בלב התיק עומדת קטטה שפרצה בין המבקש, פרג' סליבא (להלן: המתלונן) ואדם נוסף בשם נימר. על פי הממצאים שנקבעו בבית המשפט קמא, בין המבקש לבין בנו של נימר התפתח עימות מילולי. נימר והמתלונן הגיעו למקום, ואז ניסה המבקש לחבוט באלה בראשו של נימר. הלה התגונן, וספג את החבטה בידו. לאחר מכן תפס המתלונן את המבקש בניסיון למנוע ממנו להמשיך ולתקוף את נימר. או אז התנפלו המבקש ובן משפחה נוסף (להלן:
המשתתף הנוסף) על המתלונן, כשבידיהם סכינים, והמבקש דקר את המתלונן בכל חלקי גופו. למתלונן נגרמו שריטות בבטן ובבית החזה, פצע באמה באורך 30 ס"מ עם קרע חלקי בשריר ובגיד, ופצע בירך באורך 15 ס"מ .
בית המשפט קמא דחה את גרסת המבקש לפיה הוא זה שהותקף על ידי המתלונן, וכן את הטענה כי בני משפחת נימר הגיעו "בהמוניהם" כדי לפגוע במבקש. המבקש הפנה את האצבע במידה מסוימת כלפי המשתתף הנוסף, אולם בית המשפט קבע כי אף לשיטת המבקש - הוא (דהיינו המבקש) הינו העבריין העיקרי, וקיימות ראיות מהימנות ועצמאיות שהוא דקר את המתלונן מספר פעמים. סיכומו של דבר הורשע המבקש בידי בית המשפט המחוזי בעבירות של חבלה חמורה בנסיבות מחמירות ובעבירה של תקיפה סתם.
יצוין כי בית המשפט המחוזי התייחס בהכרעתו גם לטענת המבקש להגנה מן הצדק. נטען על ידי המבקש כי בחירת התביעה שלא להגיש כתב אישום נגד המשתתף הנוסף, על אף שגם הוא נטל חלק בדקירת המתלונן, מהווה אכיפה בררנית. בהקשר זה ציין בית המשפט המחוזי כי החשד נגד המשתתף הנוסף הועלה על ידי הסנגוריה מספר פעמים במהלך החקירות הנגדיות שנערכו, אך הדברים התגבשו לכדי טענת הגנה מן הצדק רק בשלב הסיכומים. שיהוי זה אמנם איננו חוסם את עצם העלאת הטענה, אך מכרסם בעוצמה שיש לייחס לה. כן קבע בית המשפט, בהסתמך על הסבריו של בא כוח המדינה, כי נגד המשתתף הנוסף לא הוגש כתב אישום משום שאין די ראיות באשר למעורבותו האישית באירוע הדקירה.
ביום 2.7.2012 ניתן גזר דינו של בית המשפט המחוזי. צוין כי מעשי המבקש הם חלק מ"תת תרבות הסכין", אשר מן הראוי שבית המשפט יתרום את תרומתו למלחמה בה. מעשי המבקש הינם ברף העליון של החומרה, שכן הוא החזיק מקל וסכין בכוונה לגרום חבלה חמורה לקורבנותיו וללא כל התגרות, ותקף שני אנשים. המבקש אף לא הביע כל חרטה לאחר שהורשע. היסוד הנפשי של המבקש נמצא אף הוא ברף גבוה, ומשיק לכוונה של ממש. לקולא הודגשו גילו של המבקש, עברו הפלילי הנקי, וכן העובדה שהוא עובד לפרנסתו. כן צוינה לקולא העובדה שהמשתתף הנוסף כלל לא הועמד לדין (על אף שטענת ההגנה מן הצדק נדחתה לגופה, כאמור). ברם, בית המשפט הדגיש כי, במקרה דנא, אין מנוס מנקיטת הגישה המחמירה שמעדיפה שיקולים של מניעה והגנה על שלום הציבור על פני שיקולים אינדיבידואליים. סיכומו של דבר נגזרו על המבקש 24 חודשי מאסר בפועל, 15 חודשי מאסר על תנאי, וקנס בסך 2,000 ₪, וכן פיצוי בסך 40,000 ₪ למתלונן.
להשלמת התמונה יצוין כי, במעמד הקראת גזר הדין, ביקש בא כוח המבקש לעכב את ביצוע העונש. בית המשפט המחוזי דחה את הבקשה, בין היתר משום שתקופת המאסר היא ממושכת דיהּ ואין חשש שהערעור יתייתר. עם הגשת הבקשה לעיכוב אל בית משפט זה נקבע כי ביצוע העונש יעוכב עד להכרעה בבקשה לגופה.

