, מצד המערער, לשכנע כי העיון בתיק יפגע בו באופן המצדיק מניעת העיון.

בשלב שלישי יש לבחון האם יש מקום להגביל את היקף העיון או להתנותו בתנאים, כדי לצמצם עד כמה שניתן את הפגיעה בזכויות ובאינטרסים של בעלי הדין המתנגדים לעיון. המבקש הודיע כי לא יתנגד כי מתוך המסמכים יושחרו בטוש כהה שמות המערער ואמו וכל פרט מזהה אחר אודותיהם. כן התחייב המבקש כי לא יעשה במסמכים אלו שי מוש
זולת לצורך חקירת המומחים הרפואיים. לטעמי, אכן ראוי להגביל את זכות העיון בכך שיוסרו מן המסמכים פרטים מזהים של המערער ואמו. מבחינה מעשית, נראה כי הדרך לעשות כן הינה לאפשר למבקש לעיין בתיק ולצלם את המסמכים שהתבקשו, ולהשחיר את הפרטים המזהים המופיעים על גבי הצילומים. עם השלמת הדבר (על ידי המבקש), ובטרם יוצאו הצילומים מבית המשפט, תוודא המזכירה הראשית כי כל הפרטים המזהים אמנם הוסרו. מובהר בזאת כי המבקש אינו רשאי לעשות שי מוש
בחומר המצוי בתיק למטרה כלשהי החורגת מן התכלית עליה מתבססת בקשתו. לבסוף, לא מצאתי כי יש לדחות את מועד העיון עד לתום הליכי הערעור, כהצעת המשיבה, שכן לא מצאתי יסוד לחששה כי המסמכים המצויים בתיק יאבדו בשוגג.
התוצאה היא, שניתנת בזה זכות עיון כמבוקש. מועד העיון יתואם עם המזכירה הראשית של בית המשפט העליון. אין צו להוצאות.
