בקשה לדחיית הערעור
החלטה
לפניי בקשה לדחיית ערעור מחמת איחור נטען בהגשתו.

בפסק הדין נשוא הערעור בוטלו שתי החלטות אשר התקבלו על ידי המשיבה 2 בעניינו של המשיב. פסק הדין, אשר ניתן ביום 30.8.2012, הומצא לידי המערערים ביום 4.9.2012.
ביום 14.10.2012 הגישו המערערים ערעור על פסק הדין וזה נתקבל במזכירות בית המשפט. בבקשה שבפניי טוען המשיב כי הערעור הוגש באיחור ניכר שכן היה על המערערים להגישו עד ליום 4.10.2012. בעניין זה טוען המשיב, בפירוט רב, כי על פי תקנה 33 לתקנות בתי משפט לעניינים מינהליים (סדרי דין), תשס"א-2000 (להלן: תקנות בתי משפט לעניינים מינהליים ) ערעור על פסק דינו של בית המשפט לעניינים מנהליים ניתן להגיש תוך שלושים ימים, וכי ההוראה הקבועה בתקנה 529 לתקנות סדר הדין האזרחי, תשמ"ד-1984 (להלן: תקנות סדר הדין האזרחי ) הקובעת כי תקופת פגרה לא תובא במניין הימים, אינה חלה לגבי ערעור כאמור.
ואולם, בכך מתעלם המשיב מהוראה מפורשת המצויה בעניין זה בתקנות בתי משפט לעניינים מינהליים עצמן - היא תקנה 44 - הקובעת מפורשות כי "תקופת פגרה של בתי המשפט לא תבוא במניין הימים שנקבעו בתקנות אלה...". משמע, אין כל צורך להידרש בהקשר זה לתקנות סדר הדין האזרחי, ובהתאם לסדרי הדין המיוחדים שנקבעו בקשר עם הליכים מנהליים תקופת הפגרה אינה באה במניין (ראו גם: בש"א 6927/11 רוכמן נ' קיבוץ מענית , פסקה 11 (לא פרסם, 24.1.2012); עע"ם 7118/12 שליו נ' עירית הרצליה (לא פורסם, 22.10.2012)).

פסק דינו של בית המשפט לעניינים מנהליים הומצא כאמור למערערים ביום 4.9.2012, ומשכך תקופת שלושים הימים, בהינתן ימי הפגרה, חלפה ביום 12.10.2012. ואולם, היות ומועד זה חל ביום ו' הוא נחשב כיום פגרה (ראו תקנה 4 לתקנות בתי המשפט (פגרות), תשמ"ג-1983) ומשכך הגשת הערעור ביום א' החל בסמוך לאחר מכן, קרי ביום 14.10.2012, נעשתה בתוך המועד הקבוע לכך בדין.
משכך, בדין קיבלה מזכירות בית המשפט את הערעור לרישום, והבקשה לדחיית הערעור נדחית.
