לפניי בקשה מטעם המשיב לפסיקת הוצאות.
הערעור שבכותרת, שהגישה המדינה, נסב על פסק-דין של בית המשפט המחוזי בבאר-שבע, שבו התקבלה עתירה שהגיש המשיב – נתין אריתריאה – נגד ההחלטה לשלול את אשרת השהייה שלו, להוציא בעניינו צו גירוש ולהשימו במשמורת בעקבות מעורבותו בפלילים. בית המשפט המחוזי פסק כי יש לשחרר את המשיב בתנאים.
הערעור הוגש ביום 27.6.2013, יחד עם בקשה לעיכוב ביצוע. כבוד השופט עמית נמנע מלהורות על עיכוב ביצוע (החלטה מיום 27.6.2013), וקבע כי הערעור ייקבע לשמיעה בהקדם. בהחלטתי מיום 1.7.2013 הוריתי על הגשת עיקרי טיעון לקראת הדיון שנקבע ליום 16.9.2013. המדינה הגישה עיקרי טיעון ביום 20.8.2013, והמשיב הגיש את עיקרי טיעוניו ביום 11.9.2013. ביום 12.9.2013 ניתנה החלטה של כבוד המשנה לנשיא נאור, שבה התבקשו הצדדים להביע עמדתם לגבי האפשרות שהדיון יידחה עד לאחר מתן פסק-הדין בבג"ץ 7146/12. הצדדים הודיעו כי אינם מתנגדים לכך, וכבוד המשנה לנשיא קבעה כי מועד הדיון יידחה. ביום 7.2.2014 הגישה המדינה בקשה למחיקת ההליך (זאת בהמשך להחלטה נוספת של כבוד המשנה לנשיא, מיום 28.1.2014). בבקשה צוין כי בעקבות פסק-דינו של בית משפט זה בבג"ץ 7146/12, אשר ביטל את התיקון לחוק למניעת הסתננות (עבירות ושיפוט), התשי"ד-1954, ובהינתן העובדה שבקשת המערערת לעיכוב ביצוע נדחתה, הערעור אינו רלוונטי עוד. ביום 9.2.2014 ניתן פסק-דין על-ידי כבוד הרשמת בנמלך, שלפיו נמחק הערעור והצדדים התבקשו להגיש טענותיהם לעניין בקשת המשיב לפסיקת הוצאות. טענות הצדדים הוגשו, והתיק הועבר לאחרונה לטיפולי על רקע חילופי גברי בלשכת הרשמים.
לאחר עיון בטענות הצדדים באתי לכלל מסקנה כי יש מקום לפסיקת הוצאות לטובת המשיב.
ככלל, נקודת המוצא היא כי בעל-דין המגיש הליך צריך להניח כי הצד שכנגד יישא בהוצאות כדי לעמוד על זכויותיו, ועל כן צריך הוא גם להניח כי אם יחזור בו מן ההליך שהגיש, ידרוש הצד שכנגד שיפוי על הוצאותיו. כמו-כן, ככלל, בהיעדר הכרעה שיפוטית לגבי צדקת ההליך הערעורי, ההנחה היא כי בעל-הדין שיזם את ההליך נדרש לשאת בהוצאות שנגרמו בגינו. אמת, הנחת המוצא האמורה ניתנה לסתירה, אולם הנטל בעניין זה מוטל על מגיש הערעור (ראו למשל ע"א 644/10 עזבון רווידאן נ' נג'אר (25.5.2014); עע"ם 7026/10 באר מרים 26 שי בע"מ נ' מחלקת רישוי עסקים – עיריית טבריה (15.1.2012)).
בענייננו, לא מצאתי כי הנטל הורם. נכון הדבר כי ביסוד החלטתה של המערערת לסגת מן ההליך עומד פסק-דין שניתן בהליך אחֵר (ושינוי המסגרת הנורמטיבית בשל כך), אולם בנסיבות העניין איני סבור כי הדבר שולל את זכותו של המשיב להוצאות. המערערת אמנם מדגישה את ההבדל בין הסוגיה (המנהלית) שעמדה בבסיס ההליך שבכותרת לבין הסוגיה (החוקתית) שניצבה במוקד פסק-הדין בבג"ץ 7146/12, אולם, בסופו של דבר המצב הוא שהמערערת בחרה, על-פי זכותה כמובן, לנקוט בהליך הערעור שבכותרת (בשעה שההליך החוקתי היה תלוי ועומד), ונסוגה ממנו לאחר פסק-הדין בבג"ץ 7146/12, כשברקע גם העובדה שהוחלט לדחות את בקשתה לעיכוב ביצוע (ראו סעיפים 4-3 להודעת העדכון מיום 7.2.2014). ודוק: המערערת עודנה סבורה כי הערעור היה מוצדק, אולם מכיוון שההליך לא הגיע לכדי ליבון, בוודאי אין בידי לקבוע מסמרות בעניין זה היום; יש רק לזכור, כי קיים פסק-דין של בית המשפט המחוזי שפסק לטובת המשיב, וכי הנחת העבודה היא שבעל-הדין אשר יזם הליך ערעור שהסתיים ללא הכרעה שיפוטית, הוא אשר יישא בהוצאות.
אני רואה להדגיש כי במסגרת הבקשה לפסיקת הוצאות לא נכללו נתונים לגבי הוצאות ושכר טרחה בפועל, ומנגד צוינו מדדים שאין להם נפקות של ממש ככל שמדובר בפסיקת הוצאות בהליך זה (כגון נזקים נטענים של המשיב עקב שהייתו במשמורת עד לשחרורו). כמו-כן, יש להביא בחשבון את היקף הפעילות (המצומצם יחסית) שנדרשה מהמשיב בהליך, ובכלל זה את העובדה שלא התקיים דיון לפני הרכב.
לאור כלל הנסיבות, החלטתי לפסוק לטובת המשיב הוצאות בסך של 3,500 ₪.
