המבקשים, אב ובנו, הורשעו בבית המשפט המחוזי בנצרת על פי הודאתם ובמסגרת הסדר טיעון בעבירות אלימות. המבקש 1 הורשע בעבירות של חבלה חמורה בנסיבות מחמירות ובהיזק בזדון והמבקש 2 הורשע בעבירות של חבלה של ממש בנסיבות מחמירות ובהיזק בזדון. על פי העובדות שבהן הודו המבקשים, ביום 19.6.2008, לאחר סכסוך שהתפתח בין בני משפחתם ובין בנו של המתלונן בשל כך שרכב אשר יצא מבית העסק השייך למתלונן חסם את דרכו של רכב השייך לבן משפחתם של המבקשים, דקר המבקש 1, צעיר בן 19, את המתלונן מספר פעמים לאחר שניסה להכותו בעזרת אלה והמתלונן ניסה להוציא את האלה מידיו. למתלונן נגרם חתך באורך 6 ס"מ בצידו השמאלי של חזהו וכן נגרם לו קרע בסרעפת ודימום פנימי מסיבי והוא הובהל לבית החולים במצב קשה ונזקק לניתוח. המבקש 2, אביו של המבקש 1, הורה לו לברוח מן המקום ובעצמו תקף את בנו של המתלונן אשר הגיע למקום, במכות אלה בזרועו ובפניו וגרם לו חבלה בכף יד ימין שהצריכה טיפול וחבישה וגרמה לו כאבים. המבקש 1, המבקש 2 ואחרים גרמו גם נזק בפח ובשמשות לרכב בו נסע בנו של המתלונן. מאוחר יותר נורו כחמש עשרה יריות לעבר בית משפחת המתלונן מהן נפצע אדם נוסף, נגרם נזק לרכב השייך למתלונן ושמשותיו נופצו.

בגין מעשים אלו גזר בית המשפט המחוזי על המבקש 1, ביום 12.2.2009, חמישה עשר חודשי מאסר בפועל, 12 חודשי מאסר על תנאי למשך שלוש שנים וקנס בסך של 5,000 ש"ח אשר ישולם בחמישה תשלומים חודשיים רצופים ושווים החל מיום שחרורו של המבקש 1 ממאסר, או שלושים ימי מאסר תמורתו. בית המשפט ציין עם זאת כי נוכח העובדה שבין הצדדים המעורבים נערכה סולחה ובה שולמו כספים כפיצוי למתלונן, אין הוא מוצא לנכון לחייב את המבקש 1 בתשלום פיצויים למתלונן. על המבקש 2 גזר בית המשפט עשרים חודשי מאסר בפועל וכן 12 חודשי מאסר על תנאי למשך שלוש שנים ובהתחשב בתקופת המאסר שהוטלה עליו וכן בסכום ששולם על-ידו במסגרת הסכם הסולחה, נמנע בית המשפט מלהטיל עליו קנס כספי וכן נמנע מחיובו בתשלום פיצויים לבנו של המתלונן. בגזר דינו עמד בית המשפט על החומרה שבמעשי המבקשים ועל הצורך להחמיר בענישה במקרה של שימוש בסכין כדרך לפתרון סכסוכים. בית המשפט המחוזי הוסיף וציין כי אינו ממצה את מלוא חומרת הדין עם המבקש 1 נוכח גילו הצעיר, העדר עבר פלילי וניהול אורח חיים נורמטיבי עובר למקרה דנן וכן בשל התרשמותו החיובית של שירות המבחן ממנו. אשר למבקש 2 ציין בית המשפט כי אף שהעבירה שבוצעה על-ידו פחותה בחומרתה מזו שביצע המבקש 1, הרי נוכח העובדה ששימש ה"יסוד הממריץ" בהתנהגות בנו, המבקש 1, עברו הפלילי הכולל עבירות אלימות רבות ונוכח התרשמותו השלילית של שירות המבחן ממנו, ראוי הוא כי עונשו יהיה כבד מזה שהוטל על המבקש 1. עוד ציין בית המשפט כי הוא אינו סבור שבמקרה דנן יש לראות בסולחה שנערכה שיקול לקולא, שכן זו אינה כוללת הבעת חרטה אמיתית. במעמד מתן גזר הדין עתרו המבקשים לעכב את ביצוע גזר הדין לצורך הגשת ערעור ובית המשפט נעתר לבקשה.

