4 והוראת שעה), התשע"ד-2013 (להלן – החוק למניעת הסתננות או תיקון מס ' 4 לחוק למניעת הסתננות ).

המערער 1 (להלן – המערער ) הוא אזרח צפון סודן, שנכנס לישראל שלא כדין בשנת 2009, דרך גבול ישראל-מצרים. המערערים 7-2 הם ארגונים הפועלים לקידום זכויות מהגרים ומבקשי מקלט. המערער שהה בישראל מאז חודש מאי 2009 בהתאם למדיניות "ההגנה הזמנית" שנקטה ממשלת ישראל בעבר ביחס לאזרחי סודן, שמשמעותה המעשית הייתה אי-החזרה של אזרחים סודנים לארצם (לסקירת ההתפתחויות במדיניות זו, ראו, למשל, בג"ץ 7146/12 אדם נ ' הכנסת , פיסקאות 10-9 (השופטת ע ' ארבל ) (16.9.2013)). שהייתו של המערער בישראל הוסדרה ברישיון זמני, לפי סעיף 2(א)(5) לחוק הכניסה לישראל, התשי"ב-1952, אשר חודש מעת לעת. ביום 19.1.2014 ביקש המערער לחדש את הרישיון הזמני שלו בלשכת רשות האוכלוסין וההגירה. במעמד זה, הוצאה נגדו הוראת שהייה לפי סעיף 32ד(א) לחוק למניעת הסתננות. לפי ההוראה, נדרש המערער להתייצב במתקן השהייה הפתוח למסתננים "חולות" שבקציעות ביום 23.2.2014. המערער פנה למשיב בדרישה לבטל את ההוראה, מהטעם שלא נערך לו שימוע לפני קבלת החלטתו של המשיב בדבר הוצאת הוראת השהייה, ומשום שזו לא נומקה. המערער אף תבע לבטל הוראות שניתנו בהליך דומה ביחס לאחרים. בעקבות פניותיו, הוזמן המערער להגיע למשרד הפנים ביום 20.2.2014 לצורך בחינת עניינו. דא עקא, המערער לא התייצב במועד שנקבע, בנימוק כי מטרת הבחינה אינה ברורה לו, לאור עמדת המשיב לפיה אין חובת שימוע טרם הוצאתן של הוראות שהייה. עוד טען המערער, כי הוא מסרב לקיום הבחינה בעוד הוראת השהייה עומדת בתוקפה, ולהפרדת עניינו מזה של כלל המסתננים נגדם הוצאו הוראות שהייה בנסיבות דומות.

בעקבות הדברים הללו, עתרו המערערים לבית המשפט לעניינים מינהליים. בעתירתם העלו טענות הן במישור הפרטני לגבי המערער הן במישור העקרוני. במישור העקרוני טענו המערערים, כי על המשיב לערוך שימוע למי שהוחלט להוציא נגדו הוראת שהייה לפי סעיף 32ד לחוק למניעת הסתננות, ולנמק את ההחלטה. זאת, לפני קבלת ההחלטה בדבר הוצאת הוראת השהייה, ולא בדיעבד. כמו כן, ביקשו המערערים כי בית המשפט יצהיר על בטלותן של כלל הוראות השהייה שהוצאו מכוח סעיף 32ד לחוק למניעת הסתננות, אשר בהליך קבלתן לא ניתן שימוע מקדים ולא ניתנה הנמקה כנדרש. במישור הפרטני, טענו המערערים כי נוכח הפרת חובת השימוע וההנמקה בעניינו של המערער, כמו גם לאור נתוניו האישיים, דינה של הוראת השהייה שהוצאה נגדו להתבטל.

בפסק-דינו מיום 25.3.2014 הכריע בית המשפט לענינים מינהליים אך בעניינו הפרטני של המערער, וקבע כי בשל סירובו להתייצב לשימוע מאוחר, העולה כדי חוסר תום לב, אין עילה לבטל את הוראת השהייה מחמת הפרת חובת שימוע. מטעמים אלה אף דחה את טענת המערער בדבר פגם בהנמקה. בית המשפט ציין, כי ההנמקה להוראת השהייה היא למעשה עמידתו של המערער בקריטריונים שקבע המשיב להוצאת הוראת שהייה, וכי היה באפשרותו של המערער לתקוף הנמקה זו, לוּ הופיע לשימוע המאוחר. עוד קבע כי פגם בהליך, אם היה, אינו מוביל לבטלות ההוראה, כי אם לבטלות יחסית. בית המשפט לא הכריע בעניין העקרוני, היינו, חובת מתן שימוע מקדים בהליכים של הוצאת הוראות שהייה, לפי סעיף 32ד לחוק למניעת הסתננות. בית המשפט ציין, כי סוגיה זו מצויה במישור חוקתיות תיקון מס ' 4 לחוק למניעת הסתננות, שאלה בה עתיד להכריע בית משפט זה בבג"ץ 8425/13 גבריסלאסי נ ' הכנסת . ממילא, לא נעתר בית המשפט לבקשת המערערים לבטל את כל הוראות השהייה שהוצאו מכוח סעיף 32ד לחוק למניעת הסתננות, אשר ניתנו, לשיטתם, בהליך פגום. מכאן הערעור.

