החלטה
בהליך שבכותרת התעוררה שאלה בדבר דרך התקיפה הראויה של החלטת בית משפט קמא.

לצורך דיון בבקשה, אתאר בקצרה את ההליכים שקדמו לה. בין הצדדים מתנהל הליך אזרחי בבית משפט השלום בירושלים. במסגרת הליך זה, נתבקשו המערערים לגלות מסמכים למשיבים. בין הצדדים הושגה הסכמה בעניין זה אשר ניתן לה תוקף של החלטה. במשך להחלטה זו נתגלעה בין הצדדים מחלוקת נוספת לגבי השאלה מי מביניהם ישא בעלויות צילום המסמכים. בית המשפט השלום קבע כי המשיבים ישאו בעלויות אלה. על החלטה זו הוגשה בקשת רשות לערער לבית המשפט המחוזי בירושלים. בית המשפט המחוזי קבע כי הסכומים שנתבקשו על ידי המערערים בגין צילום החומר מופרזים ובהחלטתו נקבע הסדר ספציפי בעניין זה. בגין אופן קיומה של החלטה זו הוגשה על ידי המשיבים בקשה לביזיון בית המשפט. בית המשפט המחוזי קבע כי המערערים ביזו בהתנהגותם את פסק דינו הנ"ל והם חויבו לשלם למשיבים הוצאות משפט. עוד נקבע על ידו, כי אם הוא עדיין היה סבור שיש נושאים שטרם בוצעו על ידי המערערים, הוא היה מחייבים לשלם למשיבים בגין הביזיון סך של 50,000 ₪, אולם מאחר והחומר התקבל זה מכבר על ידי המשיבים, הוא מנוע מלהטיל קנס על המערערים שכן אין לפניו צו הצופה פני העתיד. בית המשפט המחוזי הוסיף וקבע כי אם יתברר שיש מסמכים שטרם הומצאו למשיבים, הם יהיו רשאים לנקוט הליכי בזיון בית משפט נוספים, ואז, ככול שהבקשה תתקבל, ניתן יהיה להטיל עליהם את הסנקציה הכספית האמורה. על החלטה זו הוגש הערעור שבכותרת. בהחלטתי מיום 11.3.07 התבקשה עמדת הצדדים לגבי הדרך הראויה לתקיפת החלטת בית משפט קמא; ערעור פלילי או בקשת רשות לערער בהליך אזרחי.

לטענת המערערים, בקשת המשיבים לבזיון בית המשפט התקבלה ולפיכך הדרך להשיג עליה הינה באמצעות הגשת ערעור פלילי. המערערים מפנים בעניין זה לע"פ 4793/05 בתיה נבון נגד מיכל עצמון , תק-על 2007(1), 1563 (להלן: הלכת נבון) . לטענתם, בהלכת נבון נקבע כי דיון בגלגול שלישי של ההליך יהיה לעולם בדרך של הגשת בקשת רשות לערער, ואילו כאשר מדובר בדיון בגלגול שני, כמו במקרה דנן, ובית המשפט מקבל את הבקשה, הדרך התקיפה הינה באמצעות ערעור פלילי. עוד נטען כי גם בהלכת נבון נדון מצב דומה, שכן בשני המקרים קבע בית משפט קמא כי המדובר בביזיון בית המשפט אולם נמנע מלפסוק קנס בהתאם לפקודת ביזיון בית המשפט (להלן: הפקודה) וקבע מפורשות כי במידה ויתקיים בזיון בית משפט עתידי תוטל על המשיבים סנקציה כספית. המערערים מוסיפים וטוענים כי אף אם לא הוטלה עליהם סנקציה מכוח החלטת בית המשפט, הרי עצם קבלת הבקשה מהווה
פגיעה קשה בהם, תוך קביעה בעלת משמעות שבפלילים, ומטעם זה יש לאפשר להם לערער על ההחלטה. לעומת זאת, לטענת המשיבים, הדרך הראויה לתקוף את החלטת בית משפט קמא הינה באמצעות הגשת בקשת רשות לערער. לטענתם, הוראת סעיף 8(1) לפקודה הינה ברורה, ולפיה רק במקרה שבית המשפט עושה שי מוש
בסמכותו לפי סעיף 6 לפקודה ונותן צו המטיל עונש על הממרה, קמה לו הזכות להגיש ערעור פלילי על ההחלטה. במקרה דנן, נמנע בית משפט קמא מליתן צו המטיל עונש על המערערים, ולפיכך לא קמה להם זכות ערעור. עוד נטען על ידם כי הלכת נבון כלל לא רלבנטית לענייננו.