המבקשים הגישו לבית משפט זה ערעור על חומרת העונש ויחד עימו הגישו את הבקשה שבכאן לעכב את ביצוע העונשים שנגזרו עליהם על כל מרכיביהם, עד להכרעה בערעור. המבקשים טוענים כי טובים סיכויי הערעור להתקבל בשל רמת הענישה המקובלת במקרים דומים; נסיבותיו המיוחדות של העניין; קיומה של סולחה בינם ובין המתלונן (ואחרים שהיו מעורבים בפרשה); חלוף הזמן וכן גילו הצעיר של המבקש 1 והעובדה שהוא נעדר עבר פלילי. עוד טוענים המבקשים כי בית משפט קמא ציין את התרשמותו החיובית מהם ובאשר למבקש 1 התרשם כך גם שירות המבחן אשר המליץ על עבודות שירות בעניינו. המבקשים מפנים לנסיבותיהם האישיות כפי שפורטו בתסקירי שירות המבחן שהוגשו והם מוסיפים ומציינים כי דחיית בקשתם תוביל לסיכול תכלית הערעור, במיוחד ככל שהדבר נוגע למבקש 1. לבסוף טוענים המבקשים כי במהלך משפטם הם שוחררו לחלופת מעצר וכי ביום 28.10.2008 אף הוקלו תנאי החלופה ונקבע כי עליהם לשהות במעצר בית רק בשעות הלילה וכי הם לא הפרו את תנאי השחרור, התייצבו לכל הדיונים במשפטם והפקידו ערבויות מספקות וטובות.

המשיבה מצידה מתנגדת לעיכוב ביצוע העונשים שהוטלו על המבקשים. לטענתה, גזר דינו של בית משפט קמא מפורט ומנומק וצויין בו, בהתאמה לפסיקתו של בית משפט זה, כי יש לשרש את "תופעת הסכינאות" בדרך של ענישה מחמירה. עוד מציינת המשיבה כי בית משפט קמא נקט גישה סלחנית כלפי המבקש 1 ולא מיצה עימו את הדין נוכח גילו הצעיר, היעדר עבר פלילי והרושם החיובי שהשאיר על שירות המבחן וכי העונש שנגזר על המבקש 2 נומק בכך שהוא היה "היסוד הממריץ" בהתנהגותו של המבקש 1, וכן בעברו הפלילי ובתסקיר שירות המבחן השלילי שהוגש בעניינו. על כן טוענת המשיבה כי העונשים שהוטלו על המבקשים אינם מצדיקים את התערבותה של ערכאת הערעור, בוודאי שלא על דרך של ביטול עונשי המאסר כליל, ומכל מקום היא מציינת כי תקופות המאסר שנגזרו על המבקשים אינן קצרות ואין בתחילת ריצוי עונשם כדי לסכל את ערעורם. בנסיבות אלה, סבורה המשיבה כי אין מקום להיעתר לבקשה.

דין הבקשה להידחות. הערעור שהוגש על-ידי המבקשים מכוון כנגד חומרת העונש ועל פני הדברים ובזהירות הראויה ניתן להעריך כי סיכויי הערעור אינם מן הגבוהים. זאת נוכח העונשים המתונים שנגזרו על המבקשים בעבירות האלימות החמורות שבהן הורשעו. עם זאת, נוכח תקופות המאסר הקצרות יחסית שנגזרו על המבקשים, ובמיוחד בשים לב לתקופת המאסר שנגזרה על המבקש 1, תדאג המזכירות לקבוע את הערעור לשמיעה בפני הרכב בהקדם, ככל שהיומן מאפשר.
הבקשה לעיכוב ביצוע נדחית. המבקשים יתייצבו לריצוי עונשם ביום ג', 24.2.2009, עד השעה 09:00 במזכירות הפלילית של בית המשפט המחוזי בנצרת.
