ביום 23.11.2011 קיבלנו את ערעור המדינה על קולת העונש שהושת על המשיב בת"פ 33398-05-10 והעמדנו את עונשו על 18 חודשי מאסר. פסק הדין ניתן
יומיים לאחר מועד הדיון ונשלח לצדדים (להלן: פסק הדין ). ביום 29.11.2011 המשיב הגיש בקשה לקיום דיון בנוכחותו לצורך שימוע פסק הדין על מנת שיוכל לממש את זכותו לבקש שינוי ותיקון פסק הדין על אתר בעוד בית המשפט
יושב על כסאו, באשר לטענתו נפלו מספר טעויות בפסק הדין. לבקשת המשיב, ונוכח הסכמת המערערת, קיימנו את השימוע המבוקש ודנו בהשגות שהעלה בא כוח המשיב.

נקדים ונאמר כי לאחר ששמענו את טענות הצדדים. לא מצאנו ככלל שיש בהשגות שהעלה המשיב כדי לשנות מהותית מתוצאת פסק הדין. נתייחס בקיצור נמרץ לשלוש ההשגות העיקריות שהעלה המשיב בבקשה.
א.
בפסק דינו של בית המשפט הנכבד קמא נכתב במפורש כי כתב האישום כלל 11 אישומים כאשר המשיב הודה במעשים הכלולים באישומים 8-1 באופן חלקי וכי המאשימה הסתפקה בתשובה זו. אכן, המשיב הודה במפורש כי תשובתו מהווה הודאה בעבירות שבאישומים 8-1, דהיינו, של לקיחת שוחד והפרת אמונים, וכך גם עולה מעמוד 13 לפרוטוקול מיום 26.5.11, שם נטען על ידי ב"כ המאשימה כי הנאשם (המשיב פה) הורשע על פי הודאתו בשמונה אישומים. אלה האישומים העיקריים מושא פסק דינו של בית משפט
קמא, ולכן לא בכדי, בסעיפים 3 ו- 6 לפסק דיננו התייחסנו בעיקר לנושא המעטפות (תוך אזכור ארגזי הירקות), מבלי להזכיר כלל את נושא המוסכים מושא אישומים 11-9 בהם לא הודה המשיב. עם זאת, מאחר שציינו בפסק הדין כי אישום 11 נמחק מבלי לאזכר כי גם אישומים 10-9 נמחקו (וראו סעיף 2 להודעת הערעור של המדינה שם נזכר כי השוחד כלל גם שירותי מוסך עבורם לא שילם המשיב), אכן היה מקום לציין במפורש בפסק הדין כי המשיב לא הורשע גם באישומים 10-9 שעניינם בשירותי מוסך. לפיכך אנו משנים את פסק הדין בהתאמה.
ב.
תפקידו של המשיב וסמכויותיו הוגדרו בחלק הכללי של כתב האישום המתוקן. שם נאמר, כי בתקופה הרלוונטית לביצוע המעשים המשיב שימש כראש ענף תעסוקה במנהל האזרחי באיו"ש ובמסגרת עבודתו "הנפיק אישורי עבודה לתושבים פלסטינאים בתוך יישובים ישראליים ". אכן, המשיב טען בתשובתו כי הנפיק אישורי עבודה לתושבים פלסטינאים מחוץ לישראל , אך אין בכך נפקה מינה לעניין הרגישות של התפקיד שמילא המשיב כראש ענף תעסוקה במינהל האזרחי, כמי שהנפיק אישורים לעובדים פלסטינים בתוך יישובים ישראליים (בהתנחלויות) ואין בכך כדי לשנות מההנמקה שבפסק הדין.
ג.
על פי האמור באישום הראשון, המשיב סיפק אישורי כניסה לקבלן שסחר במאות אישורים. בתשובתו לכתב האישום השיב המשיב כי אינו יודע אם הקבלן סחר באישורים. איננו רואים ולא ראינו נפקה מינה בתשובה זו להרשעה באישום הראשון, ולא למותר לציין כי כנגד אותו קבלן הוגש כתב אישום והוא טרם מסר ל בית המשפט את תשובתו.

נוכח האמור לעיל יש להדגיש כי לנגד עיננו בקבלת ערעור המדינה עמדו בעיקר מעטפות המזומנים שניתנו למשיב במסגרת האישומים בהם הודה ובגינן הוחמר עונשו של המשיב ולא בגין האישומים בהם לא הורשע המשיב. עם זאת, ולו משום מראית פני הצדק, על מנת שלא יסבור המשיב כי בשל אישומים אלה הוחמר עונשו כפי שהוחמר, החלטנו לנכות שלושה חודשים מתקופת המאסר שהושתה עליו בפסק הדין, כך שבסעיף 9 לפסק הדין ייכתב: "אנו מעמידים את עונשו של המשיב על 15 חודשי מאסר בפועל", במקום 18
חודשי מאסר בפועל, כפי שנכתב.

דין הבקשה להתקבל אפוא בחלקה, משום מראית פני הצדק כאמור בסעיף 3 לעיל, כך שמעונשו של המשיב על פי פסק הדין יופחתו שלושה חודשי מאסר בפועל. החלטה זו מהווה תיקון של פסק הדין.