סעיף 8(1) לפקודה קובע כדלקמן:
"צו המטיל עונש שניתן ע"י בית משפט מחוזי או בית משפט לקרקעות או בית משפט שלום עפ"י סעיף 6 יהא ניתן לערעור באותם התנאים הנוהגים בערעור על פסק דין פלילי המטיל עונש כיוצא בזה".
ההלכה לעניין הדרך לתקיפת החלטות שעניינן בקשות לבזיון בית המשפט ברורה וידועה. כאשר בית המשפט נעתר לבקשה לפי הפקודה, דרך התקיפה הינה זו של ערעור פלילי בזכות, כפי שמורה סעיף 8(1) הנ"ל. לעומת זאת, כאשר הבקשה נדחית נעשית ההשגה על דרך בקשת רשות ערעור כבהליך אזרחי (ראו: בע"א 228/63 עזוז נ' עזר , פ"ד יז 2541; ע"פ 4793/05 הנ"ל). השאלה המתעוררת במקרה שלפני הינה, מהי הדרך להשיג על החלטת בית המשפט בנסיבות בהן בית המשפט מקבל את הבקשה לביזיון במובן זה שהוא קובע כי בעל דין אכן ביזה את פסק דינו של בית המשפט אולם יחד עם זאת, בשל טעמים שונים, נמנע בית המשפט מלהפעיל את הסנקציות הקבועות בפקודה כנגד המפר.

בעניין זה, מקובלת עלי עמדת המשיבים לפיה הדרך לתקוף החלטה כאמור הינה באמצעות הגשת בקשת רשות לערער. לשונו של סעיף 8(1) לפקודה ברורה וחד משמעית. עיון בסעיף מלמד כי הוא עוסק רק במצב בו בית המשפט מחליט להפעיל סנקציה נגד המשיב בבקשת הביזיון. לשון אחר, האפשרות לערער על החלטת בית משפט באותם התנאים הנוהגים בערעור על פסק דין פלילי מסויגת רק למקרה שניתן צו המטיל עונש. בכל מקרה אחר, הדרך להשיג על החלטת בית המשפט בבקשה לביזיון הינה באמצעות הגשת בקשת רשות לערער. פרשנות זו אף עולה בקנה אחד עם תכליתו של סעיף 8(1) לפקודה. הסעיף נועד לאפשר להגיש ערעור פלילי רק כאשר הסנקציה שננקטה נגד בעל דין במסגרת בקשה לביזיון בית המשפט הינה שוות ערך, מבחינת חומרתה, לסנקציה פלילית מובהקת. כאשר לא ננקטה סנקציה כאמור, אין מקום לאפשר לבעל דין להגיש ערעור פלילי. מכאן, שאם הסתפק בית המשפט בהטלת הוצאות משפט בלבד, אין זכות להגיש ערעור פלילי (ראו: משה קשת ביזיון בית המשפט (תשס"ב)
230). אוסיף, כי לא מצאתי שיש מקום להקיש בענייננו מהלכת נבון. בהחלטה נשוא הלכת נבון הטיל בית המשפט סנקציה אשר נקבע כי היא תחול ממועד מסוים באם לא יבוצעו החלטות בית המשפט. לעומת זאת, בהחלטת בית משפט קמא לא הוטלה כל סנקציה, מהטעם שהמערערים בצעו זה מכבר את החלטת בית המשפט. פשיטא כי קביעתו של בית משפט קמא, לפיה המשיבים רשאים לנקוט הליכי בזיון בית משפט נוספים, אשר במסגרתם ישקול בית המשפט הטלת סנקציה על המערערים, אין בה כדי להחיל בעניינו את הוראת סעיף 8(1) לפקודה.
נוכח מסקנתי הנ"ל, הערעור שבכותרת הוגש שלא כדין ולפיכך דינו להימחק. המערערים ישאו בהוצאות המשיבים בסך כולל של 1,500 ₪ אשר ישאו הפרשי הצמדה וריבית מעת המצאת החלטה זו ועד ליום התשלום בפועל.
