החלטה

בפניי בקשה לפטור מהפקדת עירבון בהליך שבכותרת שעניינו ערעור על פסק-דינו של בית המשפט לעניינים מנהליים בבאר שבע בו נדחתה עתירת המערער, נתין סודן, לביטול צו גירוש שהוצא נגדו לפי החוק למניעת הסתננות (עבירות ושיפוט), תשי"ד-1954; לשחרורו ממשמורת ולהשבת אשרה זמנית שהיתה ברשותו.
המערער טוען כי יש לפטור אותו מהפקדת עירבון נוכח מהות ההליך והעובדה שנתון הוא במשמורת (בדומה לפטור שניתן מתשלום אגרה על פי תקנה 20(7) לתקנות בתי המשפט (אגרות), התשס"ז-2007).

המשיבים 1-2 מתנגדים למתן פטור מלא מהפקדת עירבון, בציינם כי המערער לא טען, וממילא לא הוכיח, כי מצבו הכלכלי מצדיק את מתן הפטור המבוקש. המשיבים מדגישים בהקשר זה כי המערער שהה בישראל החל משנת 2008 וכי הורשע על פי הודאתו בעבירה של החזקת סמים מסוכנים שלא לצריכה עצמית - ומכאן כי "לא בחל בדרכים בלתי חוקיות על מנת לדאוג לפרנסתו וכלכלתו". עוד טוענים המשיבים כי סיכויי הערעור נמוכים. עם זאת ציינו המשיבים כי הם אינם מתנגדים להפחתה מסוימת בשיעור העירבון.

הצדק עם המשיבים כי המערער, אשר כעולה מפסק-דינו של בית המשפט קמא הסתנן לישראל בשנת 2008 ונעצר כארבע שנים לאחר מכן בחשד לביצוע עבירות לפי פקודת הסמים המסוכנים [נוסח חדש], תשל"ג-1973, לא פרש בבקשתו תשתית עובדתית, ולו מינימאלית, לעניין מצבו הכלכלי. כך לא ציין המערער מה היו מקורות מחייתו לאורך התקופה הארוכה בה שהה בישראל עד שנעצר; לא הבהיר כיצד הוא נושא בעלויות ייצוגו המשפטי בבית המשפט קמא ובבית משפט זה; ולא התייחס לאפשרות העומדת לו לגייס את סכום העירבון בעזרת מכרים שרכש בתקופת שהייתו בישראל. בנסיבות אלה אין מקום לפטור את המערער באופן מלא מהפקדת עירבון אף מבלי להידרש לשאלת סיכויי ההליך.
יחד עם זאת, בהינתן מהות ההליך ופערי הכוחות בין הצדדים ובשים לב לעובדה שהמערער נתון כעת במשמורת כמו גם לעמדת המשיבים 1-2, אשר כאמור אינם מתנגדים להפחתה בסכום העירבון, יועמד העירבון על סכום מתון של 1,500 ש"ח.
עירבון בשיעור האמור יופקד בתוך 14 ימים ממועד המצאת החלטה זו, ולא - יירשם ההליך לדחייה ללא הודעה נוספת.