המבקש טען בפניי כי השיקולים שנמנו בעניין שוורץ (ע"פ 111/99 שוורץ נ' מדינת ישראל , פ"ד נד(2) 241) מצדיקים עיכוב ביצוע העונש. כך, הסכסוך בין המבקש לבין הנפגעים הינו נקודתי, ובוצע על רקע התנגדות לאירוסיו של המבקש עם בת משפחתם של יתר המעורבים בקטטה. כן נטען שהמבקש הינו איש נורמטיבי, בעל עבר נקי, שעובד לפרנסתו. צוין שהמבקש היה נתון במעצר בית מלא במשך שמונה וחצי חודשים במהלך המשפט, ובתנאי מעצר בית חלקי במשך כשבעה חודשים נוספים – ולא הפר את תנאיו, כך שניתן לסמוך עליו שימשיך לקיים את תנאי השחרור. כמו כן, לשיטת המבקש – יש סיכוי ממשי שהערעור אותו הגיש יתקבל.
הערעור שהוגש מופנה הן נגד הכרעת הדין של בית המשפט המחוזי והן נגד גזר הדין. טענות המבקש בנוגע להכרעת הדין נשענות על שלושה נדבכים. ראשית , הגנה מן הצדק: המדינה פעלה בחוסר שוויוניות כאשר הגישה כתב אישום רק נגד המבקש ולא נגד המשתתף הנוסף. שנית , שגה בית המשפט כשדחה את גרסת המתלונן מפני גרסת עדי התביעה. הקושי נובע מכך שכל עדי התביעה הם בני משפחה אחת, ויש להם אינטרס מובהק לגונן זה על זה ולהטיל את מלוא האשמה על כתפי המבקש (שאיננו בן המשפחה). שלישית , בית המשפט הכשיר דברים שאמר המתלונן מכוח סעיפים 9 ו-10 לפקודת הראיות [נוסח חדש], התשל"א-1971, על אף שלא הייתה לכך הצדקה. באשר לחומרת גזר הדין, המערער מעלה שתי טענות: ראשית, הפיצוי שנפסק הוא מופרז, במיוחד מאחר שנגד המבקש תלוי ועומד הליך אזרחי. שנית, באשר למאסר בפועל – אין מדובר באירוע קלאסי של "תת תרבות הסכין", שכן נימר והמתלונן הגיעו יחד עם בני משפחתם אל המבקש במטרה לתקוף אותו. אף טענת ההגנה מן הצדק צריכה הייתה להביא להקלה משמעותית יותר בענישה.

על פי הנפסק בהרכב מורחב בעניין שוורץ , הכלל הבסיסי הוא שיש לבצע את העונש באופן מיידי לאחר מתן גזר הדין, אלא אם קיימות נסיבות חריגות המצדיקות דחייה. נקבע כי בבקשה לעיכוב ביצוע יש לאזן בין האינטרס הציבורי לבין שיקולים הנוגעים לפרט, ובהם: חומרת העבירות ונסיבותיהן, תקופת המאסר שהושתה על הנידון ויחסה לזמן בו עתיד הערעור להתברר, הסיכוי לקבלת הערעור, העובדה שהמבקש היה משוחרר במהלך משפטו, ונסיבות אישיות אחרות. ניתן להציג את ההלכה שעולה מעניין שוורץ
באופן אחר: מהותו, מטרתו ותכליתו של ההליך הפלילי בערכאה המבררת – מחייבות בדרך כלל אכיפה מיידית של העונש. זאת כל עוד אין נסיבות מיוחדות, ואין באי-עיכוב העונש לפגוע בטוהר הליך הערעור.
במקרה דנא, המבקש מעלה שתי טענות עיקריות בערעור: האחת, כי על הכרעת הדין להתבטל. השנייה, כי בכל מקרה יש מקום להקל בעונשו על בסיס הגנה מן הצדק. באשר לטענה הראשונה, מבלי לקבוע מסמרות, יצוין כי מדובר בהכרעת דין המבוססת על ממצאים עובדתיים. ברקע לכך עומדת ההלכה של אי-התערבות על ידי ערכאת הערעור בכגון דא. באשר לטענה השנייה, טענת ההגנה מן הצדק נשענת על העובדה שמעורב אחר באירוע לא הועמד לדין. לא אביע עמדה לגבי סיכוייה של טענה זו. אולם לצורך בקשה זו, וכדי להכריע בה, אומר כי גם אם הטענה תתקבל לעניין העונש – הסיכויים לא נראים גבוהים דיים לכך שבית המשפט יתערב בענישה עד כדי הטלת עבודות שירות או חודשים בודדים של מאסר בפועל.
לנוכח האמור, ועל פי אמות המידה שנקבעו בעניין
שוורץ , דין הבקשה להידחות - וכך אני מורה. על המבקש להתייצב ביום 9.8.2012 בשעה 10:00 במזכירות בית המשפט המחוזי בחיפה, לשם ריצוי עונש המאסר שנגזר עליו. תנאי השחרור בתוקף עד להתייצבות. המזכירות תיתן עדיפות לשמיעת ערעור זה, בשים לב לתקופת המאסר שנגזרה על המבקש.