בתום דיון בערעור ביום 21.5.2014 קבענו, כי המערער יוזמן לשימוע מחוץ למתקן השהייה "חולות", בו הוא שוהה בפועל מיום 5.5.2014, ויופטר מהתייצבות לספירה יומית במתקן לשם כך. הדגשנו, כי בא כוחו של המערער יהיה רשאי לייצגו בשימוע. השימוע אכן התקיים בפני ממונה ביקורת גבולות ביום 28.5.2014. בסופו קבע הממונה, בהחלטה מנומקת, כי הוראת השהייה תיוותר על כנה. בכך מוצה, למעשה, הערעור בעניינו הפרטני של המערער. אלא, שבהודעתם המשלימה מיום 1.6.2014 מוסיפים המערערים וטוענים, כי יש לבטל את הוראת השהייה שהוצאה נגד המערער. לטענתם, השימוע המאוחר אך אישש את ההחלטה הקודמת בעניינו, על אף שנפלו בה פגמים מהותיים, היורדים לשורש ההליך. המערערים משיגים אף על אופן הפעלת שיקול דעתו של הממונה. ייאמר כבר עתה, כי איננו רואים לדון בטענות אלה במסגרת ההליך דנא. אם מבקש המערער להשיג על החלטת הממונה מיום 28.5.2014, שכמובן לא עמדה בפני בית משפט קמא בהליך נושא הערעור, עליו לנקוט הליך מתאים.

עתה לעניין העקרוני. במהלך הדיון ביום 21.5.2014 העלינו הצעה לשינוי ההליך של הוצאת הוראות השהייה לפי חוק ההסתננות, כך שיינתן שימוע למסתנן טרם מתן הוראת שהייה בעניינו, ולא בדיעבד. ביום 26.5.2014 הודיע המשיב, כי הצעת בית המשפט מקובלת עליו, וכי יישם הליך חדש של הוצאת הוראות שהייה החל מיום 6.6.2014. המשיב ציין, כי ההליכים ינוהלו במתכונת זו כ"פיילוט", למשך תקופה של שלושה חודשים. לפי המתווה החדש, כשמגיע מסתנן אל לשכות רשות האוכלוסין וההגירה לצורך חידוש הרישיון הזמני בישראל שברשותו, מודיע לו ממונה ביקורת גבולות, בכתב, על הכוונה להוציא בעניינו הוראת שהייה. זאת, אם האדם עומד, לכאורה, בקריטריונים למתן הוראה כאמור. במקביל, הוא מוזמן לתשאול במועד מאוחר יותר, תוך שהרישיון הזמני שבידו מוארך עד יום התשאול שנקבע. בתום התשאול, מחליט ממונה ביקורת גבולות אם ליתן הוראת שהייה לפי סעיף 32ד לחוק למניעת הסתננות. אם הוחלט על מתן הוראת שהייה, תיכנס זו לתוקף בתאריך עתידי, כך שעומדת לאדם תקופת התארגנות טרם הכניסה למתקן "חולות". הרישיון הזמני שברשות המסתנן מוארך עד ליום כניסתה לתוקף של הוראת השהייה. במועד ההגעה למרכז השהייה ב"חולות", נערך לשוהה ראיון קליטה ובירור עובדתי נוסף לשם אשרור הוראת השהייה.

בהודעתם מיום 1.6.2014 הביעו המערערים את הסכמתם העק רונית למתווה המוצע, אך ציינו שישנם היבטים נוספים בהליך הטעונים הבהרה. בין היתר, טוענים המערערים כי על המשיב להבהיר מה פרק הזמן שיוקצה למי שנשקלת האפשרות להוציא נגדו הוראת שהייה לפני מועד השימוע, וכן בין מועד השימוע לבין מועד ההתייצבות במתקן "חולות". לשיטתם, יש להעמיד את פרק הזמן המינימלי לפני השימוע על 10 ימים, ואת פרק הזמן המינימלי בין השימוע להתייצבות במתקן חולות על 30 ימים. כמו כן, לטענת המערערים, על ההודעה בדבר הכוונה להוציא הוראת שהייה נגד מסתנן להסביר אילו טענות ניתן יהיה להעלות בשימוע, להבהיר כי הוא זכאי לייצוג בהליך ולנוכחות מתורגמן כשיר, ולציין כי המסתנן רשאי להביא עמו מסמכים רלוונטיים. בנוסף, מבקשים המערערים כי בית משפט זה יורה שלא יוצאו הוראות שהייה נוספות עד ליישום מתכונת ההליך החדשה. לגבי החלטות שכבר ניתנו במתכונת הקודמת, סבורים המערערים כי יש לקבוע הוראות באשר לבחינתן מחדש, ואם טרם מומשו – אף להורות על בטלותן.

כאמור, המשיב קיבל את הצעתנו בנוגע להליך של הוצאה של הוראות שהייה לפי חוק ההסתננות. המשיב אף מסר כי ההליך, במתכונתו החדשה, מיושם מאז יום 6.6.2014. מצאנו כי נדרשת השלמת טיעון בטענות הצדדים בהתייחס לשאלה העק רונית המתייחסת להוראות השהייה שהוצאו במתכונת הישנה. המזכירות תיקבע המשך דיון בערעור בהקדם.

הדיון בערעורו הפרטני של המערער מסתיים איפוא, כמפורט בפיסקה 5 לעיל. הערעור בשאלות העקרוניות ייקבע להמשך כאמור.
